Chief Government spokesperson, Kennedy Sakeni has said that Government is not ready to take former President Rupiah Banda case to parliament because the Government needs to put the facts  together, adding that MPs cannot support the motion unless they are given convincing reasons as to why Mr Banda’s immunity should be lifted

Mr Sakeni said that Government will will tread cautiously before it can recommend that former republican President Rupiah Banda’s immunity against prosecution should be lifted by Parliament.

Mr Sakeni said in an interview in Lusaka yesterday that although the public and concerned stakeholders were calling for the lifting of Mr Banda’s immunity, Government would deal with the matter cautiously.

Mr Sakeni said Government would ensure it puts facts together so that by the time it takes the recommendation to Parliament, it would have concrete facts to have Mr Banda’s immunity lifted.

“We cannot go to Parliament before putting our facts together. MPs cannot support the motion unless we give them convincing reasons as to why we should lift his immunity.

“We cannot go to Parliament before putting our facts together. MPs cannot support the motion unless we give them convincing reasons as to why we should lift his immunity.

“We want the people to appreciate what we will do once we are through with the whole process,” he said.

He said Government had already indicated that it would take the matter to Parliament but it would not rush the process despite the pressure from the public and other concerned stakeholders.

He said Government would ensure all the necessary steps were followed in order for the move to yield tangible evidence.

Several stakeholders including civil societies have called for the lifting of Mr Banda’s immunity to accord him the chance to exculpate himself on alleged corrupt activities that he might have committed during his tenure of office.

Mr Banda recently snubbed summons from the Anti Corruption Commission (ACC) to interview him claiming that he was insulated against investigations.

  1. Sata is double tongued man who is so untrustworthy . I can’t believe he is doing exactly the same things he was condemning when in opposition . He expelled and called his MPS that were poached by MMD as labels. People of zambia hear me never ever vote for the PF liars in 2016. TB Joshua please whence art though, sendest thee a prophecy unto this Mother Zambia so that lucifer Satan be cust in the bottomless lake pit of fire.?

    • @ Octopus PAUL BWALYA, What you wish for others will definitely happen to you.And in this case, your parents, wife and children gonna die,but Sata will still live and die at God’s own time. Why wishing someone dead? What kind of jealous is this?Did Sata refuse to sleep with your mother?Say something as a human being, not a demon.

    • I think you meant “Rebels” and not “lable”, why call upon TB Joshua and God himself? Did TB Joshua prophesy the down of UNIP? No it was people of Zambia’s prayers that were answered and resulted in FTJ declaration of Zambia as a Christian Nation because everybody saw that God had heard our prayers and he interverned.

    • As I said, Octupus’ tone is harsh, however, his facts cannot be disputed. I dont belong to MMD or any political party. And yet, my workers now tell me they were deceived by MC Sata’s 90 days jobs, constitution etc campaign promises. My compatriots, wait and see how MCSata will fall out with the population in the coming years. This WILL happen because,he promised the impossible and he wont fulfill the promises.

  2. PF promised us that they will have a lean cabinet to cut down on government recurrent expenditure on salaries and allowances so that money is reserved for capital and social expenditure. These are the things that have an impact on the livelihoods of Zambians. Sata has increased the number of Ministeries. One such Ministry is the so called Ministry of Chiefs and Traditional Affairs. This is a waste of money. Now I see and
understand why normal people are against these foolish appointments of oppsition MPs as Deputy Ministers? Deputy Ministers are not Cabinet Members! They dont take part in policy making as they do not have seats on this policy making organ. So what is the point of having 3 Deputy Ministers in a Ministry? Isnt this just a waste of resources? • Though your tone is harsh; yet your facts cannot be disputed. There is no harm promising a lot to get to your goal if there is no malice aforethought (premeditated). I ask, were the 90 day promises not premeditated lies? I can now sense despondency building up in the country especially with the filth induced by floods in the Lusaka townships like Kanyama etc and now even in villages such as Nangoma. Let this be a lesson to our politicians to woo votes but not with blantant deceit. 90 days this, 90 days that, 90 day………

    • Octopus my advise for you is to cut your tongue short. You dont seem to understand a thing about governance.Your thoughts are misguided. When the opposition say that Sata has failed to fulfill his promises they know that they are just politicking for the sake of winning people like you on their side. The fact is things take time to materialise.A baby takes nine months to be born. You cannot exepct your wife to give you a baby just after she conceives. You cannot harvest maize just after planting the seed.Developing a country takes time.Rome was not built in one day.Cool down my brother and wait.Time is the best teacher, dont go into the fast lane you will crash!!

    • Life is a journey you right things take time, my only worry is this government has not given us the direction or their strategy to bring development. The president is busy swearing in people & has never had a press conference so we can ask him many question we have. The country is on auto pilot government is so much focused on by elections and the opposition. The link 8000project & railway design by chilwa are good ideas but are not receiving much attention or have they told the general public how those will be brought to reality.

Let’s use the same standards PF used to judge) to judge them, and see if they will make anyone happy

    • YOU MAY HAVE A POINT. BUT WE HAVE ALSO SEEN THAT THE PF HAS JUST REALISED THAT KEEPING THE CABINET LEAN IS NOT THE SOLUTION. HOWEVER GENERALLY THE PF IS THE ONLY PARTY THAT MAKES SENSE IN ZAMBIA. MAYBE AFTER 10 YEARS WE MAY HAVE A SENSIBLE OPPOSITION TO VOTE FOR.

Plagiarism is good in this instance because it is all in the service of the nation. The only sad thing is the inability to paraphrase. It speaks to the archaic standards of our education system.

  3. The PF Government will do the country alot of good to drop this whole idea of lifting RB’s immunity if they have no evidence that will lead to a conviction. The Mwanawasa administration wasted millions of dollars at the expense of equipping hospitals, schools etc, only to recover less than what was spent on the task force. We still have the London judgement hanging in the balance. While we have heard about the Mpundu Trust and all these other allegations, is there any paper trail to lead them to any tangible evidence. PF may pursue Thandiwe for being on payroll and getting money not worked for. I suppose she may be sentenced for receiving money by false pretence the same charge which should be slapped on all NCC members who never delivered the constitution but got paid for it.

    • Mwanawasa’s lifting and subsequent prosecution of Chiluba is what won you debt cancellation, so don’t down grade it to “waste of resources” and no matter the cost, we should persue people who plunder national resources especially those in higher offices as long as this is not done vindictively. In RB’s case it appears to be more vindictive than a genuine attempt to bring to book a plunderer as evidenced by the satetement above.

  4. Ok. This is the time it’d best for Mr. Sakeni and his colleagues to keep quite whilst working on their case. Trial via the media is not only unfair but smacks of cheap politicking. If the case against President Banda is strong, then let us follow the process by seeking to remove immunity and make him have his day in court. There is nowehere he is running to. It’s embarrasing when the president can make such assumptions and even comment about things that need no commenting and will be dissproved in a few days time. Patience!

  5. Iwe sakeni who started ranting about lifting RBs immunity?? Its the government, don’t say its the public & stakeholders. Which public & stakeholders are you referring to?? You guys talk without thinking now that you don’t have any reasons to have RBs immunity lifted you are shying away to say you want to put facts together, you shout have done that before bringing the topic to public

    0

    0
    • It is really amazing that Sakeni is claiming that there is a lot of “pressure” from the public and stakeholders to life RB’s immunity. And yet, it is clear that many people including the stakeholders are asking for the “evidence” and “due process” if this Govt is to attempt the lifting. It goes to show the kind of “misinformation” and twisting of facts for the benefit of Sata’s allies. No wonder Sata’s popularity is tumbling rather quickly if this is the kind of feedback he is getting in terms of the “mood” in the nation.

  6. The country vividly understands PF’s lack of credibility, wisdom, rationality and indeed its subservience to the wishes of those species beings in self entrenched deep spirits of envy and hatred against the wise, intelligent and prolific statesmen. My dear you have hired rascals to vainly propagate a failed regime. See now they are a liability to PF while stealing from Zambians in cartels. With a critical mass build up set to sweep failure, they will turn around that you plundered alone but Zambia got them fixed on all their corrupt ways. You have a tough battle over RB Globally respected as an excelled top diplomat and Statesman. All Global positive eyes on RB and disdain on tyranny.

    • My six pence advice to His Excellency MCSata. Be wary of the hatred of M’membe and his deep almost pathological obsession to get even and settle scores. M’membe and his coterie of ‘thieves’ were at the sharp end of RB’s tongue and short end of his stick principally for political reasons. And now it is clear that M’membe Post was deep in support of you, your Excellency. But in the process,M’membe was involved through his businesses in the DBZ gate, Tax gate et al. And that is where RB had him by his short and curlies. But your Excellency, that is politics. The nation will be for the better if we move forward and do not get mired in the RB-M’membe life and death contest. The nation is bigger than these two protagonists.

  11. “Zambians have a short memory ~ Levy P. Mwanawasa” people seem to forget that the reason we ended up with Sata and PF in government is because of RB’s MMD corruption and abuse of office among others. If we let RB go scotch free then so should we let MCS when his out of office although his also doing a crappy job and screwing us over? Wise men from East have a saying “mulandu siuola” aka “a crime does not rot”

  12. The masses supported the removal of chiluba’s immunity and it was easy for parliament to do that. Today, the masses are not in support of that not because we are corrupt but because the people that are pushing for this (The Bwinjimfumu Cartel) are the most corrupt and want to use this opportunity to plunder RB’s assets as they did with Chiluba’s assets. Actually their main aim is to destroy RB’s percieved financial muscle so that the MMD and generally the opposition can be weakened further.

  13. Lies have no Legs not even a single one.I think PF have realised that they are saving one Master group ,Mmembe and the Cartel of crooks such as Nchitos. The country as we speak is at stand still or in reverse gear. Thanks to HH who realised earlier that the association with PF would be a big blow to his political Career.Surely PF could have done better as promised.Down 17 months we are still hearing swearing in ceremonis etc.Things which would have been done within one or two month(s) after winning elections.Shame on PF!!

  14. What public or concerned stakeholders is this retard referring to? Simply say Mmembe and Nchito are hoping for another bumper harvest should their wish be granted. For now it’s about creating the impression that people are interested in lifting RB’s immunity when in fact the opposite is the case. First, there is no case to answer, no numbers in parliament and no public interest whatsoever. Mmembe has sensed the lack of quality at the heart of government, so he has extended The Post to ministry of information and broadcast to spit his ill-conceived ideas. Stop wasting our time if you cannot tell us what’s being done about state of roads claiming lives in numbers.

Today he is even pleading with the church to join in, shameless man!

  18. Here is the deal , this Sakeni is lying through his teeth and they don’t have a case against RB.

What they don’t have is the numbers in parliament. We know that if they had the numbers, brainless PF MPs would support anything including a motion to have a Frog or Lizard as a life president after sata retires.

We challeged them to take the case to parliament any day they wished and they will be totally destroyed. Their numbers don’t add up.

Their strategy now is to try and increase their numbers in parliament by creating unnecessary by -elections. Is that a cost worth putting this country through? What make them sure it will work? We shall see.

  19. COUNTRYMEN,

WE SHALL NOT RUSH RB’S CASES LIKE LEVY DID TO CHILUBA. YOU SEE RUSHED AND AS A RESULT THE CASE IS STILL IN COURT. ALL THE INVESTIGATION OFFICERS HAVE DONE SO FAR IS TO GATHER EVIDENCE OF CORRUPTION FROM RBS ASSOCIATES. THAT IS WHY THE ACC SIMPLY WANTED RB TO STATE HIS CASE OR REBUFF THE ALLEGATIONS (LINE BY LINE) IN CASES WHERE HE IS CITED OR MENTIONED AS AN ACCOMPLICE.

ITS AT THAT POINT WHEN ACC AND THE PUBLIC WILL ASK THE PRESIDENT THROUGH PARLIAMENT TO LIFT RB’S IMMUNITY. WE ARE NOT RUSHING BUT WE MAY PANIC IF RB DECIDES NOT TO COME BACK HOME LIKE ONE OF HIS SONS HAS ALREADY DONE.

  23. We are not agaisnt the removal of RB’s immunity. what we are agisnt is the following:

    (1) summoning RB to ACC when he enjoys immunity against such interrogations. (the clause that imminisez RB against prosecution is the same na Sana wine iimucita protect. if u cant summon Sata ba ACC for questioning why summon RB imwe ba Nkusa?)

    (2) calling for the removal of RB’s immunity before telling us Zambian the commited when he was our President. we are not saying he stole neither are saying he didnt. just give us details of his crimes and we will support it.

just follow the right procedure and we wont question your move. but remember, before u do anything against this innocent man (dazent our constituion say one is innocent until proven gulity/) just ensure he is guilty.

  24. Hon Sakeni’s public confession that Government has not assembled RB facts on corruption is embarrassing, in the eyes of the public and the international community. One would have expected that by the time ACC (wing of Government) summoned RB the full report would have been ready.
RB’s refusal would have been used as a chance to release that report and convince parliament by saying, “look we didn’t want to reach this far, here is what he did blah, blah, blah……” but to hear that facts are not ready why did ACC summon him?
According to my understanding, the same facts that ACC has compiled are the ones that Government should use.

  25. Sakeni you are very correct when you say PF cannot take RB’s immunity issue to Parliament because you know RB is clean and you are going to lose miserably. My advice to you is keep your ignorance out of this social media as you ‘re just embarassing yourself. Sata was elected by the majority zambians, insulting him means you are insulting the people who put him in power. If you think you can do better than Sata stand against him and see how many people will vote for you in 2016.I doubt if you will get a vote apart from your own. 29. Sakeni and his government must tell us the details of what wrongs RB is suppossed to have committed. Fred M’membe should also produce a document on RB like the famous “Matrix” he did on Chiluba. Names dates details and all are required. There has been no “Matrix” document because RB is clean. I challenge M’membe to come out with a “Matrix” document on RB.

Fertilizer has been an issue, we want to start buying fertilizer for next year with this issue will catch up. 35. Why do Governments of the day deflect attention from themselves?

And why would any politician demand immunity from prosecution? If you look at Zambia’s history (and that of other African countries), the recent previous presidents have had “immunity” of some form after leaving Office (not sure if KK had any though), but were all hounded by incoming governments….possibly to deflect attention as they fill up their own pockets. What a disgrace. I guess they do not have long before the next set comes in to clean up national assets 🙁

If the outgoing government abused office, charge them accordingly in courts of law. But let the Judiciary do its job.

BTW, now that we are expecting new arrival, please keep us in your prayers….

  38. So ba sakeni and your government you don’t even have any facts ready against the man and you want to cook up something to present to Parliament just to embarrass and humiliate him? This is so sad for Zambia. is this not witch hunting? So the goal is simply retribution against RB and opposition parties? This kind of sakeni thinking exposes the hidden agenda of our president against all whom he percieves as having opposed him whilst he was an opposition leader. Wake up yu sane Zambians as the battle to destroy Zambia and personalise it is just beginning.

  39. This immunity clause should be properly qualified in the new constitution. It should not cover thieving, self enrichment , corruption etc but only relate to matters of internal security, defence of soverienity etc. Look beyond RB and Sata. We may have some President worse than RB and Late FTJ (MHSRIP). There are many out there waiting in the wings and waiting for a chance!

    • We already have one serving now. We might as well remove it before he leaves office so that he can answer charges while he is on his legs. We don’t want people insulting the dead; it is an Zambian.

  41. Its naivity of the highest condoour to take that Octopus Bwalya or children his children all things being equal would die first than Mr Sata who is sick and much older than Octopus and his children. Be realistic Mr Sata is seriously sick even if his sickness is being hidden to the nation. Octopus Bwalya’s opinion is being misinterprated. The wrong notion about Mr Sata and PF govt can be likened to a national religion, and questioning this religion is never polpular. But this religion seriously needs summoning by Zambians to reform, change its stance towards zambians who do not agree with it and honour its pledge made to Zambians

  42. @42.1 Octopus Paul Bwanalya In medical field they don’t give PhD as this means Doctorate of Philosophy. But what they give is MD as this means Doctorate of Medicine. U are a student in neither of the mentioned fields.
Actually, I can almost predict the levels of education in those that blog. Just the way the argument is put forwerd and the way the language is manipulated.

  43. Do you see these people in govnt? They have been preaching about removing Banda’s immunity when they dont have even a faintest clue as to whether he did any wrong whilst in power. And it suprises me these non-govntal organisations pressing for the removal of Banda’s immunity, if the govnt itself has no clue, what about them? Food for thought

  44. CAN THIS GOVT FOR ONCE PREACH MESSAGES OF LOVE. ALL THAT TALK ABOUT RB BEING CORRUPT ONLY TO TURN ARROUND TO TELL THE NATION THAT THEY DON`T HAVE ANYTHING TANGIBLE TO LAY ON THE TABLE AGAINST RB. WHT WAS THE BASIS OF THAT NEGATIVE PUBLICITYAGAISNT RB? SINCE THERE ARE NO CONVICING REASONS TO TAKE TO PARLIAMENT, YOU MUST ALSO STOP POINTING AN ACCUSING FINGER AT RB.BLAMING OTHER PEOPLE DOESN`T MAKE YOU A BETTER PERSON, BUT WHAT YOU DO.
