President Sata castigates A.C.C for not seeking permission from him to investigate senior party officials

FILE: President Sata honoured PF Secretary General Wynter Kabimba for his professional legal advice regarding various bodies and local government authorities as well as his contribution towards the first Draft Constitution

President Michael Sata has advised the Anti Corruption commission (ACC) to refrain from investigating people using the media.President Sata said it is not right for the commission to go to the newspapers and reveal a person being investigated by the commission.The Head of State instead advised the commission to uphold the privacy of the people being investigated.Mr Sata said the ACC should ensure that investigations are done between the commission and the person being investigated without involving the media.

President Sata said this today at State House when he swore in Anti Corruption Commissioner Rollen Mukanda and Teaching Service Commission members.
Those sworn in the Teaching Service Commission include Chairman Jennipher Chiwela, Alfred Sikazwe Vice Chairman, Justo Chishimba, Angness Nyoni, Robam Mwaba, David Kandolonda and Janet Kayama board members.

Mr Sata castigated the Anti Corruption Commission for not getting permission from him when investigating senior party officials.He explained that by law the commission is supposed to get permission from him to investigate any senior party official.Mr Sata wondered why the commission was not approaching him to get permission to investigate senior party officials when the law is clear.[pullquote]I won’t suspend anybody unless you prove to me[/pullquote]
“Madam Rollen I want you take some sanity to Anti Corruption Commission, how would you feel if somebody is investigating you in the Times of Zambia. Because if you are investigating somebody that should be between you and that person. Don’t go to the newspaper and say we are investigating you give people the privacy they deserve,” he said.

Mr Sata said he will not suspend anybody on allegations but that he will wait till the Anti Corruption proves to him that someone is guilty.

“I won’t suspend anybody unless you prove to me, the law says if you have a senior party official you want to investigate come and get permission from me. You don’t go to the press and say we are investigating somebody. That’s the MMD way of doing things,” Mr Sata said.

Meanwhile, President Sata said the Teaching Service Commission needs a lot of inspiration in a bid to inspire teachers if they are to be professionals.
Mr Sata complained that the teaching service commission has been employing teachers who are an enable to teach themselves.
Mr Sata said if he had a choice he would not have allowed the old men appointed to serve in the Teacher service commission wondering how an old commissioner appointed would inspire young teachers.

“And you the Teaching service commission it is a pity because if I had a choice all the men I would not have allowed them. You are going to deal with tender age and when you have men like this, what inspiration can you give to the teaching service commission. They need a lots of inspiration you are dealing with tender age you have seen exam leakages, defilement and unless we have a dignified service men run the teaching service commission not men looking like criminals,” he said.
“Go in the field, hope you bring sanity in the teaching services. Not the way they are recruiting teacher’s people who can’t teach themselves,” Mr Sata stated.

  1. Our president has really lost direction. He is saying that if you want to investigate a senior government official please inform me. I have to approve before you can go ahead. So if CNP says don’t investigate, then someone goes free. This is a how bad the situation is.

Its law that senior govt officials can be corrupt and only face persecution once they are voted out of office.The president is the only one who can say who is corrupt and who isn’t.So ACC please focus on MMD ,UPND and the ordinary Zambians. Does it mean the ACC is for ordinary people only and not those in leadership? This is total disregard of the rule of law. The PF is preaching selective justice in broad day light. Where does this leave us the common citizens? No wonder the police are abusing us. So Sata is able to advise the security wings on who to pursue and who not to! What a country!   14. The only solution is to change the constitution, there is just too much power in the President. How do you expect ACC to be independent when they have to dance to the tune of their appointing authority? I was appalled when I heard this news, is this being allergic to corruption and rulling by 10 commandments? Winter made his case public by going with his cadres and demanding to be questioned in public.

Then how do you accuse them of taking the issue to the media when the fight between GBM and kabimba was in the media. Mr. Sata you failed to control your ministers when they were fighting thru the media. the issue is already of media interest, so dont blame ACC.

  23. Where is LAZ on this. Which law says law enforcement agencies must get permission from the president when investigating his senior officials. Just this reaction tells you the difference between our Zambia & US. the Head of the CIA was forced to resign due to investigations by the FBI & Obama was not even remotely aware. He did not blast the FBI for “not getting permission” from him. What a contrast. these agencies were created to do they jobs & the non-involvement of the president is for his own protection. What happens if they ask for his permission & he refuses then later on it is established that the protected individual was wrong. What the president is saying is that he will only suspend people when the judge pronounces them guilty since it courts, which complicates the process

    • Thats exactly what I want to know; If anyone from LAZ ( or anyone familiar with the Anti Corruption Act) could please comment on the legality of ACC having to inform the president on investigations involving members of his admin. If it is indeed as it says, why did LAZ not contest it’s legality because clearly, it invariably leads to abuse of authority by the president because it amounts to intimidation and obstruction of the law. In this instance, Mr. Kabimba made a mockery of their (ACC) mandate to investigate/ prosecute with out fear or favor.

No permission or authority was sought by the FBI from the powerful president of USA, Barak Obama, to investigate the powerful four-star general David Petreaus regarding his his alleged indiscretions. But in this banana republic we want to hide alleged cases of corruption by taking recourse to subjective parameters. Shame!

    • Actually Zero Boyz is correct. BO was informed the general was being investigated, there’s no stipulation that either FBI, NSA or CIA inform the president regarding such investigations. Even the chair of the Intelligence committee, Eric Cantor I believe, was made aware of it. Of course these are two very different sovereign nations so things may be done differently but clearly, the interference from Sata should be unconstitutional if it is not already.

  37. I think that is a bad law and needs to be reviewed. However on the other hand the president says ACC shoud get permission to investigate senior party officials does this mean also senior memebrs of the opposition party e.g HH, Nevers Mumba? In which ever way we look at it the law here isnt fair, it biased to the ruling party. ACC are a law enforcement body therefore they should investigate whoever they believe has issues. Apart from the president who has immunity but can be piling up files for him for after he leaves office without telling him that.

  42. Umupondo. The issue here is ACC were unprofessional in their conduct. Why did they not just summon Kabimba without telling the whole world what they were planning to do? They could have interviewed him quietly then made a statement later.

    • They did not initiate this issue, they got it from the media when GBM and Kabimba were accusing each other of corruption. There was already media interest so cannt keep it secret.

  51. #70, I suggest you go back and read: ACC to question Kabimba this afternoon as Sata maintains a Zero tolerance to corruption stance :- published on December 3, 2012. The ACC was NOT “unprofessional in their conduct”. This was a publicized interview and should’nt have come as a surprise to anyone. Hell, haven’t the ACC publicized all other cases before an interview? Go back and read all the MMD (especially Dora’s) cases on corruption.
    What you need to know and ask yourself is, what was/is so special about Wynter Kabimba for the ACC keep everything hush hush? Being a cabinet minister does NOT make any-one citizen above any Zambian laws period.
    So, tell me; does Kabimba’s overall behaviour at the ACC offices (regardless of the fact), make any sense to you? Am waiting…

Is it because he is a god or the law itself? We have all seen the Evil that we chose for president for those who chose on our behalf. This man is an embodiment of corruption. He is corrupt to the core and this story of him getting sick with corruption are political pronouncements to blind those who support him. He has a clear and well documented track record of being a thief and corrupt.

    Secondly, Kabimba proceeded to go ahead and “show up” at the ACC offices with his so-called entourage. Did he not? Seems you don’t understand my original post nor do you remotely make sense of my reponse to #70. If Kabimba did not want to be interviewed by the ACC with his possy in toll, he should have informed the ACC prior to physically going to their offices.   72. I proceed on the premise that our president was right at law. My question is How come GBM who is facing same issues never ferried cadres to the ACC offices? Is the president saying it is ok for GBM to interviewed and bad for Wynter? The President seems to know more than we do. He has clearly demonstrated his bias between the two ministers and also his lack of wisdom. At this rate, he has failed to inspire most people.

    • Use ACC Act No.3 of 2012 and the 1980 Act was repealed, but the section 5 is the same as the one you have quoted above (see post 130)

    • Probably because he continually moves the post whenever an issue like this arises. By that I mean he choses his own logic, wrongly arrives at a conclusion, to justify his responses. ACC interviewing Wynter is part of the investigative process on their part so they can ascertain answers to questions that arise during their investigation. 

  84. From my reading of the ACC Act of 2012, the ACC does not require any permission from the the president unless there is a clear provision in the constitution which overrules the provisions of the Act. Section 5 of the Act provides & I quote “Subject to the Constitution, the Commission shall not, in the performance of its functions, be subject to the direction or control of any person or authority”. I believe this includes the president. If any one has information contrary to this provision, particularly the article of the constitution that provides otherwise, please share that information so that we can debate this issue intelligently

  85. I strongly believe Sata is using the provisions of Section 16 (1) of the Anti-Corruption Commission Act, Chapter 91 of the Laws of Zambia. Unless there’s a part of the “law” that I did not see or understand, Sata’s uses this as a justifcation that he ACC is answerable to him, since he appoints the director general.

    We are in trouble on this ACC issue bane!

  86. The ACC Act of 2012 clearly states that subject to the Constitution, ” the Commission shall not, in the performance of its functions, be subject to the direction or control of ANY person or AUTHORITY …”
    The Commission may ” investigate ANY conduct of ANY public office which the commission has reasonable grounds to believe may be connected with, or conducive to, corrupt practices;” The reference to the Constitution is only in so far as the Commission’s acts do not breach the same; e.g. infringing on someone’s liberties unreasonably. It is clear also, that the Commission was formed and accorded powers that endeavour to make it as autonomous and independent as possible in its functions. It does not matter that the President appoints the Director. In short, Sata is out of order.
