William Banda charged and granted bail

Share

William Banda

MMD Lusaka province chairperson William Banda has appeared in court on a charge of inciting violence against patriotic front (PF) cadres but has denied the charge.

Mr Banda has since been granted a 60 million kwacha cash bail, with two working sureties from recognized institutions.

The 65 year old of Lusaka’s Bauleni Township told Lusaka chief resident magistrate Joshua Banda that he understood the charge leveled against him, but pleaded not guilty.

Mr Banda is alleged to have incited violence by instructing MMD cadres to beat and chase the PF cadres contrary to the laws of Zambia.

Magistrate Banda further ordered the MMD Lusaka province Chairman to surrender his passport to court and to be reporting to the Lusaka central police officer in charge every Friday.

But one of Mr Banda’s lawyers Robison Malipenga informed the court that his client had no passport to surrender because it was among his property that was burnt after people attacked and burnt his house after the elections.

Magistrate Banda asked the defence to avail him with the police report which highlighted the fact that Banda’s passport was among the things that were burnt in the aftermath of the September 20, general elections.

Earlier Mr Malipenga asked the court to grant his client bail saying he was entitled to bail according to the provisions of the law.

Magistrate Banda has set 3 October 2011 as dates of commencement of trial.

  1. I hope this is a lesson to those advocating for thugery type behaviour in a democratic society. You will have your day in court.

  2. I shared a platform with this thug in chilenge just before the elections. He is on tape inciting violence with his chawama foot soldier ‘nathan’.
    William you deserve jail

  3. He might embark on another attempt to escape to Malawi before his trial begins, so ZP please put electronic bracelets around his feet so that his movements can be monitored easily.

  4. Some people can not change, William is obviously an incorrible violet man. In 1991 when Government changed, he found himself in simmillar circumstances and got deported, he was only reprived by LPM, MHSRIP. One would have expcted William to sober up and probably if leave politics if he is unable to practice it in a civilised manner. He is now facing same fate. I bet, if you released William, give him a position in PF, he would again unleash terror on people. By the way, William, what abut walkie Talkie you were using, which security wing were you connect to, whose frequency were you using????

  5. Please let’s not beat about the bushes, this man; Saidi Awalli needs to go back home to Marabi (Nyasaland), that’s where he belongs. We cannot be wasting more money (public funds), food to feed *****s like this man in Prison. Chiluba (MHSRIP) will otherwise turn in his grave…

    • He split open buttocks of innocent people. Where did he get the K180million found on him? Let him answer to the charges, he thought others cant be boma! Boma ni boma mambala. Your fellow mambala has been forced into retirement against his will. He should also prepare because the way Sata has started is systematic. The ERB, ZESCO, NAPSA, ZNBS and others will implicate RB and his MMD. Finally, he will have his immunity lifted especially when Sata addresses parliament in two weeks time. Viva hardwork and more money in our buttocks not those for Siliti awe twakana.

  6. Sata is beginning to show his true colours, the man is very vindictive and ignorant. Why has his government freed Judge Ngoma his personal body guard who was convicted of kidnapping and possesion of firearms, but he is taking William banda through the courts fot violence? Judge Ngoma is a statutory criminal – period. What is worse is that victims of Judge Ngoma’scrimes have been left to lick their wounds. Why are the barotse rioters being freed and celebrated as heroes, this is the nonsense Sata is bringing to Zambia. People breaking and destroying public property should be where they belong- jail. Can you imagine the British Prime Minister freeing those rioters in London and celebrating their conduct?

  7. Now that the man has been released on bail, it will be interesting to see whether the likes of Saki will remain vocal in defending him. I think that the law will take its course with Tekere, it was only a matter of time, I am just glad that it came sooner rather than later.

  8. #7 Zeb. That cracked my ribs! If he joined PF MMD cadres would be in trouble. This man is just better off in a cage.

  9. By the way, K60 million bail, not too bad. At least the man has got K83 million left from the K143 million purported to have been in his posession. Even he appears to have benefited from PF slogans, he still has more money in his pockets!! lol!

  10. PF Justice. Look at the broader picture son. OK tell us why Tekere William Banda was not charged with these offences which he committed under MMD rule?

The offences he is being charged for were committed when RB was in power. Tell us why the Police didn`t charge him then.

  11. The bananation of Zambia continues unabated. RB was warned several times but he did not change until the last minute when it was too late. Now, the circus continues. Welcome NAREP!

  12. What is wrong with charging William Tekere Banda mwebantu? If the law doesn`t take it`s course here, expect another version of William Banda in PF infact he can even jump ship like other rats have started doing aleady. We don`t need his kind in our country. Let him be a lesson to PF cadres.

The question I am have been asking is, why wasn`t he charged when RB was president?

  13. # 11 PF Justice, you are a very unreasionable person! The people of Mongu were not accorded the chance to have a peaceful meeting as the permission to hold the meeting was denied by the police by instruction from Rupiah and Kabonde! They insisted on having this meeting and were shot at by police killing some with malice so as to intimidate them. They deserve to be freed. Judge Ngoma and others were protecting the PF and Michael Sata in particular from being scandalised by a political mercenery hence they are political prisoners and there was no proof that they assaulted the man, they just drove him away from his intended venue of press conference to scandalise the future president, they do not deserve to rot in jail! To you and Rupiah, only Chiluba deserved his acquittal, HYPOCRITE!

  14. #6 Seriously, I thought this chap called Nina Chale had brains and it looks like he has gone wako Kaponya style , but again am sceptical because because he could be impersonated since the Nina Chale I know always starts with Good Morning, Good afternoon or Good evening.

Please note that our country is a country of laws even if your punch drunk president thinks he can run it like his party by for example pardoning a PF cadre Ngoma convicted of actually causing bodily harm to somebody. RB never pardon Chalwe. We are watching you

William Banda is innocent until proved guilty and if the law says that anybody on bail should not be tagged with electronic gadgets , then don’t tag William Banda because the law does not say so.

  15. WILLIAM BANDA DESERVES TO BE CAGED FOR A LONG PERIOD. IMAGINE IT TOOK THE AMERICANS 3 YEARS TO CATCH THE LATE FORMER IRAQI PRESIDENT SADDAM HUSSAIN FROM HIDDING BUT OUR GALLANT PF CADRES MANAGED TO FISH OUT WILLIAM FROM HIS HIDDIND PLACE IN JUST 3 DAYS AND THE .PF CADRES SHOULD BE COMMANDED FOR THEIR BRAVERY IN APPREHANDING THIS DANGEROUS CRIMINAL WHO WAS ARMED TO THE TEETH WITH 3 FIRM ARMS NO BOND SHOULD HAVE BEEN GRANTED TO HIM..

  16. # 20 MMD Chief Bootlicker. Remember when you proudly said BOMA NI BOMA whenever your MMD government screwe.d us. Today, my four year old daughter will just say’ GOOD FOR YOU’.

  17. NUMBER 2O YOU ARE JUST TALKING RUBBISH AS YOU ARE A MMD BOOTLICKER. WHAT PROOF DO WE NEED TO SAY THAT WILLIAM BANDA IS NOT GUILTY WHEN HE HAS BEATEN THE OPPOSITION PARTY CADRES AS WELL AS THE VOTERS THAT WENT TO ATTEND THE PF RALLY BEFORE SEPT 20TH ELECTIONS IN FULL VEIW OF THE ZAMBIA POLICE OFFICERS WHO WERE PLACED ON DUTY TO ENFORCE PEACE DURING THESE RALLIES AND MR KABONDE WAS FULLY AWARE OF WHAT WAS HAPPENING BUT NOBODY DARED TO TOUCH THIS SMALL THIN GUY.WILLIAM SHOULD BE BE JAILED FOR 20 TO 25 YEARS SO THAT WE DO NOT HAVE ANOTHER WILLIAM BANDA IN ZAMBIA UNDER ANY GOVT OF THE DAY..IF I WERE A JUDGE HANDLING HIS CASE I WOULD HAVE HAVE GIVEN HIM A DEATH SENTANCE.

  18. Ati “Boma ni boma”, now they are crying. kekekekekekekekekekeke
Say that again, “boma ni ….”, hahahahahahahahahahahahahahahahahahahahaha
You quacks thought you owned the country and the rest of us were residing here at your mercy.
    Mule chimona!

  19. #20 Bootlicker. Please help me with this one. Why wasn`t William Tekere Banda not arrested and charged at the time he was committing these crimes? By the way it was RB as president.

    I am waiting!

  20. #24 Moron, what is the point of having courts and a Minister of Justice if you cannot assume the innocence of any accused person? Just because there is no Faculty of Law at Matero University ot Kulima Tower, does not mean that the country does not operate with the three branches of government. If you are having trouble getting your thick head round that, go revise your social studies or Civics notes.

And No wonder you are not a Judge but a Kaponya, otherwise this country would be on fire, thank God. How do you pass judgement without hearing both sides of the argument?

There are always two sides to every issue, my friend. In fact, no matter how you flatten a piece of paper, it will always have two sides, get that in your Kaponya head

    • Do I detect sour grapes in MMD Chief Bootlicker because of MMD loss? You come across as someone who is educated but given the manner in which MMD conducted themselves in the weeks leading to election, I wonder if anyone in MMD really had brains.

  21. @#28 Bootlicker. Please answer my simple question. Please! I am waiting for your answer.

This comment is awaiting moderation! Pee peeeee!

  22. #27 William Banda was summoned by the Police and given a warn and caution before the elections and the police said that they would investigate. The police have no right to convict anybody. Their task it to bring somebody before the judge with solid evidence and the judge based on the evidence presented by the Police will decide and of course the accuser has to be given the change to defend themselves.

William Banda left Lusaka for his own safety, unless you have been living under a rock , you saw what these lawless Kaponya did to his property and and has anyone in your Kaponya party said anything about crimes committed against William Banda? No , we are watching you.

  23. #30 Boot Fimofimo. So he was given a warn and caution and the Police said they were going to investigate. How nice! Why have they charged him now that he got arrested by citizens and there has been a change of government?

Look sometimes lets try and be objective and put this cadr mentality aside. The man was never going to be charged and he would have found his way out of the country.

I am one person who was calling for a constitution when you cadres were on your high horses blowing your trumpets. It is clear one man called William is going to cost a number of people their jobs. The IG couldn`t touch him because he was doing the job for the then President. Tell you what there are thousands of witnesses in this case of inciting violence.

  24. I do not agree with people damaging his property and if you go back to the MUVI article I questioned where the Police were because MUVI reported that there were about 800 people.

I will tell you why the Police didn`t do anything, they were waiting for instructions from their boss to see whether they had to interven or not. Lets move away from this and let these Police men do their job.

The trouble is you guys thought you were too clever and were not going to be kicked out. Trust me you never expected it no- not this year. Now RB is dropping cases and saying he knows he will be arrested, tried and sent to jail. There is a lot to come out and pray you not one of the people this net will catch. We are watching!

    This message is awaiting moderation!

  25. By the way Bootfimofimo, ERB is gone and there will be an ivestigation. You know some sons of certain people were accused here. Uko!

  26. Oh William! Its sad that your love of money and power has made you to be where you are. Shame on you. The only solution for you is to turn to God and ask for your forgiveness.

  27. #30 MMD BOOT LICKER.

You are right about two sides to every issue. Infact two sides to our comments too! just as there are two sides to RB or even MMD. Why stoop so low against your principles and see only the downside of PF? Is the rest of the world so short sighted to congratulate PF for their victory?
If you cant see any right done by the PF, your comments wont attract readership but just quarells of an immature youths.

  28. utter nonsense you pardon Judge Ngoma for violence as persecution and you persecute William Banda…let the man be….please

  29. #39 boma ni boma judge ngoma needs to be pardoned,he fought for this mother zambia from those sellfish leaders and cadres like william banda

  30. MMD Chief Bootlicker, Can you tell us exactly what your agenda is? What is your problem with the new government? I advise you to work extra hard and revive your chwe, chwe, chwe and nafuti na futi and boma ni boma.

  31. # 11 I agree with you. the president has too much power in Zambia. William will be a political prisoner just like Ngoma. An eye for an eye! Where is the reconciliation process? The week has ended in the president giving orders. This worries me as a Zambian. Most people are being brain washed. Wait it is 5 years and don not underestimate the opposition! 74 + 5 = 79! If you want him for the second term 79 + 5 = 84. Where are the young leaders in Zambia? We are tired of the recycled politicians.

  32. #47…….what orders has the president given so far? It will take another 10 years for Zambia to have a strong opposition party like PF. I’ll tell you one thing my friend. The two elections that we had before Sata became president, were rigged. Plain and clear. This time around, we did not give them a chance. Give us a chance to rule. Accept defeat or else you r only raising your BP for nothing. Sata will make it. Mark my word.

Besides, Zambians need a tough president like Sata. Not like RB who spends most of his time drinking, holidaying with his family

  33. The only way to convict him is to adjust the charge. It will be nearly impossible to connect him with ‘inciting’ violence, but lets wait and see.

  34. Why did this old man come to Zambia? Is it JUJU AT WORK OF GODLY?To me this man is mad.I still remember in the 80’s this man kicking the then MP for Munali and former head master of Munali Mr Kapata at Kabulonga filliing station, and the seting on fire of houses in the eatern province.Just our lady DORA Siliya we know she has two legs one in Zambia and the other one in Maputo

  35. Lest We Forget:
    —————
William Banda and his cadres physically attacked villagers in Chongwe’s Waterfalls’ area for supporting the PF. Several people were beaten up and severely injured. The cadres also smashed windows of two Landcruisers for Sylvia Masebo in full view of police. And Banda, in an interview with Radio Phoenix on Tuesday, said he and President Rupiah Banda were at the centre of the political violence being experienced.
    ************
Rupiah will soon go to jail, says Chitala
    **************
RUPIAH Banda told MMD NEC members that he knows the PF government will send him to jail.
    *************

  36. William has been screwed up,utulumendo twalimuchita akantu mambala. Especially those overzealous and energetic recuits from Lilayi kekekeke. Never the same again. Soon will go for a second round. Booty chatile sit down nicely with William and ask him what happened to him
