
ATTORNEY General Mumba Malila has instructed his chambers to appeal against the High Court judgment which quashed the decision by Chief Registrar of Societies Clement Andeleki to de-register the opposition MMD.
Mr Malila said in an interview in Lusaka yesterday that it was vital in a case of such nature to seek a final ruling in the Supreme Court.
Lusaka High Court Judge Jane Kabuka on Thursday quashed the decision to de-register the former ruling party, saying the move was excessive and irrational.
But Mr Malila said he would proceed with the appeal today.
“We are definitely proceeding with the appeal and instructions have been issued to challenge the High Court judgment today,” Mr Malila said.
Mr Andeleki said in a separate interview that the judgment had the capacity to set a bad precedent which would make it difficult for his office to collect revenue from defaulting political parties.

Its not right Mr.A.g to appeal for the sake of appealing.U ought to have proper grounds of appeal.I know u as a Commercial Law specailist.I doubt if u appreciated the reasoning of her Lordship in an Administrative Law case.I had time to read the judgement and i believe u ill waste the time of both the Law and the Supreme Court.

Stop whingeing and mourning MMD cadres, and confirm the fact that government, to quote Mwanawasa, must be of laws and not of men. If MMD breaks the law MMD must bear legal consequences.

this is being retrosgressive. i think there are more bigger things to be attended other than a debt of K300million whihc can and must still be collected. i dont think the judgement meant the money should not be collected. I totally agree with # 1 , its not in the best interest of Democracy in Zambia, MMD must be told to pay up, De-registering MMD will be excessive and very expensive both for the Government and the people who will be caring out all those bye Elections the only Party who will be happy of this decision is the PF…. They are in Govt and will have resources to contest all those Seats….hence make them more powerful in Parliament

Honestly the whole AG can’t use his power of reason that this appeal won’t work. Why are they so scared of having opposition parties providing checks and balances.Andeleki is a misguided cadre who is unfortunately misleading the AG. I know that the judicially will act proffessionally on this matter and will uphold the High Court rulling. Shame on you all haters of democracy.

It is excessive and unreasonable because we pounced on it as an opportunity after ignoring it for over 2 decades. There are so many other things that are coming to roost: illegal shanties that have grown too large to ignore or to tear down (dilemma); eyesore shops and institutions that have become too expensive to rehabilitate or facelift (dilemma); laws that have been broken for too long that it becomes unreasonable to apply them without netting unsuspecting ‘valuable’ fish (dilemma); This seems to be the lot of the Zambian society. If we are spending a lot of money to de-register MMD for K300,000,000 then why do we still have the Post Newspaper which has K14 billion of tax payers money. …. Reposes the post and sale off their assets to collect our K14 billion….. Leave MMD alone
That’s the way to go Mr AG, some judges are making judgements without regard for precedence. A lot of questions remains unanswered concerning Chiluba because of bad judgements. Is it legal for the President to use Government accounts to conduct his personal businesses?
A lot of people do not understand the gravity of the judgement, that’s why they keep condemning the appeal. In this case the Judge was caught up in emotions, she should have applied the law the way it is written.
This Attorney General does not seem to be a servant of the people. He should have been the lawyer for PF secretariat not Zambian govt. Do you want a One Party State which seems to be the preferred model of govt by your master? Start working for the people not an individual! Are you mindful of the consequences of de-registration? instead of giving money for bye-elections, direct it to the lecturer who are on strike and youth employment!
Is this man trying to appeal against the vedict normal. Does he understand what it means to deregister a party of MMD’s magnititude? Zambia shall never develop as long as we continue witch hunting. Take people to court because they have not paid farmers, not done a good job on roads and others. What economic development will be brought up by deregistering MMD?
So will Mr. Andeleki finally resigne when PF looses this one?
At first this case seemed to be genuine but now i truly think it is PF Engineered. Instructing the registrar as well as the A.G I think this case should have ended here. Definitely MMD will win the case in the Supreme court but this will also be bad for the PF as it will be seen as persecuting the MMD rather and a normal prosecution(whatever the case we will find out). I actually thought that Mumba Malila was a balanced person this now gives me question marks, anyhow this could be his personal decision based on facts lets see how he goes further in cases to come. The London court judgement should also now be registered if he is truly a man of integrity and one who believes in justice.
