The Anti-Corruption Commission has arrested former Zambia Railways Limited Chief Executive Officer Professor Clive Chirwa for alleged Corrupt Practices involving over K280, 000.00

Prof. Chirwa was arrested yesterday and charged with two (2) counts.

In the first count, Prof. Chirwa is charged with failure to Disclose Interest contrary to section 28 (1) of the Anti-Corruption Act No.3 of 2012.

Details are that Prof. Chirwa, 59, between 1st November, 2012 and 31st December, 2012 as CEO of Zambia Railways Limited recommended at the Zambia Railways Board meeting that Clavel Incorporated Limited, a company in which he is a shareholder be given a contract to train Zambia Railways employees without disclosing interest contrary to section 28 (1) of the Anti-Corruption Act No.3 of 2012.

In the second count, Prof. Chirwa is jointly charged with Ms. Regina Mwale, 50, and Finance Director of Zambia Railways Limited for Abuse of Authority of Office contrary to section 99 (1) of the Penal Code Cap 87 of the Laws of Zambia.

Details are that between 1st November, 2012 and 30th April, 2013 Prof. Chirwa and Ms. Mwale whilst acting together abused the authority of their office by authorizing a total payment of K289, 128.84 to Fallsway Apartments of Lusaka for accommodation for the benefit of Pro. Chirwa without following laid down procedures.

Prof. Chirwa and his co-accused who have since appeared in the Kabwe Magistrate Court have pleaded not guilty to the charges.

The ACC has outlived its usefulness.You let Kabimba go and you go after a person who has a heart for Zambia.What message have you just sent to those people abroad who want to develope Zambia? STAY ABROAD DON’T COME AND WORK FOR THE LOSERS BACK HOME,THERE IS HIGH PROBABILITY YOU WILL BE ARRESTED.TRY AFTER 2016

    • They FAILED to link Kabimba to his Midland company and swept under the carpet…diasporan or not if the prof. broke the law he should face the music, he should know better.

    • @Liam – who told you that Clive has a heart for Zambia and Kabimba hasn’t? Imwe ma-Zambians please be mature in your reflections on reality. What is this excitement all about? Do you actually know Clive Chirwa and Kabimba personally for you to make such wild declarations and claims? Stop think thinking through your bottom and use your head please. And then what will you say tomorrow if you actually found out the truth about Clive? Tone down and stop acting like children. These are just himan beings who are not perfect and you can’t come here and start defending Clive as if you know him personally. Because of being narrow in mental scope, Zambians tend to reduce everything down to politics. That is why foreign investors are firing them and replacing them with foreign workers.

      Now when prof chirwa was let go, the govt come out, cleared prof chirwa of all allegations and declared that no fraud had occured and that eurobond was intact..
      And the ACC is not professional and cant be truth, believe me there are some evil hands behind this arrest, Prof chirwa i think made a mistake suing the govt to claim his passport and somewhere along the line he(prof chirwa) made enemies with the `great` mmembe..

    • “He informed the very first meeting of the board that he will hire the company to offer this service. He was advised then that the board would not allow single sourcing as it is against government procurement regulations and that the President has already made a clear position on this. Coming from outside, he was actually briefed of some cases currently in the courts of law regarding anomalous procurement practices. After investigations by the board, it was established that this company, registered in 2000 in the UK, is (as per the filed accounts for the financial year ending 31 August 2011, signed by Clive Chirwa himself) a dormant company with hardly any assets and owned by Clive Chirwa and his family members (wife and two sons). How many people have been arrested by PF’s ACC since 2011?We have had all main opposition leaders arrested,opposition Mps like Nkombo,journalists,human rights activists,parastatal heads etc all these were arrested and there was lots of noise and excitement in the media initially.|For some the DPP put his tail between his legs and entered nolle prosequi for others their cases have been thrown out by the courts.Do you remember the gold scandal RB was accused of?How come we’ve stopped hearing about it.Zambians are so gullible .You truly deserve PF.

    • But how? Has Prof Chirwa has still been in Kabwe? I thought this man said he would fly back to the UK anytime after leaving the ZR CEO job which we were told was actually A FAVOUR he was doing the country!

    • There’s just a kind of stupidity in some people which education can never remove. how could a whole Professor undermine the intelligence of Zambians and think they wouldn’t detect such a simple thing? And given the amount involved, should we really believe this man’s story that he was as comfortable in the UK as he claimed?

    • I know its punishment for refusing to campaign for PF in Mkaika. They told him to go and help boost support for PF but he refused. When threatened he decided to demand for his passport so he could escape to the UK. But the PF are not through with him yet. Thats why they have blocked him by slapping him a charge that allows them to hold on to his passport. The major thing they are scared of is that if he leaves Zambia, he will talk and expose all the rampant corruption and theft taking place in PF and it government.

      Any way he has himself to blame for the mess he is in. It is his greed responsible for his suffering. With sata you don’t question anything.You do as told and shut up. At the moment Sata only listens MKCMN. For him to survive he must sing praises for Sata day and night.

    • This is quite disheartening. Clive excited Zambians with his vision but we didn’t know his weaknesses.

      Part of the reason for differing with ZR board was the way he wanted to do everything and I mean everything alone even when such needed approval from the board.

      Zambians in diaspora, don’t look down upon the fellow citizens back home thinking you been there done that, so you know it all

    • Indeed it speaks volumes about HH ‘s intelligence and wisdom. The man is more intelligent and wise than anyone in PF. That explains why he did not want work with Sata in government in the first place. He carried out a critical analysis on Sata ‘s thinking and reached a conclusion that Sata is a Chimbwi with out a plan(CNP) and to work with him would have been an insult to his intelligence and wisdom. So he jumped off the boat at the earliest opportunity.

      For people like Prof Chirwa without wisdom they easily took the bait and are now victims of their poor decision making process. HH tried to share his wisdom with Prof but Prof thought academia is superior than wisdom and ignored sound advice. Where is he now?

      Sata is canning. He draws his enemies closer and then destroys them.

    • The saddest part of it is why this rent supervised by the controlling officer( PS WORKS AND SUPPLY), the ACC are not joining the PS to these charges…………Once convicted Prof Chirwa becomes a criminal of rent while the Conspiracy Board members laugh…………..sad sad sad- Worst humiliation!

Using your own company for business with where you work, especially without declaring interest, single sourced is an offence even in the UK, Why should it be okey in Zambia. Go back to Zed and work in a clean manner, the law would not visit you.

  6. The PF forgave him, but he went ahead and sued the government to give him his passport back. So they are reacting and punishing him. That’s why he is in court. It is like he is ungrateful to the president for cushioning him.

    He should just have applied for his passport without going to court.

So Chirwa is being charged for paying his rent billings at Fallsway as CEO of ZR, while the Minister of transport, accumulated over K400,000 at the same apartments and is set free? DOUBLE STANDARDS PF. Kwenaa, I have never seen such Rubbish.

    • The issue of Zambians in the diaspora going back to Zambia is more complex than this issue alone ! Indeed a lot of wise Zambians are actually investing in Zambia ! Furthermore , Zambians in the diaspora are diverse ! Some are high powered professionals while on the other end of the scale , some do menial jobs ! Additionally , some Zambians who are not in the diaspora are doing quite well and slowly investing in Zambia ! I think the best way is to have an open mind and see where you can best fit in ! Don’t just justify your continued stay away from Zambia by citing examples like Prof Chirwa only !

CEO & Finance Director are signatories / Senior executives, who don’t even prepare payment vouchers?? so what proper procedures are you talking about, when settling an Account Payable?? You went on to accuse the lady maybe going out with Chilwa?? Why would you not think maybe its motives by Board members when they had refused to pay them Allowances for doing nothing, which is stealing from poor Zambians?? Please don’t conclude before facts. As you are showing your true dullness.

      you are partly right, the prof should have know better, he should have demanded for a written contract in black & white. He should have known every other entiltments which were going with that job including accomodation in black and white!! i think the prof acted a bit desperate!!

  12. I believe the ACC has a solid case against Clive Chirwa. I’m one of those people who tried to advise government with evidence how Clive Chirwa is just a conman and should not be appointed MD of ZR. Now I’m relived to be proven right. Unfortunately, sleepy Zambians continue to support him. No wonder former President Frederick Chiluba once said “Zambians are docile”. I’m sure Clive Chirwa is thinking the same when he reads blog comments on Lusaka Times that support him.

When you called Chirwa to com to Zambia,what agreement was made regarding his place o residence,was he going to live in a tree?Am sue all involved knew that at some point he would have to rent a place if not a hotel.Even when he was coming,he must have been given leverage to chose a place to stay in at GRZ expense.That’s why when you do some of these things,donot allow your excited emotions get the better of you.I for me was actually fogetting about the prof,now you guys have woken sleeping dogs which will sleep at high cost than what he is accussed of having abused.Advise is you can never please zambians at all.Concentrate on major development if you have any than what you are pursuing now.

  15. This report makes very sad reading, it looks like Pro Chirwa was betrayed by some of the board members and there is no doubt that most of those in leadership are deeply involved in corrupt practices but go unpunished.

    • The prof. thought he was “clavel” you can not deny the board sitting allowances then try to enlist the services of your firm even if its in the interest of the ZRL!

  23. Pro Chirwa is not an intelligent character. History has a way of repeating itself and one thing Africans are not good at is learning from history…In 1991 when the MMD came to power, Chiluba appointed Dr Kawimbe and minster of Health. The good Dr managed to convince a number of Zambian specialist in the diaspora to come work at UTH including a well know Zambian specialist in Canada. Kawimbe constituted the most professional UTH Board ever. When Chiluba fell out of favour with the intelligenia in the MMD he fired Dr Kawimbe and appointed Sata as minister of Health. Corrupt Sata stole money from UTH and ministry of Health transferring government money in his personal account. The UTH board could not condone is steal. Sata decided to fire the UTH board so he could steal better

    • If Prof Chirwa was intelligent he would have know that Sata does not like intelligent people around him. The skim to arrest him is well planned and the trap was lead out the day he accepted the job.

    When Scott finished his Phd in the UK, he first worked at the ministry of finance as a research offer. Kaunda fired him for incompetence. His next job was minister of agriculture, Chiluba fired him for corruption (the swine scandal). Sata has kept him because he can feed is ego of having a useful F.O.O.L for a deputy

  27. PF a government of Kaponyas for Kaponyas by riff-raff Kaponyas.
    Appoint a qualified person on a blank slate, expect him to upgrade Zambia Railway Limited so as to sing PF songs once developed. The road map was absent at ZRL as the company was without ant board in place. In the mean time, without any condition of services, Prof Chirwa was expected to begin his task without any enabling action including where he was to be accommodated. What a joke of these Kaponyas.
    Sata appointed Chirwa who came with guidelines from his solicitors how to negotiate over his contract. Surely, during negotiations no PF govt official clarified the accommodation clause? Its frightening to experience PF is governing Zambia. But for how long?

  29. Typical Zambian twist. Official report did not find Chirwa guilty and the government decided to retire him rather than fire him. Why are these kabovas now trying to arrest someone who has been given a retirement package funded by tax payers? We are sick and tired of your incompetence.

  30. i thought corruption was not criminal in Zambia! otherwise Dora siliya and co. would not be cleared by courts of law to recontest.
