People’s Party (PP) President Mike Mulongoti says acting chief Justice Lombe Chibesakunda should step down to keep her good reputation and integrity.
Mr. Mulongoti said that Justice Chibesakunda is a qualified person who does not need to worry about her future if she leaves her position today.
Mr. Mulongoti said that he has no doubt that Justice Chibesakunda will listen to the many people who have continued to speak negatively about her holding on to her current position.
The people’s party president has since appealed to the chief justice to reconsider her position and move a step further in her life by doing other things.
Mr. Mulongoti said that Justice Chibesakunda comes from a humble beginning and she should not dent her image by holding on to the position which she no longer qualifies for.
And National Restoration Party (NAREP) president Elias Chipimo has urged acting chief justice Lombe Chibesakunda to leave room for someone eligible to take over her position.
Mr. Chipimo said that there was no basis in law which allows somebody who has passed retirement age of a judge to be considered for a permanent position of chief justice.

Mr.Chipimo stressed that calls for her to retire have nothing to do with questioning her integrity or competence.
He noted that he knew Ms Chibesakunda very well but stated that if she allows the controversy associated with keeping her in that position to continue,it will have an impact on her integrity.
Mr.Chipimo added that for the sake of preserving her integrity which is important to everyone, she should not allow the process to continue.
He noted that someone eligible, capable and qualified by age should take over adding that the move will be fair for the Zambian people who are familiar with the law.
The NAREP leader said that it was unfortunate that on a straight forward matter the PF administration is again choosing to follow instinct and emotion rather than reasoning.
They will do well to consult widely and refer to the parliamentary select committee meeting for acting chief justice to resign he said.
He further added that government should blame itself for the consequences of not listening to the people.

Acting and being are two different issues. If the Chief Justice is acting, which I think is not a permanent position, why then should she resign , and from what position.
One only resigns from a permanent position, not a temporal one. For instance, the Egyptians have got themselves an acting president, will it be in order for him to be asked to resign so that another acting President is appointed??

For those that dont understand the contract law more relating to constitutional offices. The Office of the Chief Justice is one provided by constitution and has clauses attached as to who is capable to serve that office and how they are appointed and approved. I believe the Chief Justice is appointed from the Supreme court/High Court bench. The law also stipulates that the retirement age for a High Court Judge/Supreme Court judge is 65years. Although upon retirement judges can be seconded on contract. However, once attaining the age of retirement that judge is ineligible to be appointed to the office of Chief Justice (hence the refusal of the Parliamentary Law Subcommittee to confirm Justice Chibesakunda to the office of Chief Justice). One cant act for more than 6 months…

Age should not in itself be a problem. The biggest problem is having a chief justice serving at the pleasure of the president. As long as she is acting, she will not rock the boat. RB is the one who started this trend of giving judges short contracts so that he can get rid of those who do not dance to his tune. It is a disgrace!!
Get your facts right and dont bring RB into this. I don’t remember RB appointing an “Acting Chief Justice” at any time while in office – never mind one that occupied office illegally over six months. And Judges are appointed to the bench until retirement. Short term contracts are only given to those judges who are past the age of retirement where need is recognised and to complete workloads.

There is no need for resignation of Chief Justice. The office of Chief Justice is very important. The substantive office holder has not yet been named. In the meantime, allow appointing authorities to utilize a suitably qualified and expereineced individual like the incumbent to discharge duties without undue pressure. When you are appointing authority, then you have the power to preserve the integrity of the office. Give enough time tro appointing authorities to do the work dilligently.
