

Transparency International Zambia has welcomed the conviction of Sports Deputy Minister Hon. Steven Masumba.
TIZ Executive Director Goodwell Lungu said the conviction sends a good signal in the fight against corruption that even serving Ministers can be brought before the law and made to account.
Mr Lungu said it is very rare in Zambia to have a serving Minister convicted of a criminal offence.
He has since commended the Lusaka Magistrate Courts for dispensing justice without fear or favor.
Mr Lungu also strongly advised the Patriotic Front leadership to always lead by example and to be accountable for their actions and remain above board all the time and learn from Mr. Masumba’s conviction.
The TIZ Chief has since called on President Michael Sata to immediately dismiss Mr Masumba from his deputy Ministerial Position.
This is contained in a news statement issued in Lusaka by TIZ.
The Lusaka Magistrate Court Monday convicted Mr Masumba on one count of obtaining pecuniary advantage through false pretences in connection with a NIPA certificate he allegedly obtained.
Sentencing for Mr Masumba has been reserved for Wednesday, November 20 2013.  Masumba who is Mufumbwe Member of Parliament (MP) will, as a convict, spend two nights in prison before knowing his sentence as the court ordered that he be sent to prison while waiting for his lawyer to mitigate on his behalf before the court can deliver the sentence.

Principal magistrate Wilfred Muma said in his judgment delivered in Lusaka earlier today that  that the prosecution had proved its case against Masumba.
Mr Muma said Masumba knew very well that he did not clear his accounting technician course and also did not sit for one of the subjects to enable him acquire a certificate and later on be eligible to graduate from the National Institute of Public Administration (NIPA)  He said there was no doubt in the mind of the court that Masumba fraudulently obtained the certificate from NIPA which he used to find employment for himself.
Mr Muma said Masumba induced and duped institutions such as the Lusaka Business Technical College by using a fraudulently obtained certificate.
He said that Masumba neglected to uphold ethical standards that each and every NIPA students were taught to honour when he noticed a mistake about his qualification.
“As if that was not enough he went further to apply for a job using the defraud certificate and even earned a salary from December 2005 to 2008 July at Lusaka business technical school,” Mr Muma said.
Mr Muma further said it was clear in the circumstances that Masumba induced the business school to believe that he had qualified when infact not.
“I have not found any aorta of truth in the accused person’s testimony. I therefore find the accused guilty and thereby convict him accordingly” he said.
Masumba ‘ defence lawyer who was representing Mutakala Lisimba later asked for an adjournment to enable her prepare mitigation.
Mr Muma adjourned the matter to tomorrow for mitigation and sentencing but ordered that Masumba be taken to prison until Wednesday as he was a convict.
Masumba, 31, was charged with obtaining pecuniary advantage through false pretences contrary to section 309a (2) c of the Penal Code as read with section 41 of the ACC Act number 42 of 1996.
It is alleged that Masumba between December 1, 2005 and August 2008 obtained employment for himself as an accounting officer at Lusaka Business and Technical College using forged documents.

Masumba’s awaiting fate begs the big question; will he be disqualified as an MP because of this conviction of a crime of corruptly obtaining a qualification by false pretence. If not ,then that will be clear evidence of selective justice being perpetrated by the PF’s judiciary.
Opposition MPs’ seats were nullified and yet non of these MPs have actually been convicted or arrested for their offences.

@Wanzelu Masumba is likely to exhaust his full offering of appeals (i.e. High Court and Supreme Court), which will be an addition cost in time taken away from these courts processing other cases. Once he applies he probably is allowed to remain an MP.
Now Masumba has proved by reasonable doubt that he is not witch. His witchcraft couldn’t work against magistrate.

Saulosi remember that Sata appointed Masumba at a time when his DPP had already authorized prosecution. What does that say about Sata? I am sure that in the country where you live Masumba would not have been adopted as a candidate for PF and subsequently appointed as a Deputy Minister, while there was a court case pending. That is just good order and so to save the system an embarrassment such as this one.

Hahahaha, he has even forged his age. Masumba is NOT 31, he was a grade ahead of me. Come to think of it, this boy went to Kasempa boys in Grade 8 in 1993. If he is 31 as he claims, it means he was born in 1982, meaning he was 11 years old in Grade 8 (1993). It also means that he started Grade 1 at the age of 3. Even if he skipped some grades, this can not add up.

The law on fake qualifications should not only be punitive on the person cheating but include those accepting the fake papers like employers. The burden should also be on the person hiring to prove that the docs in their possession are genuine failure to which a heavy fine or jail be meted out.
Nsimbi. I think it will be difficult for the employer to prove anything because the certificate itself is genuine and not from matero. The problem is the way it was obtained.

If one guy made a typing error were was the school adminstrator responsible for monitoring and awarding certificates? And what about the rest of those who were in the same situation? Something is not right here and am pretty sure this had been going on for some time meaning there are a thousand more sitting on highly paid jobs they dont even deserve, it’s about time Government recalled all former NIPA students to re-examine them afresh for of them are suspects, maybe the entire country is what can one say, that explains his character and behaviour!

Govt knew that Masumba’s qualification was fake. Issue is that politics were at play. Firstly, PF needed a foot inside NW Province. They took Elijah Muchima, Richard Taima and Stephen Masumba. Muchima noticed early what PF was up to and did not want to compromise his tribes mates etc and his own beliefs. He was dropped shortly after that. Richard Taima failed to deliver even the chief in his area hence the decision to use him, then dump him. Masumba delivered Mufumbwe chiefs but has failed to make inroads into NW province. Time is moving and he has not influenced any MP in NW Province to make the cross – so he has been used and is about to be dropped. He has failed to meet his KRAs. Also realise that as long as he is close to Pres Sata, team Winter wants him out.
Masumba should respect our education system and achieve every level genuinely without altering the process.Mune kusunsumanako petebulo for you to acquire what you wish to be.No short cuts bane mukapandapofye ubwanga if such acts and vices are left untreated.The law enforcement should firmly deal with him if proven guilty and i strongly appeal to the relevant authorities to start audit of ministers qualifications with immediate effect.Investigating should be put in place to sort out leaders with forged papers from matero issuing university where any paper can be sourced.

Ba Luba Kaonde, TIZ is right on this issue. Their comment / statement is on the conviction of Masumba and not calling for his investigation. The Kabimba and GBM issue is another and not related to the issue on the table. Masumba’s conviction should send a strong signal to all crooks in PF that you can run but you can not hide!

Mr. Sata knew all these things before he appointed Masumba to a ministerial position. This case was there before. Mr. Sata chose to undo all what the previous Govt. was doing by just trying to undo even the things that were good. It is gratifying though to note that slowly he is settling down and going back to what he rubbished just when he ascended to plot 1. This includes the extension of KKI Airport. Any new Govt. that comes to power should not act without thinking, it is Zambia at stake not a political party so please good development plans should be carefully concluded. Zambia will not be developed by just printing Chitenge materials of political parties but by continuing on the development path that has been carefully thought out.
That’s why I consider all those MPs who cross from one party to the other as people who lack integrity!!
