

THE Lusaka Magistrate’s Court has acquitted Foreign Affairs deputy Minister, Gabriel Namulambe in a case in which he was charged with theft of 20 bicycles valued at K11,000.
It was alleged that Mr Namulambe on November 21, 2010 in Kitwe being employed in public service as deputy minister in the Ministry of Mines then, stole 20 bicycles altogether valued at K11,000 the property of the government which came into his possession by virtue of his employment.
In his ruling yesterday on whether he should be found with a case to answer or not, Magistrate Wilfred Muma said the prosecution had failed to prove that the bicycles were stolen and belonged to Small Scale miners.
“ The essential ingredients of knowledge or reasonable ground for belief that the bicycles were meant for Small Scale Miners has not at all been proved, I rule that the accused has no case to answer and I accordingly dismiss the charge, acquit the accused and set him at liberty forth with,” he said.
Magistrate Muma said the accused stated that he was given the said bicycles by the then Mines Minister Maxwell Mwale for personal use and asked him to use the same truck that was going to Kitwe to deliver the other bicycles to Mpongwe.
He said this statement was in tandem with the circumstances of the case were the accused subsequently gave two bicycles openly believing that there were his property.
This to the court was an indication that there were no proper instructions whether the truck carrying the accused bicycles were also supposed to be driven to Kitwe and the accused could not be convicted on the point of lack of knowledge.
And in an interview after ruling, Mr Namulambe said he had gone through a lot of trauma during the whole process and expressed happiness at the outcome of the ruling.

Then the court must give back MMD those bicycles, so that they go and prepare the ground for Mansa elections.

Exactly @Nizaulula, how come the case against Max Mwale is still sticking and yet, the same bicycles on Nalubambe is no case. Thought handling stolen property is crime!

My heart indeed breeds when I see such injustice being practised by incompetent and corrupt judiciary. Lets wait and see if indeed Malila will appeal this outcome at all and take it that this fooolish namulambe was in MMD wat cud have been the outcome?!!!!! indeed its animal farm.
That was very kind of Hon. Max Mwale to buy so many bicycles and give away 20 of then to a fellow cabinet minister. Did Hon Mwale consult the wife and family on the decision to buy so many bicycles. Did they not have other needs in the family.
And for Hon. Namulambe, that was a strange gift!! Twenty bicycles.
How I want to do the same for the poor villagers I left in that forsaken remote of Zambia. I am sure they needed the bikes more than Hon. Namulambe. !!!!!What a circus!!!!!

In principle courts do not speculate as you are. this was a bad case from the beginning.
Prove it beyond reasonable doubt… leasson learnt dont take people to court for the sake of fixing them have your facts in place do your home work( is it an offense is evidence there what type of evidence is it can the evidence be brought to court etc) DPP you need to get on top of this. if i may ask what are your achievements since you took office.

Namulambe aquitted? I expected this. Then the question still remains, what about others who have remained in opposition and they have vowed not to join the PF party? We are waiting to hear the case of Masumba the play boy then we can judge for ourselves. I believe if it were me by now I would have been arrested for forgery and plagiarism.
I find it very odd because maxwel Mwale is in court of the same bicycles. So, Gabriel is acquited because they were a gift but Maxwell stole them. Should Gabriel not then be tried for recieving stolen goods? Guess you need to have the right friends in the right places….

Magistrates are the most manipulated and corrupt officers in the judiciary. We all know the backroom deals done with the PF to avoid a by-election resulting from Namulambe being found guilty. His day of reckoning will come soon.
Namulambe was given the bicycles by Maxwell Mwale. Namulambe didn’t steal according to the court. And there was no evidence to show that the bicycles were meant for small scale miners. Benefit of doubt. Now what if Maxwell is convicted of stealing the bicycles, is Namulambe going to charged with being found in possession of stolen goods?
The charges for stealing bicycles were slapped on several MMD leaders as a crude way of punishing former Ministers. This judgement, therefore, clears all other MMD leaders such as Maxwell Mwale and Dr, Musokotwane etc who were slapped on charges of stealing bicycles from the owner who never complained to the Police. In this regard the PF will go down the history of Zambia as a Party that had no regard for civilisation nor decency.
Where is the integrity of the Zambian Police? If Wynter Kabimba, Mumba Malila, Musa Mwenye and Mutembo Nchito are worth living for their so called legal profession, let them appeal to the High Court to reverse this Court’s judgement.
Gabriel must be feeling really good that he joined PF otherwise he wouldn’t even ride a bicycle!
