Harrington applies for a tribunal to probe Tourism Minister Sylvia Masebo

FORMER Transport and Communications Minister, William Harrington has applied for the appointment of a tribunal to probe Tourism Minister Sylvia Masebo’s alleged abuse of office, as reported in the media, in the manner she dismissed the Zambia Wildlife Authority (ZAWA) officials.

The application is in a letter addressed to the Chief Justice dated January 21, this year,.

Mr Harrington said he had nothing personal against Ms Masebo but that he supported Government’s stance against corruption and appealed to concerned parties to take advantage of the tribunal once set-up to offer their views on the matter other than issuing statements in the media.

Mr Harrington outlined the terms of reference as being, to investigate media allegations of interference and abuse of office by the Ms Masebo.

This was in the tender process where she allegedly ordered the withdrawal and non-publication of the list of successful bidders for hunting concession licences and cancellation of tender processes in breach of the Zambia Public Procurement Agency (ZPPA) Act of number 12 of 2008 as quoted in the Sunday Nation of January 6, this year.

The other allegation being the appointing of a committee to prepare her own bidding document in breach of the ZPPA Act, which was also published in the Sunday Nation of January 6, this year.

Mr Harrington also called for investigations into media allegations of abuse of office and breach of contracts and the Parliamentary and Ministerial Code of Conduct Act Part II Section 3 (c) on the part of Ms Masebo, when she dismissed senior ZAWA management officials being public officers from employment on allegations of corruption in the hunting concession licences tender process.

Mr Harrington quoted the Post Newspaper of January 3, this year, the Times of Zambia and the Post Newspaper of December 31, last year, respectively and the Times of Zambia of January 2, this year.

He called for investigations in media allegations of the breach of the ZAWA Act by the Minister when she issued a verbal instruction to ZAWA officers to hunt wildlife without issuing Special Licence and allegations of irregularities and corruption by ZAWA management in the handling of tender for hunting concession licences as quoted in the Times of Zambia of December 31, last year.

Mr Harrington also said Ms Masebo should be investigated on whether procedure was followed in the banning of hunting.

“Investigate media reports that the Minister is in breach of State security by failing and/or neglecting to report to Government security wings that foreign registered aircraft are violating Zambian airspace to uplift, out of Zambia some wildlife species or Government trophy as reported in the POST newspaper of January 3, 2013 and the Daily Nation of January 4, 2013,” Mr Harrington said.

He said the tribunal should also recommend to Government appropriate administrative action based on the findings of the investigations as provided under the Parliamentary and Ministerial Code of Conduct Act.

He attached photocopies of the newspaper articles.

“In making this application, I am aware of the requirement of your office to notify the Republican President and the Hon. Mr Speaker. I pray that you, Hon. Chief Justice, will give my application your favourable consideration in the public interest and I thank you in anticipation,” he said.

    • Indeed I would rather pay my tax for this noble purpose Harrington is advocating. We need sanity in our country. I wish Sir, you had included Bob Sichinga in your letter as well. these guys think they are angels & have better solutions to Zambia’s problems. Masebo used to leak confidential reports to her boyfriend (Kabimba) from MMD. That is why now she appoints him on ZAWA board so that they can chew DINGI together. We know them & they will account to pay in future! Well done William.

    • If you can pay footballers 90,000 a piece, give the constitution making process an open check, create districts wantonly and everything else, it is very apparent that the money is coming from somewhere. How is it a waste if the leadership is being asked to come clean? I would like one on how the minister of justice becoming an education overseer.

  1. Harrington is right, Sylvia Masebo has a lot to answer for on these issues. It’s shocking that someone who has been a Minister for so long does not know the extent of her own authority. Dora Siliya did the same and is being taken to task and now Masebo has done the same – has she just arrived from Mars and is not aware of Siliya’s problems?

  2. The judicially if they are not biased must start with Judge Lisimba’s “case”.There is a complaint against this Judge.

    • A complaint from the criminal gang of Mahtani, Sangwa and company! Criminals must not be allowed to choose their own judges. It started with Mmembe and Nchito. And now it is Mahtani. Is Zambia the new Sicily where the mafia chooses who hears the cases! Ba PF dont destroy the country!

  6. @ Galamukani.. Ndiwe ufunika u galamuka man!! These are elected leaders and they owe us responsibility of doing their jobs in a straight forward fashion. If their activities are coming into question. President Sata constituted a number of commissions of inquiry and we haven’t heard back from more than half of them. I say Mr. Harrington has got every right to go ahead and give us the citizens a chance to know what is really going on in those high offices.

  7. I agree with Mr Harrington. For once someone should stand up to Sylvia Masebo, Wynter Kabimba faction. They are the most corrupt and incompetent ministers Zambia has ever produced. No wonder she and her boy friend are trying to bring confusion and victimize innocent people. We are watching. Your days are numbered. Remember what goes round comes round. Who knew MMD were going to be out of power. You are less than 2 years in the Government and already there is shortage of mealie meal, essential commodities, political harassment. the list is endless, something we never experienced under MMD. At least we had some sanity under Late Dr Mwanawasa. We could hold our heads high.

MASEBO THINKS SHE IS ABOVE THE LAW AND THAT EVERYONE APPROVES OF WHATEVER SHE DOES. WE NEED TO FOLLOW THE LAW. THE PF VOTED FOR THE REINSTATEMENT OF THE ABUSE OF OFFICE CLAUSE AND NOW IT IS WORKING AGAINST THEM. THEY BOASTED ABOUT IT WITHOUT UNDERSTANDING THE IMPLICATIONS. NOW MASEBO IS CAUGHT IN THE SAME WEB AND SHE MUST ANSWER TO THE CHARGES. THE LATE GEORGE KUNDA WARNED THEM AND THEY BRUSHED EVERYTHING ASIDE. NOW THEY ARE BEING HAUNTED BY THE SAME LAW. WE SHALL SEE WHETHER THE PF WILL ACT JUSTLY AND CONSTITUTE THE TRIBUNAL TO PROBE CORRUPT MASEBO. THE DRAMA IS JUST UNFOLDING AND WE ARE FOLLOWING CLOSELY. THIS IS A TEST FOR THE PF.

    • Why didn’t you say something then? It is your fault that you kept quiet. Right thinking people should always fight injustice and wrong doing commited by everyone including those in power. You are as good as dead if you keep quiet in the face tyranny. Read Wole Soyinka’s book “The Man Died”.

HARRINGTON is leading the way to absolute democracy,alot written above, but others writers purely refusing to use their heads,Masebo is not dull she should be able to face tribunal i hope,some writter complained about conduct of some judges, but where in the fore front condemning judges probe when it was first excuted by these PF,LETS ENCOURAGE TRANSPARENCY its good for democracy.

    speculations of corruption in the zawa transactions have made headlines in our daillies for sometime now and its only prudent that she puts the records straight.

Zambia is blessed with citizens of stone age type, Mr Harrington has taken the right way to enhencing our democracy, media houses spearhead trasparency in modern societies regardless on how u view the Zambian system, Harrington’s action will check the intergrity of media reporting and seeks to correct minister’s correct way of excuting there duties. Any dramas with that? its jst tax payer’s money and some of u dont even contribute a penny.

  13. Are we in a democratic country or a Jungle, i think even in the Jungle rules apply. In this case, ZAWA has issues and Harrington is right to ask the court to investigate. By the way what is Anti corruption commision doing, Police and solicitors to allow merciless people like Masebo and Kabimba to hold the whole nation like their sex act? For God’s sake its pathethic. Why is UKWA (SATA) still quiet about all this circus?

    • Please do not insult the circus industry because things are well organised in that industry. There is always time for everything e.g. time for elephants to perform, time for horses, etc. What is happening in Zambia under these untouchable chancers is nauseating.

  16. Masebo is a mafikizolo in PF but she more powerful than the true original bwato paddlers. Harrington has taken the right step to remind the current rulers that nobody is above the law. The earlier the tribunal is set up the better so that Masebo can dance to the music.

  17. I hope they don’t do what they are doing with political rallies.
    I honestly believe the Zambians who voted for PF deserve better leadership as they had all their faith in this government, I cannot say the same for myself but I expect them to do their jobs well, as a citizen I demand that they do so, for they are servants to their people.I don’t understand why they feel they are not really responsible for we the people,but this problem seems to be all around Africa as this is the case in many other places *****************
