President Sata appoints new Anti-Corruption Commision Chief

President Michael Sata has appointed Rosewin Wandi as Director-General of the Anti-Corruption Commission, replacing incumbent Colonel Godfrey Kayukwa.

Mrs Wandi has worked at the Anti-Corruption Commssion for over 25 years where she has risen from the junior ranks to her new position.

“In exercise of the powers vested in me pursuant to the provisions of Section 16 (1) of the Anti-Corruption Commission Act, Chapter 91 of the Laws of Zambia, I hereby appoint you as Director-General of the Anti-Corruption Commission. This appointment is subject to ratification by the National Assembly,” stated the President in his letter of appointment to Mrs Wandi which is contained in a State House press statement.

“Mrs Wandi’s appointment confirms President Sata’s commitment to gender balance by ensuring the appointment of women to high positions of authority.” read the statement issues by new Special Assistant to the President George Chellah

  1. MR SATA HAS DONE THE RIGHT THING BY APPOINTING MRS WANDI AS THE NEW CHIEF OF ANTI CORRUPTION.FORMER BOSS MR KAYUKWA SHOULD BE FULLY INVESTIGATED BY THE PF GOVT.

  2. people i dont think president Sata has followed the law can we be educated if someone was appointed and ratified by parliament isnt he suppose to be fired the same way? was the necessary Law sited i wonder. who is the leagal advisor please mwebantu

    • This has been the trend my friend. The president appoints and disappoint, the only parliament does is to ratify the appointed person. The law does not provide such commissioners to be removed by parliament. It is the same thing with the DPP, ECZ, DEC etc, the president appoints and parliament ratifies but he can simply disappoint without parliament consultation. Parliament only checks if the person appointed is qualified enough and has the caliber to hold such an office. He has therefore not contravened the law.
      Maybe we have to change the law that such appointments can only be disappointed through parliament. In this way the appointees will not be able to be pushed around around by the appointing office!

    • when disappointing, parliament can’t do anything except they are free to move a motion in parliament and discuss if the disappointment was not genuine or for any other reasons not worthy doing it. for instance, if the president fires the chief justice due to him hitting a same girl with the presidents brother, parliament is free to discuss it and bring it to the presidents attention. in developed countries, impeachment process might start out of that. always the appointing authority disappoints with good reasons know to parliament.

Now let him be investigated thoroughly and see whether for sure he didnt know any thing about the cases of corruption that he was trying to blindly defend.     The reason is very simple; they over trusted and over-expeted from Obama, yet they have met with the worst economic hostility of their time.
    MMD supporters and reservists who dont expect much from SATA’s leadership have their hearts well guarded.
    I pity the street boys and the youths and their Kaponya (both educated and uneducated) group of individuals who see SATA as a saviour.

The Anti-Corruption Act, 2010.Tenue of office of Director General Section 10(2) states, a person appointed Director-General may be removed from office for inability to perform the functions of office,whether arising from infirmity of body or mind or from any other cause, or for misbehaviour.Section 10(3) states if the president considers that the question of removing a person holding the office of Director General from office ought to be investigated, then-
    (a) the president shall appoint a tribunal which shall consist of a chairperson and not less than two members, who hold or have held high judicial office;

  23. (b) the tribunal shall inquire into the matter and report on the facts thereof to the president and advice the president whether the person holding the office of the Director General ought to be removed from office under this question for incompetence or inability or for misbehaviour.

    • What is the reason for terminating Kayula’s contract? Unless we know, it is difficult to jump to a conclusion that a tribunal be set up.IS HE BEING INVESTIGATED FOR ANY VICE? Looking at the quotation you have, the President is perfectly right to remove an unperforming DG of ACC.

  24. This is a perfect appointment! If you all care to recall, Mrs Wandi was dropped for wanting to arrest Mwawnaumo then at FRA now at RDA. So she must move and investigate RDA contracts. FRA contracts, adn of course one Kayukwa.

    REVELATIONS of dealings at National Housing Authority (NHA) which led to a loss of K3.5 billion were expected the very day Elias Mpondela was appointed chief executive officer, Given Lubinda said yesterday.
    And Lubinda has said President Rupiah Banda should start providing answers for the abuse of money at NHA by Mpondela.

Commenting on revelations last week that K3.5 billion realised from the sale of properties seized by the Task Force on Corruption had been swallowed by Ecobank in its effort to recover the K8.5 billion NHA overdraft, Lubinda said Mpondela was exhibiting levels of rudeness of the matter because he does not even have a board to report to.
    The K3.5 billion was money in the custody of NHA and Lubinda has advised Mpondela to own up.
    “The revelation of the dealings at the National Housing Authority were expected the very day when a political cadre was appointed managing director because unfortunately, he answers to his appointing authority who also depends on him for his continued hold on to power,” Lubinda said.

  27. “All of us know that Elias Mpondela is just a cadre, MMD chairman for Lusaka Constituency. When you make such political appointments to institutions as important as National Housing Authority, first of all you will misdirect its mandate. Secondly, you lose the focus on the reporting routine because Mpondela does not even answer to the board. He answers to his party president and you can see the mischief of Mpondela denying a well know fact.”
    He also dismissed Mpondela’s statement that the money from the Task Force on Corruption was still intact and would be made available when it was demanded.

  28. Lubinda said the only way NHA would make available money from Task Force on Corruption was through acquisition of further overdrafts.
    “Look at how mischievous he was when he said he would make the money available if the money is demanded by the government,” he said. “It is not the question of government demanding, it is about he owning up and telling us ‘yes this money is still being held and where is it.’ For him to say he can make the money available, of course, he will make the money available by just increasing the overdraft.”
    Lubinda called for an immediate audit of NHA and other institutions keeping proceeds realised by the Task Force.

  29. “It is important for NHA to be subjected to an urgent audit particularly that all cases that the Task Force was following are now being acquitted and thrown out of court,” Lubinda said. “Can all those institutions that are holding money that was realised by the Task Force be subjected to an audit so that we know where this money is and NHA must the first to be audited? The cheekiness being exhibited by Mpondela only raises anxiety in the minds of citizens.”
    And Lubinda who dismissed assertions by Mpondela that the overdraft from Ecobank was used to finance operations of NHA, said President Banda should provide Zambians with answers on Mpondela’s handling of issues at NHA.

    “Overdrafts and loans are acquired for capital expenditure and not for paying Mpondela allowances. You don’t use loans for operations. That is a scandal that President Banda cannot run way from.”
    Lubinda said intentions of late president Levy Mwanawasa to ensure the money recovered by the Task Force on Corruption was taken back to the Zambian people had been defeated.

  34. Let’s not get carried away. This is expected of every new government in office, it has to appoint its own men and women. Chiluba did the same when he was elected into power, so did Mwanawasa and RB. So, its not magic what the president is doing, its just the precedence and just doing the right thing. All heads of major parastatals will definitely feel the new wind of change as long as it is legally done and in consultation.

  37. Well put Hon. Lubinda, pliz extend the audit to Zampost where the CEO was even mocking the PF govt in yesterday’s management meeting. He said how can a sane president start his work by renaming airports, he went on to say he is waiting to see where the ‘Don’t Kubeba’ thing will take us. He said these chaps (PF) will definately fail. He drives a vehicle bought by Zampost at about 1 billion Kwacha. He spent over 1.4 billion Kwacha to renovate his house. He bought another vehicle for his office for about K400 million in a space of 2 months. His mobile handset cost Zampost about K9 million. Pliz move on Zampost quickly.

  38. Zampost is no longer a viable company, its also surviving on overdrafts. The swiftcash money has all gone missing and money transfer clients are paid through overdrafts including salaries. Pliz carry out an independent investigation and prove me wrong.

The next thing is to start reducing the number of diplomats in our missions.So many cadres who do nothing ,just waiting for our phone calls to claim for our allowances once in 3 months.Zambia is really rich.So much to spend outside while teachers home get peanuts.RB sent alot of his cadres in our missions abroad.Most of them own the missions and treat Zambians like bull-shit.We need qualified stuff to handle such missions and not cadres.

  46. The President has no powers to remove the Director General of ACC without a resolution passed by two thirds of the MPs. that a tribunal be put in place to investgate the removal of the DG of ACC.

  47. #56, i equally wonder but you must know that currently, the president has too much power and you must know that currently the national assembly has not been called to sit as the previous one was dissolved by RB. So according to the powers conferred upon him, he can hire and fire any one he is allowed to appoint under the 1996 amended constitution. that’s why we need a new document which will protect even less privileged persons
