
Nyimba Member of Parliament, Forrie Tembo, and his Kapoche counterpart, Nicholas Banda, said they voted in favour of the motion to lift former Republican President Rupiah Banda’s immunity because they were working with the government of the day.
The two, who are Local Government Deputy Ministers, said there was no way MMD Members of Parliament working as Deputy Ministers would have voted against the motion.
They said there was a rule in parliament called the Three Line Rule which advices every MP to support the motion tabled by parliament.
“We voted in favour of the motion to lift the former republican president’s immunity because we work with the government of the day and you do not expect us to work against it,” they said.
Mr Tembo said he was ready for any action that would be taken by his party against him, saying he was abiding by the rule which requires supporting the government of the day.
The three MPs have been accused of being traitors by the MMD in Eastern Province despite serving in government and the former ruling party believes they could have supported the former Republican President by not participating in the voting.
Meanwhile, MMD in Eastern Province has warned that it would not tolerate indiscipline among its Members of Parliament (MPs).
Provincial MMD Chairperson Alexander Miti said in Chipata today that MPs found wanting would be disciplined harshly.
Mr Miti said that the MMD Provincial Executive Committee (PEC) was disappointed with Nyimba MP Forrie Tembo who has challenged the executive committee’s stance on MMD MPs who voted for lifting of immunity for former republican president Rupiah Banda.

“As MMD we are warning all MPs in Eastern Province to be careful with statements because some of them we might discipline them,” he said.
Mr Miti expressed shock that Mr Tembo including Kapoche MP Nicholas Banda and Mkaika MP David Phiri decided to back the lifting of immunity for Mr Banda.
He described the three MPs who are currently serving in Government as deputy ministers of being ungrateful to Mr Banda because some of them faced resistance at constituency and district levels during the adoption process for the 2011 general elections.
And Provincial MMD Secretary Samuel Lugomo Phiri stated that the MPs would face disciplinary action for betraying their former leader.
Meanwhile, United Party for National Development (UPND) has vowed to continue supporting former republican president, Rupiah Banda after parliament removed his immunity.
UPND Deputy National Chairperson for Youth and Sports Development Michael Chuzu said in Chipata today that Mr Banda needs support because he proved to be a good leader, the time when he served as a republican president.
Mr Chuzu said that this could be evidenced by the international recognition which the former head of state has received.
He also stated that the UPND was watching with keen interest latest developments that have followed the lifting of immunity of Mr Banda.
“UPND will continue supporting Mr Rupiah Bwezani Banda because he proved to be a good leader the time when he served as a republican president between 2008 to 2011,”Mr Chuzu said.
Mr Banda who appeared before the Government Joint Investigating Team (GJIT) for the second time on Tuesday was warned and cautioned on three counts bordering on corruption.
Investigative Team Spokesperson Namukolo Kasumpa said Mr Banda was warned and cautioned for his role in the oil supply deal with unnamed Nigerian Oil firm, campaign materials for 2011 elections and Mpundu Trust Development Fund.
Mr Banda is expected to return to Drug Enforcement Commission (DEC) headquarters on Friday for continued questioning.

The state has no credible case against Mr. Bwezani Banda because there are many issues which point to the fact that the state’s evidence before the prosecution fraternity is grossly lucking in nature, thus investigators are consistent on thorough interogations. If one argues that the state had a water tight winnable case against Mr. Banda, then the state would not tolerate this marathone embarrassing fishing expedition. Note that this fishing expedition in the unfishable waters mirrors the so-called professional investigators as small boys and girls in training and attempting to deconstruct the myths of Sata who assigned them pin down Banda on malicious concoctions.
Removing the immunity is one thing and securing a convinction is s bruising huge mountain to climb whilst relying on myths.
Further, finger pointing should not be the cream of the argument but the merits of the so called case are the main ball of contention. The implications of Sata’s interest in this case, simply put, his political ulteria motives and the related issues leading to the probabilities of prosecuting an innocent man should earnestly concern the ‘think tanks’ of the MMD hierarchy not minor issues i.e. disciplinary hearings.
The defense team must build a defense strategy founded on Sata’s ulteria political motive in that it becomes almost impossible for the presiding judge president at a high court level to reach a vedict in favour of state senior prosecuting advocates. In turn this creates advantages for the senior defense attorneys. Arguments can be highly tedious and burdensome but…

UPND leader Hakainde Hichilema yesterday said President Rupiah Banda has a corrupt mind and therefore has no moral right to talk about the fight against corruption, especially when the powers of the Zambia Public Procurement Authority (ZPPA) have been transferred to State House.

“Rupiah Banda for me as far as I am concerned has no moral right to talk about the fight against corruption. The conduct of his government has demonstrated that corruption is condoned from the highest office,” Hichilema said. “It’s his office that has transferred the powers of the ZPPA to State House as we have seen in the Zamtel and oil procurement cases.”
Hichilema said President Banda had absolutely no interest in fighting corruption.
“What he does is to wear a mask and project to the public that he is fighting corruption when he is doing the opposite. Zambians must not allow Rupiah Banda to change large commodity procurement contracts for personal gain,” he said.

“He removed former Task Force on Corruption chairman Max Nkole who wanted to appeal (former president Frederick Chiluba’s acquittal). He removed Kapitolo (then director general of the Zambia National Tender Board), so which whistle blower is he trying to protect?” Hichilema said. “A corrupt mind starts by preparing the way. They just look at the current structure, management and when they look at certain officers like Max Nkole, David Kapitolo and Peter Mumba (former energy permanent secretary), he gets rid of them.”
And Hichilema criticised the recent presidential appointments.
“Look at what he has done. How many Cabinet ministers are from one region? It’s now jobs for boys and girls, for the relatives, clansmen! This is Zambia, not Gwanda. I hate talking about this because I…

Certain provinces like Southern Province have no Cabinet minister,” Hichilema said. “There is no single Cabinet minister from there (Southern Province) and you have five ministers and about 14 deputy ministers all from one region and in one place which is part of Zambia you choose not to have a Cabinet minister.”
Hichilema said President Banda did not know what people were saying on the ground.
“He is just busy flying around but people are saying ‘there is a corrupt man going’,” he said.
Hichilema also dismissed home affairs minister Lameck Mangani’s justification of the appointments.
“Mangani mentioned me in that but he must not associate me in his dirty tribal mind. Mangani is doing that because of the President’s corrupt mind. This is what a corrupt President can do, especially a visionless President. You know Rupiah Banda is not morally upright with regards to corruption and to talk about corruption” Hichilema said.
He challenged President Banda to let the oil contract the late president Mwanawasa left to continue.
So it means that even when the gov of the day is wrong you have to support them. Wat a stupid reason you are there for checks and balances . On this issue you failed wat did they give any way.
“He is trying to change the contract corruptly. We were having fuel flowing smoothly until the greed of that man came in. Leave that petroleum contract just as Mwanawasa left it, if he is fighting corruption,” Hichilema said. “Look at what he is doing at the Judicial Complaints Authority (JCA). I know judge Chulu personally, Prof Mvunga not much but the President appointing them is corrupt. Look at the Chief Justice, the returning officer, Electoral Commission of Zambia (ECZ) and the Judicial Complaints Authority…Rupiah Banda is embarassing people. This is why we are asking for an independent Electoral Commission. He is stuffing people in the Electoral Commission.”
Speaking on Wednesday evening in his address to the nation on Zambia National Broadcasting Corporation television to launch the anti-corruption week, President Banda said government would continue to strengthen the anti-corruption institutional framework to address any weaknesses and negative effects of the scourge. He said corruption drained resources from the much-needed investment in health, education, infrastructure and other basic services.
“Corruption weakens democratic institutions, perverts the rule of law, discourages investment and aid inflows, undercuts public confidence in government, breeds inequality and disenfranchises large segments of the population,” the President said.
President Banda said pervasive corruption nurtured organised crime, including trafficking of…
human beings and drugs, and is associated with money laundering, including illicit international money transfers which can be used to finance terrorist groups.
He said corruption was a severe obstacle to development and Zambia could not afford to continue tolerating it.
The President said as Zambia joined the world in commemorating the International Anti-Corruption Day, his administration would remain steadfast in its resolve to rid the country of the vice.
“In this regard, my government shall continue to strengthen the Anti Corruption Commission and other institutions involved in fighting the scourge. But the fight needs the support of all well-meaning citizens,” he said.
He said Zambia has continued to place the fight against corruption on top of its agenda.

UPND leader Hakainde Hichilema yesterday challenged the government to arrest him over his statement that President Rupiah Banda (left) wanted a ‘cut’ from the US$ 53 million mobile hospitals deal.
Reacting to information minister Lieutenant General Ronnie Shikapwasha’s statement that Hichilema must withdraw his remarks and that the statement, which borders on libel could not go unchallenged, Hichilema said he was ready for the government.
“I am more than prepared. Nobody would come for me, they must go for 12 million Zambians I am speaking on behalf of. I’m not afraid. You tell Shikapwasha, sometimes he tries to use his big body to threaten people,” Hichilema said.
“Before they come for Hakainde they should go and deal with the job losses on the Copperbelt, before they come for Hakainde, they must reduce the mealie-meal prices, before they come for Hakainde they must not feed us with GMO maize. When they have done those things, they will find me waiting for them. If they attempt to come for me, let them do so because the public will be reminded of all this chain of corruption under the MMD and that will help them to be taken out of office quickly.”
Hichilema said he would continue to speak on behalf of the public.
“We will not stop and for your own information, Shikapwasha has no capacity to threaten anybody, myself included. We will speak for the people. Shikapwasha must focuss on serving the people and not threatening the people. The reason why children have no jobs it’s because of behaviour which is corrupt like Zamtel, behaviour which is corrupt like buying mobile hospitals,” Hichilema said.
He maintained that the government was corrupt.

Hichilema said the RP Capital Partners deal was a good example of corruption.
“Society objected the Zamtel issue and the person who came out to support Dora Siliya who was wrong and the tribunal has proved… that was the President followed by the Vice-President. Now, who are those? They represent MMD, they represent the government. So holistically, it means that you actually have a rotten team out there that is pursuing personal interests against public interests,” Hichilema said.
How will you define a President, a Vice-President who are supporting a minister who was pursuing an agenda which the public did not agree with? Is that not personal agenda? Why should Zambians pay to RP Capital Partners because of the minority interests? That is corruption, that is white-collar crime.”
On defence minister George Mpombo’s statement that his remarks were an assault on the President’s integrity and borders on defamation, Hichilema said Mpombo was blowing hot air.
He tried to talk of privatisation, whose policy was privatisation? Was it Hakainde’s? Was that not an MMD policy? Am I an MMD minister myself? The issue of privatisation was an MMD policy. Can you tell these chaps to stop threatening Zambians because we are not afraid of them.”
On Wednesday, Hichilema said President Banda and his government should be blamed for the proposed procurement of mobile hospital units from China.
But Mpombo on Thursday said Hichilema’s comments bordered on defamation while Lt Gen Shikapwasha advised Hichilema to substantiate or withdraw his statement.
And UPND spokesperson Charles Kakoma said the tribal sentiments made by their member of parliament for Sinazongwe Raphael Muyanda were his personal views.

And our laws currently are that we should not say anything that hurt the tribal feelings of other citizens and therefore, as a party, we do not think that attacking Bembas or attacking the Church is the correct thing to do. As a party, we would like to distance ourselves from that statement,” said Kakoma.
Muyanda on Thursday accused the Catholic Church of dividing the nation, adding that they used Bemba in their English mass in one of the churches in Lusaka at the expense of the majority who did not understand the language.

Just been on the Parliament website to check this MP’s credentials. Wasn’t surprised at what is there. Completed Grade 12 and handful of certificates in this and that which, I suppose only Sata and the PF see great value. That explains his shallow none argument about why he voted with the government. If these chaps were not arrogant, as his constituent member, I would ask the MP, in whose name he voted and inform how his sponsoring party felt. Does not matter which party you belong to in Zambia. They are all non aligned, they are a mixed grill: no capitalist, no socialist, no communist, no Hunamist. They all stand in the middle of things. Even the MPs and the electorates are all swingers. They swing wherever the pendulum swings. If you are a looser you will end up loosing more supporters and if you are a winner you will get more supporters. Especially that politics is seen as the major source of income and good life. Only until we come to have many people out of the poverty datum line, when people will loose interest in politics or being used by politicians, the swings will never end. So UPND, MMD, FDD, etc you only have core supporters with you now, the rest are with PF, for everyone knows thats where the cake is.

RUPIAH Banda will end up more disgraced than Frederick Chiluba, Mapatizya UPND member of parliament Ackson Sejani warned yesterday.
Commenting on President Banda’s role in the questionable privatization of Zamtel, Sejani warned that the sale of Zamtel would be investigated to its logical conclusion once the PF-UPND Pact assume office
He said President Banda had failed to learn from former president Chiluba’s mistakes.
“He President Banda is going to end up even more disgraced. Yes, because Rupiah Banda now is not only shouldering his own problems but he has taken over the sins of the other people,” Sejani said.

“I have said this before, this cross which Rupiah Banda has assumed, Chiluba’s cross which is laden with political, economic, social sins is heavy for Rupiah Banda to bear. And once we get in government you will know what I am talking about.
Chiluba committed a lot of political sins against Zambian people, his maneuvers to undermine constitutionalism through the third term, his plunder of Zambian resources through the cases that are in court, and his dubious acquittal, you can also add the social scandals along his marriage life.”
Sejani said Chiluba’s sins were now being carried by President Banda and he would have to atone for them.
“By making Chiluba his consultant, his best friend, his advisor, Rupiah Banda is assuming Chiluba’s sins and he will come to account for all those sins once we get in power,” he said.
Sejani said in the PF-UPND government no one would intervene to protect plunderers.
He said all the plunderers would be investigated and President Banda should not think he is insulated from what is to come.
Sejani said the corruption that characterized the sale of 75 per cent shares in Zamtel was there for all to see.
“The privatization of Zamtel was not done correctly. The Dora Siliya and RP Capital saga will still be followed once we get in government. How was RP Capital in the first place brought into the picture? And the amount of money that was paid to RP Capital, really is it something that this economy can stomach?” Sejani asked.
“The process of selling companies in Zambia is supposed to be transparent. How transparent was the sale of Zamtel from the beginning up to the end? Was the Zambia Public Procurement Authority involved at one stage or not? Or there were shortcuts that were used? The issues that we raised at that time are still the issues that we are raising up to now.”
On President Banda’s description of the Zamtel deal as the best compared to any other privatization process carried out in the country, Sejani said the sale was not justified because of the anomalies that characterised the process.
It is a big scandal and it is going to come and consume Rupiah Banda. He will be investigated over this. In Tonga we have a saying mulandu tauligwi cucu, even if you commit a crime now, in 40 years that case can still be revisited. It is never eaten by a rat,” he said.
Sejani said President Banda was following Chiluba’s footsteps.
“He will only know that he has committed a mistake once we start dealing with him. Sometime back you interviewed me The Post, I told you that Chiluba was Rupiah Banda’s tutor.
Now you confirmed that they were consulting Chiluba. So they are following exactly the footsteps that Chiluba followed, and this is where they are going to end up in a ditch,” he said.
Sejani said the country should be worried about the fight against corruption because it was now dead.
He said President Banda had abandoned his campaign promises of following on late president Levy Mwanawasa’s legacy.
Sejani said President Banda and his colleagues were now hell bent on what they could reap from the country.
He supported Lubinda’s statement that plunderers deserved to be in prison because they were thieves.
“A thief is supposed to go to prison so that he is punished and reformed. So that when he gets back he is a better citizen to society,” Sejani said.
He said the National Anti-Corruption Policy which President Banda and his colleagues kept on boasting about was absolutely lip service.
If you are committed to the fight against corruption don’t disturb what the courts are doing. Why did they stop the appeal against Chiluba’s acquittal? Why? Because this country would have learnt, there were many issues that are related to the cases that Chiluba is involved in,” said Sejani.
“By stopping that process then they have announced to the whole world that nobody is interested about corruption.
They can pass laws about corruption but that is all…just like many other progressive laws we have in the statute books but nobody is prepared to implement those laws.”
Forrie Tembo, Nicholas Banda and David Phiri will easily scoop their seats on the PF ticket. Why are you guys even wasting time? Just resign and join PF. MMD will continue haunting and wasting your time.

This is a real shame for democracy and it renders the whole idea of a people’s representative completely useless. An MP should not vote for or against a motion simply because his party thinks that is good or that is bad. He as a people’s representative must base their judgement of facts and make a decision that is in the best interest of the people. That is why i expect that even in the PF, if some MPs really thought the removal of immunity was not good, they MUST have failed free to vote against it. Shame!

Corruption has worsened in Rupiah’s govt – Hakainde

UPND president Hakainde Hichilema yesterday said he misses late Levy Mwanawasa because corruption has worsened in President Rupiah Banda’s government. And Transparency International Zambia (TIZ) president Rueben Lifuka has observed that political will to fight corruption in President Banda’s administration is not as strong as it used to be with president Mwanawasa.
Addressing a press briefing in Lusaka, Hichilema said the MMD was inherently and endemically corrupt.
“All these changes to the public procurement Act were purely to camouflage, the intention was ultimately that will allow them to procure government [goods and services] in a corrupt manner,” Hichilema said.
“If you allow a government in your country during daylight to make such changes and you are quiet, then you are an accomplice to corruption. That is why you have seen the perpetuation of scandals. I think as an opposition leader I used to criticise Levy Mwanawasa; I miss Levy Mwanawasa as I stand here today. Corruption has worsened and it has become institutionalised through various forms.”

Hichilema charged that the MMD government changed the public procurement Act in preparation to run a corrupt government.
He explained that the draft public procurement bill, which was agreed upon by all stakeholders had safeguard measures to prevent corruption but the government last year changed it.
“They decided amongst the things they wanted to do; I want to show you how this government crafts a change and sometimes goes to Parliament using the arrogance of numbers to pass an Act preparing for corrupt activities. They decided to change the governing board; stakeholders had said they would want a board of nine and a third of the board members coming from the private sector – independent citizens of different professions,” Hichilema said.
The MMD decided to increase the number phenomenon and brought about a governing board consisting of the minister of finance as chairperson, four ministers appointed by the President, one of whom shall be the vice board chairperson, preparing to run a corrupt government. Only two people from the private sector and the rest are from within the government. It’s a huge mistake and it went through.”
Hichilema urged members of parliament to repeal the public procurement Act of 2008 and replace it with one, which would uphold acceptable standards and principles of public procurement.
Hichilema cited the RP Capital and Zamtel saga in which former communications and transport minister Dora Siliya was involved as one of cases of bad procurement process.
“It was done because of corruption; it was because of an intention to get a cut that is why it was done. I ask Dora Siliya, I ask the Vice-President [George] Kunda who protected Dora Siliya and President Rupiah Banda to pay back the US $ 2 million that they authorized the RP Capital deal,” Hichilema said.
On the Genetically Modified Organism (GMO) maize, Hichilema said President Rupiah Banda suggested that Zambians reconsider GMO food because of his relatives who were involved in the deal.
“[The late president] Levy Mwanawasa and the country had agreed that we are not ready to consume GMO maize for health reasons and when this matter came, who answered to support GMO maize? It is the President [Banda]. The President said let us review the consumption of GMO maize when the maize was already in the country and he went to suggest that can we create milling companies at the borders so that we can mill the maize at the borders,” Hichilema said.
“That is why I said the President comments on maters where he has personal interests and possible gain.”
He also said politicians in the government had no moral right to stop corruption because they were corrupt themselves.
“Reported theft of public funds in the Ministry of Health, yesterday’s Post. Thefts of public funds are becoming a daily occurrence because the civil servants are seeing what the politicians are doing at the top,” Hichilema said. “The politicians have no moral right to tell civil servants not to steal because the politicians are the ones perpetuating corruption. “
This should now make the people realise that when we talk about Hichilema being driven with bitterness, envy and jelous against His Excellency Michael Chilufya Sata, this is what we mean. The chap has done a 360 degrees U-turn just because Sata defeated him lamentably and just because he comes from a tribe this foool hates with a passion

Zambians lets not forget that easily on how RB behaved in power…and these are grown men behaving like adolescents.
It is unfortunate that there is finger pointing now , the people who caused this are MPs who boycotted the debates and did not vote because if their had participated and voted the scenerio would have been different PF would have failed to get above 90 votes to push the motion through. Eg if 48 boycotted + 87 present gives as 135 and two thirds of 135 is 90. So the MPs who boycotted wanted the immunity to be removed because if they had remained in parliament the motion would have not gone through.
That is exactly why observers are condemning the whole process. It was like an ambush, a calculated move whose motion was presented on the last day when the proposer of the motion knew the numbers of MP’s in the house, especially opposition MP’s were out of “coverage area”. Why do you think PF had to fly in the Livingstone MP to Lusaka just a few hours of announcing his victory for swearing. All just to have the votes go their way. Then Matibini has his knickers in a twist by claiming that the High Court has no jurisdiction over the house in one breath and yet listens to the High court when expelled MP’s have their cases in the High Court? Why the haste?
Folly, I for one can support RB’s removal of immunity owing to the fact that Kaunda went through the same, so as chiluba, had it not been for death, Mwanawasa would have gone through the same. So there is no point of leaving RB since even the current President (Sata) shall go through the same path. Please dont show us your lack of education. Next time we vote for MP’s lets look at their credentials and what they have contributed to their constituencies voluntarily. For sure this country has gone to the DOGS!!

I am truly disappointed in the UPND over the matter of RBs’ removal of immunity and prosecution for his wrong doing. The statement by Forrie Tembo, however leaves a lot to be desired for am MP. He should have only voted if he is as convinced as I am over RBs’ corruption.

I have no quarrels with removing RB’s immunity but there is a laid down process that needs to be followed especially when embarking on an issue that borders on constitutionality. The argument here is not whether these two deputy ministers did what was right or wrong. We are looking at his argument of voting with the government he is serving under as the reason he voted to remove RB’s immunity. We are countering that by citing how full cabinet ministers and PF members saw it fit to defy the same government they serve under. The MP would have been alittle bit more convincing if he gave us why it is that they felt on principle it was the right thing as some one has put it that RB has his chance to rebuff these allegations.
