
Speaker of the National Assembly Patrick Matibini says there is nothing illegal about the move by President Michael Sata to put the Road Development Agency (RDA) under his office.
Dr Matibini made the ruling following a point of order by Monze central Member of Parliament Jack Mwiimbu who wanted to know whether the executive was in order to continue violating the constitution by realigning ministries and government institutions without Parliament approval.
In his ruling Dr Matibini stated that government has the prerogative to establish and dissolve government ministries and department subject to approval by Parliament.
He said he has no doubt that the Vice President will present to the house an appropriate motion to ensure the constitution is upheld on the moving of RDA to fall under the office of the president.
President Michael Sata recently announced that he had taken over the Road Development Agency to fall under his office in order to curb corruption in the procurement of road contracts and promote transparency.

It has always been like that. Government will announce changes to ‘operational structure’ and then leader of government in parliament will introduce appropriate legislation to complete the cycle. I think there’s a misunderstanding or lack of knowledge here. Basing on our current constitution, the President as Commander in Chief has powers to appoint and drop a judge, put a non functioning entity that belongs to government under statehouse, can even assume the role of Minister of Defence like Mwanawasa did when the situation dictates he has to protect the country he reigns over. Simply put, he has more powers under our current constitution than we care to imagine and Sata has been very resilient to use his powers as he understands them.Â
Those against the president’s decision on RDA are bitter because they won’t have chance to manipulate the system so that they can be given dubious contracts.
Anyone with grey matter should be able to critique an issue. Whether or not one is in diaspora is besides the point. His worship, the speaker, (or whatever his title is) says that: “.. government has the prerogative to establish and dissolve government ministries and department subject to approval by Parliament.” The logical question to ask is whether that “approval by Parliament” comes before or after the fact? If it comes after the fact, then parliament only functions as a rubber-stamp! In this particular instance, it is after the fact, which is a despicable reality. The next logical question is whether this is the intent or meaning of the law/constitution? The task to interpret laws is a prerogative of the courts. The Legislature functions to make laws. Is the speaker right?

What has diaspora done now? I thought we are discussing RDA issues. Zambians every where you go are never untied (unless when drinking beer or partying). When it comes to real issues that affect the community, we find difficulties to pull in one direction. Even when voting its worse. Now instead of discussing RDA, you are busy justifying who is Dual and Clever? What sort of human beings are we? Diaspora or Not, has nothing to do with gray matter as you call it.
