AN 82-YEAR-OLD man of Kawama in Kitwe has been convicted for defiling a nine-year-old girl and committed to the High Court for sentencing.
Kitwe Magistrate Ruth Kapulo yesterday convicted Joel Chileshe after finding him guilty of defilement, contrary to Section 138 (1) of the Penal Code Chapter 87 of the Laws of Zambia.
Passing judgment, Mrs Kapulo said: “I consider a man of 82 years defiling a young girl of nine years as an abominable act which should be condemned in the strongest terms.”
She said Chileshe never gave any reasons as to why the girl can falsely implicate him and failed to distance himself from the offence.
“The evidence of the prosecution is overwhelming. In the circumstances, I have no doubt that the accused is guilty of defilement, contrary to Section 138 (1) Chapter 87 of the Laws of Zambia as read with Act No. 15 of 2005 and I convict him accordingly,” Mrs Kapulo said.
Particulars of the offence are that Chileshe on October 21, 2011 in Kitwe, did have unlawful carnal knowledge of a girl under the age of 16.
Mrs Kapulo also said Chileshe never challenged the girl’s evidence that he used to pick her up from school on his bicycle, pretended to be her grandfather and took her to his house to have sex with her on several occasions.
She also said the girl’s mother testified that she overheard her daughter narrating her sexual encounters with Chileshe to her brother.
“Looking at the seriousness of the offence, my hands are tied. I have no jurisdiction to sentence you. I, therefore, commit him to the High Court for sentencing and you will mitigate before the judge. Your police bond has been revoked and you are remanded in custody,” Mrs Kapulo said.
Mrs Kapulo, who runs a shebeen, told the court that Chileshe was her regular customer but he stopped frequenting the shebeen after defiling the girl.

A magistrate owns a shebeen? Chileshe a resident of Kawama used to frequent it? Where does the magistrate stay? Isn`t a shebeen illegal business? Mrs Kapulo should have recused herself. She seems to know the defiler well. Anyway he has been commited to high court. There will be more objectivity because it seems the magistrate is not independent of the accused. It seems like people dont distinguish between language,tribe and names.Bemba is the widely spoken language in our country just like the way we use english language and yet we are not from england.So my point is this,those who critisise bembas must go back to school and learn social studies coz each region in this country has its own ethnic group.
