MMD Lusaka province chairperson William Banda has appeared in court on a charge of inciting violence against patriotic front (PF) cadres but has denied the charge.

Mr Banda has since been granted a 60 million kwacha cash bail, with two working sureties from recognized institutions.

The 65 year old of Lusaka’s Bauleni Township told Lusaka chief resident magistrate Joshua Banda that he understood the charge leveled against him, but pleaded not guilty.

Mr Banda is alleged to have incited violence by instructing MMD cadres to beat and chase the PF cadres contrary to the laws of Zambia.

Magistrate Banda further ordered the MMD Lusaka province Chairman to surrender his passport to court and to be reporting to the Lusaka central police officer in charge every Friday.

But one of Mr Banda’s lawyers Robison Malipenga informed the court that his client had no passport to surrender because it was among his property that was burnt after people attacked and burnt his house after the elections.

Magistrate Banda asked the defence to avail him with the police report which highlighted the fact that Banda’s passport was among the things that were burnt in the aftermath of the September 20, general elections.

Earlier Mr Malipenga asked the court to grant his client bail saying he was entitled to bail according to the provisions of the law.

Magistrate Banda has set 3 October 2011 as dates of commencement of trial.

  3. He might embark on another attempt to escape to Malawi before his trial begins, so ZP please put electronic bracelets around his feet so that his movements can be monitored easily.

  4. Some people can not change, William is obviously an incorrible violet man. In 1991 when Government changed, he found himself in simmillar circumstances and got deported, he was only reprived by LPM, MHSRIP. One would have expcted William to sober up and probably if leave politics if he is unable to practice it in a civilised manner. He is now facing same fate. I bet, if you released William, give him a position in PF, he would again unleash terror on people. By the way, William, what abut walkie Talkie you were using, which security wing were you connect to, whose frequency were you using????

    • He split open buttocks of innocent people. Where did he get the K180million found on him? Let him answer to the charges, he thought others cant be boma! Boma ni boma mambala. Your fellow mambala has been forced into retirement against his will. He should also prepare because the way Sata has started is systematic. The ERB, ZESCO, NAPSA, ZNBS and others will implicate RB and his MMD. Finally, he will have his immunity lifted especially when Sata addresses parliament in two weeks time.   6. Sata is beginning to show his true colours, the man is very vindictive and ignorant. Why has his government freed Judge Ngoma his personal body guard who was convicted of kidnapping and possesion of firearms, but he is taking William banda through the courts fot violence? Judge Ngoma is a statutory criminal – period. What is worse is that victims of Judge Ngoma’scrimes have been left to lick their wounds. Why are the barotse rioters being freed and celebrated as heroes, this is the nonsense Sata is bringing to Zambia. People breaking and destroying public property should be where they belong- jail. Can you imagine the British Prime Minister freeing those rioters in London and celebrating their conduct?

  7. Now that the man has been released on bail, it will be interesting to see whether the likes of Saki will remain vocal in defending him. I think that the law will take its course with Tekere, it was only a matter of time, I am just glad that it came sooner rather than later.

    The offences he is being charged for were committed when RB was in power. Tell us why the Police didn`t charge him then.

The people of Mongu were not accorded the chance to have a peaceful meeting as the permission to hold the meeting was denied by the police by instruction from Rupiah and Kabonde! They insisted on having this meeting and were shot at by police killing some with malice so as to intimidate them. They deserve to be freed. Judge Ngoma and others were protecting the PF and Michael Sata in particular from being scandalised by a political mercenery hence they are political prisoners and there was no proof that they assaulted the man, they just drove him away from his intended venue of press conference to scandalise the future president, they do not deserve to rot in jail! To you and Rupiah, only Chiluba deserved his acquittal, HYPOCRITE!

    Please note that our country is a country of laws even if your punch drunk president thinks he can run it like his party by for example pardoning a PF cadre Ngoma convicted of actually causing bodily harm to somebody. RB never pardon Chalwe. We are watching you

    William Banda is innocent until proved guilty and if the law says that anybody on bail should not be tagged with electronic gadgets , then don’t tag William Banda because the law does not say so.

  20. #24 Moron, what is the point of having courts and a Minister of Justice if you cannot assume the innocence of any accused person? Just because there is no Faculty of Law at Matero University ot Kulima Tower, does not mean that the country does not operate with the three branches of government. If you are having trouble getting your thick head round that, go revise your social studies or Civics notes.

    And No wonder you are not a Judge but a Kaponya, otherwise this country would be on fire, thank God. How do you pass judgement without hearing both sides of the argument?

  22. #27 William Banda was summoned by the Police and given a warn and caution before the elections and the police said that they would investigate. The police have no right to convict anybody. Their task it to bring somebody before the judge with solid evidence and the judge based on the evidence presented by the Police will decide and of course the accuser has to be given the change to defend themselves.

    William Banda left Lusaka for his own safety, unless you have been living under a rock , you saw what these lawless Kaponya did to his property and and has anyone in your Kaponya party said anything about crimes committed against William Banda? No , we are watching you.

    Look sometimes lets try and be objective and put this cadr mentality aside. The man was never going to be charged and he would have found his way out of the country.

    I am one person who was calling for a constitution when you cadres were on your high horses blowing your trumpets. It is clear one man called William is going to cost a number of people their jobs. The IG couldn`t touch him because he was doing the job for the then President. Tell you what there are thousands of witnesses in this case of inciting violence.

  24. I do not agree with people damaging his property and if you go back to the MUVI article I questioned where the Police were because MUVI reported that there were about 800 people.

    I will tell you why the Police didn`t do anything, they were waiting for instructions from their boss to see whether they had to interven or not. Lets move away from this and let these Police men do their job.

    The trouble is you guys thought you were too clever and were not going to be kicked out. Trust me you never expected it no- not this year. Now RB is dropping cases and saying he knows he will be arrested, tried and sent to jail. There is a lot to come out and pray you not one of the people this net will catch. We are watching!

The two elections that we had before Sata became president, were rigged. Plain and clear. This time around, we did not give them a chance. Give us a chance to rule.   33. The only way to convict him is to adjust the charge. It will be nearly impossible to connect him with ‘inciting’ violence, but lets wait and see.

    William Banda and his cadres physically attacked villagers in Chongwe’s Waterfalls’ area for supporting the PF. Several people were beaten up and severely injured. The cadres also smashed windows of two Landcruisers for Sylvia Masebo in full view of police. And Banda, in an interview with Radio Phoenix on Tuesday, said he and President Rupiah Banda were at the centre of the political violence being experienced.
