RB’s office responds to Government’s reasons for stopping him from going to Kenya

The office of the fourth President Rupiah Banda has issued a media statement addressing the reasons advanced by Government on why he was stopped from attending the inauguration ceremony in Kenya on Monday.

Below is the full statement.

GOVERNMENT HAD NO RIGHT TO DEFY COURT ORDER

LUSAKA, 11th April, 2013—FOLLOWING numerous queries that we have continued to receive from the media regarding the statement that was issued by Deputy Minister of Information and Broadcasting Services Hon. Mwansa Kapeya on Tuesday, 9th April, 2013 on His Excellency Rupiah Bwezani Banda’s abortive trip to Kenya, we now wish to respond.

To begin with, the statement appears to have been hurriedly constructed without much reflection. The government is saying that they stopped the former President from travelling because he would have arrived in Nairobi a few hours after newly-elected Kenyan President Uhuru Muigai Kenyatta’s swearing-in ceremony which took place that very Tuesday, 9th April, 2013.

Whilst it is true that former President Banda was due to attend festivities and activities connected with President Kenyatta’s inauguration, one should realise that these festivities and activities are not restricted to only the swearing-in ceremony.

It is much like telling someone who seeks leave to attend a funeral upcountry that they will not be given leave to go because they will arrive a few hours after the burial. There is a lot that happens at an inauguration apart from the actual swearing-in ceremony, just like a funeral is not only about the internment of the body.

The reasons given by the Deputy Minister are extremely lame when you take into account the following facts:

    1. The request for the former president’s passport was made in good time to the Director of Public Prosecution (DPP) on Friday, 5th April, 2013.
    2. The DPP promised to get back that same day, but by 17:00 hours he had not responded to the urgent request despite several reminders that the matter was urgent.
    3. Over the weekend, the DPP did even bother to respond to calls placed to him over the same even though it was clear that time was of the essence.
    4. The former President was left with no option but to apply to the Court on Monday, 8th April, 2013 for the release of his passport to travel to Kenya.
    5. The Court on Monday granted the Order and the lawyers started chasing after the personnel from the Government Joint Investigations Team to secure the release of the passport but only managed to do so late on Monday afternoon.
    6. The Order from the Court in the relevant section read, “IT IS HEREBY ORDERED and DIRECTED that the passport being held by the Government Joint Investigation Team be released to the Accused person immediately to enable him travel to Kenya.”
    7. The passport was not released immediately as Ordered and the first available flight was the one he booked, Kenyan Airways flight KQ724 which was scheduled to depart Lusaka at 11:00 hours the following day.
    8. The Order from the Court had envisaged that former president Banda could be out of the country up to Monday, 15th April 2013.
    9. It is unheard of for immigration officials to ask a Zambian national leaving the country why they are going out. All that is required of them is to see if one has a valid passport.
    10. The Immigration official at Kenneth Kaunda International Airport clearly stated that he was acting on instructions from his superiors.
    11. The immigration officials, or even the Minister of Home Affairs, had no right to question the Order given by the Court, which was clear and unambiguous in allowing the former President to travel to Kenya.
    12. The immigration officials at the airport have given different reasons for stopping H.E. Rupiah Banda from those advanced by Hon. Kapeya. To compound things further, the Acting President Edgar Lungu has provided a third version.
    13. The question as to whether the immigration officials acted on their own initiative or followed orders from above is an important issue which has been left unclear by the conflicting government accounts.

What is worrying is that the Executive feels that they are entitled to overrule a judicial pronouncement, and this does not augur well for the Rule of Law and investor confidence in the protection of the law in Zambia.

Another very worrying aspect is the question of whether or not the investigations against the former President are fair and independent.

From the statement by the Deputy Minister to the effect that, “The country is aware that Mr Rupiah Banda was warned and cautioned by the GJIT for many other offences in which he is due to be arrested” clearly shows that the investigators are being directed by politicians and not acting impartially and fairly.

Such a statement that the former President was going to be arrested should have come from the investigators and a politician.

This goes against the international norms that investigators should never receive directives from political players. This is a clear abrogation of the Rule of Law and independent and fair investigations.

  4. The court order was for the RELEASE of his passport which was done. The has no business in deciding who the immigration officers should or should not allow to travel.

  10. What is shameful is that a pattern has now been created where ex-presidents have to be dragged into court for office abuse after their term. Mr. Ruphiah helped create this scenario. It appears kafupi was his idol and he determined to emulate his thieving ways by brazenly removing a clause that was put in place as a deterrent to dishonest conduct. He became a thief when he did that. Now he is capitalizing on PF govt’s disorganized way of prosecuting offenders and hopes to get away free on a legal technicality. He is a thief until he proves he isn’t.

It is advisable that you remain quiet and allow the law to take it’s course than yapping yapping like a rabid dog. There are no sacred cows , where law is concerned. You are no different from any suspect under police investigations in Zambia. If govt was to give permission to every suspect in our prisons, all criminals and suspects like you will flee the country never to return. After all govt was represented by the VP and KK, what’s your cry any way? Stay home and clear your name. This tendance of trying to hide is worrying.   17. The authorities must be very careful in the way they handle the RB case otherwise Mr Sata and his government will be isolated, banned and shunned by the international community just like Mugabe.
    It is sad that too many GRZ officials are free to outdo each other by issuing conflicting statements. It seems they never meet for consultations on any given issue in order to agree on an official and sensible statement to be released to the public. What we are seeing is a total circus and quite embarrassing.

This is an ‘hunt through’ exercise on his enermy which has gone horribly wrong.In the first place the man with a catheter was hoping to copy the precedent set by Mwanawasa on Chiluba and other criminals that have being banged up in prison by Nchito at an expensive legal cost .So far no one seem to appreciate what he is doing.The effort that Levy put in the fight against corruption was reprocated by donor aid and boosted investor confidence.None of that is yet to happen with UKWA and it is time he revisted his reverse gear.He needs to spend his energy on ensuring that Mmembe and Nchito pay back tax payers money with interest.

  30. What is worrying is the trend of jumping bail and running away to other countries by these plunderers and criminals. How can the courts trust RB when his son is already on the run? RB is a flight risk and should be confined within Zambian borders and the claim that someone can pass through the airport as long as he or she has a valid passport sounds a bit outdated. This is the age of terrorists threats and organised crimes and most countries put a no flight ban on any citizen who commits a crime. RB’s cases of corruption and plunder are very serious charges and no country in the world can allow anyone to leave its borders when he is facing such charges.   34. This is a sad reading our country has sunk so low within a short period of time. The saddest thing is that we have seen how our neigbours in Zimbabwe have suffered at the hands of one man. People used to write in papers that the country ‘s economy is collapsing because the direction it is taking is wrong. Those closest to the pot (Govt revenue) used to laugh it out. Today Zimbabwe has the highest number of citizens’ exodus only rivaled by the Ireland after the 1939 famine which saw more than 4 million Irish emigrate.   38. After reading these comments its clear some people just hate. Former president Banda. No one has proved his stolen, yet you calling him a theif. His rights were abused, no question about it. Whether or not he has a case or two, he was allowed to travel. The courts are theo blame if he runs away. Not the government. George Mpombo is busy missing court dates and yet he has a passport. He is even a convict but he is allowed to travel, the government doesnt seem to set him straight. Don’t you think that’s hypocrisy with the way the are treating Mr Banda??   39. People should understand one or two things if not more. RB’s crediblity and integrity is at stake should he abscond and fail to return. He looses all the international standing he has so far enjoyed. Mandela was behind bars for 27years all for the things he believed in. In the end it was he who walked away with the world in awe and a nation shamed. It’s not saying RB is on par with Mandela but it is the outcome of Govts wrong positioning especially in the face of international eyes glaring at us. On the other hand this Govt stands to be Judged harshly for RB not attending the ceremony in Kenya when he played such a key role in what could have been a volatile situation.   50. Gvt has the right to restrict your movements when you are facing criminal charges. That is why his passport is with-held. Suspicious arrangements to travel out can be denied. 2. Gvt did not defy court orders, the passport was issued(clever). 3. Mr. RB was invited to the Inauguration ceremony not festivities of his own choice- that not even the Kenyan Gvt is aware of. Previous behavior of Mr. RB has caused the raising of a red flag. He seem insincere – hide and seek at SA embassy, in SA itself and link to commonwealth saga.   55. RB is right to claim the protection of the law. Those who think that he is guilty should be patient and let the wheels o justice turn. Justice says that one is innocent until proven guilty. Even a murder suspect (Oscar Pretorius) in South Africa is allowed to travel outside the country whilst awaiting trial. Therefore in seeking to VARY the terms of his bail which included the surrender of his passport RB should have gone back to court to seek for the release of his passport ‘for the reason he sought to travel to Kenya for Uhurus inauguration’.True the DPP has been maligned often but in this case he had nothing to do with the release of the passport. True the Spokes person for government of the day had his foot in it when he ‘tried’ to come up with some semblence of a reasons for governments denial to allow RB to leave his country. GIVEN THE CIRCUMSTANCES SURROUNDING RB IT WAS VERY WISE NOT TO ALLOW HIM TO TRAVEL. OUT THERE IN KENYA WE ARE NOT IN CONTROL OF WHAT HE DOES. LET HIM BE PATIENT. HE CLAIMS TO BE INNOCENT AND THAT SHALL BE KNOWN. FOR NOW HE REMAINS A SUSPECT. INFACT THE INTERNATIONAL COMMUNITY WILL PRAISE ZAMBIA FOR BRINGING A THIEVING PRESIDENT TO BOOK. IF HE IS GUILTY.

The problem of treating thieves with kid gloves, every fool in support of a thieve will always come up with silly comments and if you continue with your kid gloves, thirves will in the end start behaving as if they are doing the right things. If RB with his type of arrogancy is found guity, please jail the man so that others can learn to respect the thing of invetigators , so far it is like the investigation teams we have are useless and cant do a good job.   66. Punka, you promote jungle law when you declare people to be thieves without any due process. There is the presumption of innocence which is the bedrock of our criminal law system. Hate is not warranted in this matter. People who are facing even far more serious crimes like murder (an example is Oscar Bladerunner Pretorius) are allowed to travel out of the county whilst awaiting trial. There is the two French naval officers in India who were allowed to go back to France. There are many examples of civilisation which is not based on hate.

  67. Rumrod, you clearly believe in mob justice and not the rule of law. Your hate shows an underlining psychological problem which leads you to rage against someone who has not been found guilty by any court of law. I fear that you will have a mental breakdown when Rupiah is acquitted of all charges he is facing.
