Dear Brothers and Sisters,

There comes a point when any reasonable and honorable person must break their silence and speak out, even when in doing so they will most certainly face retaliatory consequences. Given recent events in Zambia, for me, that time is now.

We have found ourselves under the rule of a government that has little regard for the constitution, rule of law, or the rights of citizens. People have been jailed for insulting the president, journalists have been hounded and threatened, our economy ravaged by nepotism and incompetence, and many opponents falsely accused as part of the Patriotic Front’s witch hunt to wipe out political competition. The intolerance has been extended even to the clergy as only last week a Catholic priest was deported for daring to merely speak for the poor. His deportation was executed in a manner similar to a rendition of a terrorist suspect, as no one knew his whereabouts after being picked up by the Special Branch Intelligence until he resurfaced in Rwanda

Although I am one of those who have been falsely accused, this is not the reason for me to break my silence. Instead I wish to raise urgent concerns regarding the toxic brew of tribalism that is being stirred by leading members of the Patriotic Front.[pullquote]As a person born of a Bemba mother, and whose father proudly married a Bemba woman and named my daughter Mwansa, a Bemba name, I am disgusted and outraged by these crude attempts to manipulate the Zambian people by exploiting ethnic divisions.[/pullquote]

On the 20th of July, the Post Newspaper published a blatantly fictitious article quoting an “anonymous source” who claimed that my father sought to deprive the Bemba people of political power. One can only assume that this bogus news article was planted by the PF, because the newspaper declined to interview any other parties and was immediately followed by a hostile statement from the government that aimed to stir up ethnic tensions.

And now, after slandering my father and placing him in danger, the PF government is once again attempting to tamper with his security which he is entitled to as a former Head of State.

Playing political games with tribalism is unspeakably dangerous and irresponsible. Zambia is a nation of no fewer than 73 different tribal groupings. Among prominent groups such as the Bemba, Ngoni, Tonga, Luvale, Lunda, and Lozi, there are decades-long grievances that must be carefully and peacefully managed. Unlike many neighbors, we have largely avoided ethnic violence and civil war thanks to representative democracy and leadership that respects diversity. Unfortunately, that too is under threat today. My father has resolutely stood up for unity in Zambia, in both words and action. His cabinet was comprised of members hailing from all the provinces of Zambia, building on a tradition set by our founding President Kenneth Kaunda and observed by both Frederick Chiluba and Levy Mwanawasa. The currently Patriotic Front cabinet, however, is particularly lopsided, dominated by at least 10 people from Northern Province. Many of these officials appointed by Sata are familial relatives, which is the source of much unnecessary resentment and suspicion.

Pastor Nevers Mumba, the new Bemba leader of the Movement for Multiparty Democracy (MMD) party, has rejected the Patriotic Front’s attempt to exploit tribalism. Furthermore, Dr. Mumba has wisely observed that “it is important that this government should respect the fact that wisdom or intelligence comes from all areas of the country.”

Tribalism represents a zero-sum game. If you appeal to tribalism, there are only winners and losers, and there is no compromise or negotiation. This is something that my father worked against his whole career.

My friends, we cannot allow the Patriotic Front to use ethnic tensions as a smokescreen for their misconduct and fear of accountability. One only has to speak to fellow Zambians to understand that this is not how most people feel, and you will see how far the PF have strayed from both their principles and promises[pullquote]My friends, we cannot allow the Patriotic Front to use ethnic tensions as a smokescreen for their misconduct and fear of accountability.[/pullquote]

Some people have asked why I have remained in South Africa while the new government slanders my family in the media with false statements. I understand the government of Zambia wishes to speak to me about certain unknown allegations which they have declined to define. Since the government has threatened me, sued and threatened my attorney, and improperly influenced the prosecutor and judiciary within Zambia, I will not return to Zambia when my basic human rights will not be honored, as there is no indication that the investigation is nothing more than a witch hunt.

However, in order to be responsible to the rule of law, I have advised the government that I am presently in South Africa and am willing to assist in any lawful investigation and answer questions in this neutral environment. But despite having notified the Zambian authorities of my whereabouts in a letter dated 9 March 2012, the Zambian government has neglected to respond, failed to ask questions, and declined to take any action whatsoever, leading to the conclusion that their accusations are not credible and cannot be considered anything more than a politically motivated smear campaign.[pullquote]However, in order to be responsible to the rule of law, I have advised the government that I am presently in South Africa and am willing to assist in any lawful investigation and answer questions in this neutral environment.[/pullquote]

It’s one thing for a politician to attack opponents, but it’s another thing to play games risking the stability and peace of the entire nation for the sake of power. It is time for us to restore dignity, law, and respect for all citizens of Zambia. The government should attend to its business, not engage in the business of persecution, defamation, and appealing to the base instincts of man. If we do not demand these improvements, I fear for what may come next.

As Zambians, we are better than this, and we deserve better than this.

I totally agree with this article.Never has there been so much tribalism in Zambia like we are seeing under the PF government.Never has there been so much intimidation of journalists,opposition leaders and sadly the former head of state and his family.Now the church is being houded.They didn’t follow the law is deporting the Priest but are now asking us to follow the law in airing our grievances.former army commnaders have been slandered,police reduced to chola boys for politicians,judges threatened with dismissals and pupet tribunals set that taxpayers have to pay for.whats with the all bemba cabinet? The enemy is out to destroy our counrty we mustnt let it happen.We need to pray for the redemption of our land and repent for ignoring reason and voting PF to power.

Here, you are a declared thief and only by proving yourself innocent will the people believe you are otherwise. Why are you diverting our attention from the issue that affects you? This government is using the accusation of tribalism to silence all opposition and divide the nation. Wonder what would have become of Zambia if these guys were our first government after independence…? Apart from the 30yr civil war we would have experienced, of course!!

    • Are you really that dull? Henry is only being sought to answer certain questions investigators have. How do you expect law enforcement to charge someone based on rumors? Because what investigators have at the moment can only best be described as “rumors”. And it is up to Henry to formaly clear those “rumors” like we are all obligated to do as citizens—not to be barking from afar!

      Has the Police he once trusted to when his father was in power to go after people (e.g. Mr. Mpombo) he felt agrieved him suddenly lost all objectivity that he can’t get a fair shake? Or dose he know something that concerns him when it comes to who gets charged and or not since his father seemingly directed such things from State house? Let your friend come home to answer questions like everybody else!

I voted for and supported PF but to be honest certain things are not done in the right manner.This party should be seen to do things differently from The MMD and UNIP ways and i think thats why they won. It is up to them to listen even to their political enemies and do what the majority voices desire failure to which the end is very predictable. As for MMD members as much as you have the right to complain you should be reminded that you had the same arrogance which PF is starting to exhibit and you never wanted to listen, now do you see how it feels!. As for PF my heart bleeds with pain i did not know that power can make you deaf and the goodness is that their is still time for the leadership to change if not we will make the change in 2016

  22. This article is well written and clearly well thought out. The author clearly states his position and his advice is very valid indeed. We are all innoccent unless proved guilty. In PF, you are guilty as soon as the almighty president of theirs says so. Even FTJ, who I considered to be the worst Zambian President, was by far better than what we have today. Are there any genuine intellectuals in PF, please be brave and help this man. Zambia is bigger than PF and certainly bigger than one man’s boat, speak out and save Zambia even if you are kicked out of the man’s sinking boat. Your children will forever adore you for your honourable act of stopping a failing and help it reform if at all it has the capacity to reform. Does your president listen to advice?

    • Yes, we are all “innocent untill proven guilty”, and we all show up to answer questions when called upon by law enforcement officers so we don’t stall the wheels of justice. We don’t run away like cowards and start barking from afar in the hope of winning public sympathy! By the way, who has found Henry Guilty since he hasn’t even been charged with any crime yet? I thought he is only being sought for questioning!!!!!!!!!

  23. My observation is very simple. The writer of this article is not in Zambia and almost everyone who has made a comment is also not Zambia. When you get to Zambia, you will not experience the tribalism you are talking about. Every tribe is working harmoniously with one another. Honestly if tribalism in our country the way it is portrayed by some of you, I can bet Zambia would be a no go country. Lets just enjoy freedom of expression!

First, he has married a wife who is your age, secondly, he’s the shortest serving president of Zambia and even his term of office belonged to the late Mwanawasa. Thirdly, for the first time in history, a president is accused of corruption alongside with his children and wife. Even Chiluba did not sink to such levels. If I were you, Henry, I would keep my mouth shut and enjoy my hide-out before someone smokes me out. You are a disgraced family and the sooner you realize that, the better. We know you were in charge of procuring crude oil for INDENI. Your father ran the most corrupt regime in the history of the country. Not even Kaunda, who ruled us for 24 years, has ever stolen like your father did in just three years. So just shut up!

It is a well known fact that in this PF government, one can only get an appointment if they’re Bemba. The country has never been divided as it is today since independence. I miss RB at least we had sanity. Tribal hatred to the point of trying to take away land from other tribes all in the name of realignment. Mr President can do better than this. Most of the people who voted for him are not even Bemba, so why does he feel that he’s there to champion the Bemba cause and make Bemba’s better economically only? Let the president realise that he’s now the father of the nation and embrace everyone. I wonder if he loves his children equally because charity begins at home.

  30. I have to say, he makes his point very well. His lawyer has been prohibited from entering Zambia. Interpol have been brought in, in spite of there being no indication of what he is being accused of…

    I have no idea whether the Banda family misused the privilege of being in public office or committed fraud, and if Henry is guilty of something he should be brought to justice. But it is more important that justice is pursued the right way, than that an individual case is settled. For me, the big question is not “did he do it”. The question is whether Zambia has a judicial system that all people can trust.

  31. the article is well written except for one thing. at the beginning of the article it was said that the purpose was not about allegations against him. here are his words “Although I am one of those who have been falsely accused, this is not the reason for me to break my silence”. 

    But the last 3 paragraphs are exactly about this issue. This boys behaved like GBM ordering the ministry of finance to give them tenders and today they was to behave as if they saints by taking advantage of the lapses the PF is making. Its important that these matters be dealt with separately. The PF are making these guys looks like saints.

  33. Very well written. It is however a non-starter because no one wins against Bemba hegemony in Zambia unless they are Bemba themselves. It was preposterous to say that ‘tribalism runs in Rupiah Banda’s blood.’ Rupiah Banda married a Bemba woman Miss Makulu. His other child Andrew was with a Lozi woman, and he had another child before that with Miss Masekela of South Africa. Rupiah’s parents were Chewa and Ngoni. How can such a person be tribalist sure? His cabinet was well balanced from all regions. BUT look at Michael Sata. His wives have been Bemba and Christine Kaseba is Lala. His Cabinet is full of Bembas and Bemba speaking non-Bembas. Cabinet secretary is Bemba. Deputy Cabinet Sec is Tumbuka but speaks fluent Bemba. Please! This country is in danger of destruction!

    • Well, it was Rupiah Banda who told his tribal kinship in Eastern province never to vote for anyone who does not come from that area. Have you already conviniently foregotten about that?

      The old man does not seem to care who he goes with to bed, but when it comes to running the affairs of the country, yes, he is a big tribalist! His tribal sentments are not new. KK fired him (from the ministry of home affairs, if I am not mistaken) over this same problem he has with tribalism!

    • That is why even identical twins are separate indiividuals with discrete ways of approaching issues. Some people fear bugs while others eat them. Henry and Andrew are completely different individuals. Even their looks are completely different, so expect them to handle issues differently. Just human nature.

  35. Just stay in SA. If you really wrote that letter and never got a response then I think thats enough evidence that you need that you will not get just treatment. If you come here kiss your businesses goodbye as you never know how long you will be in prison without bail. Even men of the collar are getting deported here. Things are not good. There are some people who only believe once it affects them directly. Well to those wait til it does affect you. For Henry you stepped on people’s toes in your persuit of business using your state house connections. The people in office now will not let you be. Better you remain in South Africa.

  36. First things first: While I must state from the start that the PF really need to pull up their socks, I’d like to say the following about their alleged tribalism:
    When these guys came to power mostly their MPs came from the copperbelt and northern as well as Luapula province. Naturally u expect Sata to appoint from among the pipo who ran the race with him. That is not to say he should just stick to one side of the country. Appoitnements should be done on merit.
    I ll go ahead and point out that the cabint has no Tonga MP at the moment….TBC

  37. Sata has lately been appoiting MPs from the opporition and these are being threatened with expulsion by their parties. Only a few days ago the UPND made it very clear that they ll expel any of their MPs who gets appointed to govrnement. So question is: how are we gonna have a Tonga Minister cause almost all of them are UPND?
    That said, the PF still has to do a lot in fullfilling their campaign promises. So far they dont seem to be doing that.
    Back to Henry, Baba, just come back and explain yourself like your bro has done. Stop trying to incite us, We are too intelligent to fall for your cheap flattery….

  39. I thought you will write about the wrongs you have done, taking Zambians for granted and use tax payers’ money to enrich yourself. We have to be very careful with what we write. I am not Bemba but honestly don’t see tribalism happening unless being in Diaspora. People back Home. Is this happening?? Or it is just hear say considering that Henry is not in Zambia.   41. Seeking public sympathy in a very unusual way, Henry!

    Show up like every responsible Zambian citizen is obligated to do and answer questions investigators have. If your foreign lawyer is not licensed to practice in Zambia, find a Zambian lawyer (they are cheaper) and go with him/her and answer questions. Maybe then you will have some legitimacy to complain about what is going on in our country. As for now, cowards like you should just zip it!

    As far as defending you Dad goes, well, no surprises there! Does anybody really expect you to say anything different as a son? We surely don’t expect you to acknowledge the tribalism of your own father. But public records prove your statements hollow on this issue. Your statements concerning tribalism can best be described as self-serving!

  42. Henry, your father could have been a president of zambia today if it was not because of his corruption. You failed to assist your father instead you be came the master of corruption. I can promise you that one day things will catch up with you. What goes up always comes down. We are not worried of CNP rule because is quiet aware that 2016. Your letter confirms that you are uncomfortable in South Africa because you are not a star there way you used to be in Zambia.     The terminology we are using must be avoided at all costs. This tribalism and the sorts we continue to discuss only makes more and more damage than good. Let us be careful on how we are using these social media’s.
    Zambia is a great country and we are very priviledged to be a part of this nation. Let us unite more than ever because we enjoy a democractic country. The PF have been in power less than a year and they still have another 4 years to fufill their election campaigns and us Zambians, if we feel that the PF have done nothing positive, then the onus is in our hands. Let us continue to work together for the good of this Zambia in the sun. Let the democractic process take its course. As for Mr. Henry Banda, avail yourself and let the investigations prove u right

Unfortunately, you and your father, Bwezani, have no moral authority to talk about tribalism, the socio-economic and political decay in Zambia.   46. Interesting article written by some one in a foreign land. Mandela was fighting a war whilst in prison in RSA. Henry go back home and fight this war whilst in prison in Zambia if you are really interested in the affairs of Zambia.

    • Thanks for poiting that out. This just shows that Sata had to choose from what was available to him. I bet this was the only available Tonga man. But at the end of the day whoever he chooses is expected to deliver for the country regardless of where they hail from. Besides, lately, a good majority of us, despite carrying the tags of particular tribes have never even been to ‘our villages’ and can not even speak the same languages alleged to be ‘ours’.. Pipo we need to move on – and fast, for our own good!

  47. Henry Banda is either a genius or a criminal as he turned his financial situation in record time during his fathers presidency. I choose to believe the later and Zambians should watch-out for Rupiahs’ children as they would love a war so that they could easily benefit through anarchy! Some bitter comments above drive chills in my spine. How can a sane man take issue with the fact that the deputy secretary to the cabinet is Tumbuka but speaks fluent Bemba like The saint @ # 43? If you Zambians want a balanced cabinet start by avoiding to allign yourselves to parties that belong or are lead by your tribe-mates. It is insane to expect the president to pick people who have no allegiance to his ideals just for the sake of tribal balancing! MCS will be unpopular as long as he fights corruption!

  53. Beautifully written article, thoughtful and intellectually refreshing. This is a total representation of the state of affairs and how the majority of Zambians feel. The author has revealed interesting points that we never knew about, like writing to government revealing his whereabouts and his willingness to be interviewed or be charged in a neutral state. SA is an accompished democracy with fully functioning civic arms, in addition it is a segnatory to the Geneva convention of human rights. If there is an offence Henry committed be rest assured SA can extradite him. It is not hard to understand why Henry is not in the country. The catholic priest is testament to that. Apparently CNP tried him under the cover of darkness, found him guilty and deported with no legal representation.

Innocent people were accused and removed by your father. If you were decent you would have told your father in fact you should have written him a letter to stop accusing innocent people and to focus on development, you were already a grown man then. Secondly, who was the first to exhibit tribalism between people complaining now or Mr Sata? how many MPs does Sata have from Southern and Western provinces? How was Sata received each time he went to southern province especialy? Lets know that Mr Sata is just a human being who can react in one way or the other. Why do you want Sata to appoint enemies in to office? He went to them during compign and they rejected him then whats the noise all about?     If people will continue voting on tribal lines then am afraid certain tribes will never produce a president considering the geographical distribution of tribes in zambia. Mr Sata tried to break these tribal barriers by going round southern and western provinces preaching the message of one zambia one nation which was rejected. Mr Sata was ready to work with all the people complaining today but they rejected him because he is Bemba and they did not believe he would become president.       By the way, Kick-backs tend to distorte the real and fair value of contracts. Contracts usually get inflated for those corrupt contractors to afford the kick-backs (in the millions of dollars, I might add). And it is tax-payers like you and me who ends up paying for it. Do you get it?!!!!!!!!!!
