Kabimba’s resignation calls justified – LAZ

The Law Association of Zambia (LAZ) says calls for Justice Minister Wynter Kabimba to step down in view of the tribunal that has been set up to probe allegations of abuse of office and breach of the oath of secrecy are justified.

LAZ president James Banda has told QFM News in interview that Mr Kabimba’s stepping down will ensure a fair hearing and that people sitting on the tribunal will not feel intimidated.

Mr. Banda points out that some witnesses to the tribunal will come from Ministry of Justice which Mr. Kabimba himself heads.

The LAZ president has however expressed happiness that Mr. Kabimba has shown willingness to be probed by the tribunal by welcoming its creation.

He says to this effect, LAZ trusts that the Judges sitting on the tribunal will handle the matter fairly and without intimidation.

Meanwhile, Mr. Banda has disclosed that the Law Association of Zambia has found valid points raised by former Solwezi Central Member of Parliament Lucky Mulusa in his recent letter to the Association seeking legal opinion over the legality of Acting Chief Justice Lombe Chibesakunda and her Deputy Florence Mumba sitting on the Supreme Court bench that nullified his election.

Mr. Banda says his association also takes Mr. Mulusa’s points seriously and that the Association will be consulting with the lawyers that represented the former Member of Parliament.

    • Kabimba Summer has no morals and dont expect him to resign on moral ground. Only people with morals resign on moral ground. Dont expect the chief Mampara of the Week and Chumbu of the century to ask him to resign too because they all have no morals.

    • Mulusa possesses a lot of the attributes needed to fight these Patriotic Fools – intellect, courage and confidence. He’s got something they can never take away(Bob Marley, Ride Natty Ride)!!!

    • There can’t be any justifiable reason for Kabimba to remain in office while the tribunal is sitting. It’s a no brainer and he should simply give way or give reasons why he should remain in office. At the very least he should be sent on leave by his appointing Authority…difficult when he is held hostage by the very person he is supposed to send of leave….

    • Wynter, you do not need to wait for a letter from Sata. The tribunal is about YOU, and not any other person, and as Justice Minister we expect you to know the need for you to relinquish your current government position in view of what you are about to face—a tribunal. Most witnesses will come from your ministry where you are the boss. So in the interest of justice and fair play, you need to step aside so that witnesses can be allowed to give evidence without intimidation, or fear. So THERE IS NO NEED FOR YOU TO WAIT FOR SATA’s LETTER. I hope that with this very simplified explanation, you will understand why you need to step aside. Let me know if you still do not understand

  1. Yeah they seem to be waiting for the weight of public opinion before they come out to issue some toothless and almost overdue statement. They are supposed to be guiding public opinion, not public opinion guiding them while they do the following.

    And their statements must be followed by real tangible actions, like revoking the practicing licenses of their members found wanting and those who breach their regulations. At least they have taken the issue of retired CJ to court.

  2. Maverick, I entirely agree with you as you always speak lots of sense. This LAZ is completely irrelevant and moribund to say the least. They are very reactive instead of being proactive to matters of public interest. What happened to the LAZ that made FTJ to relent on the third term saga? I mean the LAZ that took on KK until he succumbed to multiparty politics? That is why whenever there are LAZ elections politicians take a keen interest and want to control the process so that they can have election bearers who empathize with them. What a shame from these so called learned comrades who can even now abandon their LAZ positions for government appointments! Anyway what do you expect from people who still wear wigs left by the colonial government.

  3. Nobody is clean here. KABIMBA IS NOT GUILTY YET. Even LUCKY MULUSA himself did not demand for the tribunal to probe Kabimba out of national interest. Mulusa asked for the tribunal because he lost his Membership of Parliarment after the Court found he was involved in corrupt practices during the elections. So Lucky Mulusa himself is an interested and biased party as well who has been looking for anything to hit back at the system. IF people insist that Kabimba resigns then Lucky Mulusa who is already guilty should be sentenced for electoral corrupt practices. This case will be a wash out and Kabimba will be found innocent. Even in the past we have had Ministers probed by tribunals but they didn’t resign. Dora Siliya only resigned because her case was much more serious. Stop the nonsense.

  4. @Maverick, @Oyaya, Well spoken. My thoughts too. The LAZ is supposed to set win-win benchmarks on issues to do with seeking advancement in the rule of law in our Country. Make law bidding cool and trendy to both the politician and the followers..etc.. But instead, this organisation lacks presence, it tiptoes on issues and sounds feeble and apologetic most of the time. Why is this?

  5. LAZ is toothless, lacks the depth to fight battles that are worth fighting for. LAZ is corrupt to the bone and only come out with half baked opinions. LAZ does not inspire the citizenry on matters that in many cases the man on a street is looking up to them to give direction or guidance that are open to criticism of its lack of direction. Frankly I wonder men and women leading this unique organisation Got their qualifications through hard earned abilities or they managed to get through the famous Katondo street. A lawyer worth salt will explain why the organ feels the law has been broken and not just waking up from sleep and shout like a drunkard from Eastern province after drink kachasu .

  6. True justice is founded on principles of democracy such as rule of law. The moment governing authorities seem to undermine the core upon which democracy is founded on, confidence of masses will immediately erode them.
    It does not add up, really and true. How will the juniors to Kabimba, to whom they are supposed to report, confidently face him in the face to probe him. If my memory saves me right, Kabimba was the reason Dora stepped down during her investigations. We are not judging Kabimba, he knows himself being a lawyer that in principle the best thing to do in such moments is to step down. Lets suppose he is found not guilty, will the people ever listen to him in the case he doesn’t resign, even if he does what is right they will still question his integrity.

  11. I am interested in the Tribunal who is who at the end of it all. This is the time people must bring out issues that will make sense and those that will not make sense.

    You voted for this government and you are feeling the outcome of your vote, so it will be the same with this outcome of the tribunal because the outcome is well known.

    Kabimba is a lawyer, so is Fred and these have friends who are lawyers. What Kabimba is according to the law. If it was not according to the Mr. Banda the LAZ president could ve told us what Mr. Kabimba is doing is wrong according to this law.

  13. Generalization can mislead you. It is necessary to distinguish various allegations of wrong doing. It seems to me that criminal offenses, such as economic crimes or corruption are more grave and serious than certain civil cases involving personal differences. The discretionary power to recommend a suspension, a resignation, or criminal proceeding in a court of law lie on the shoulders of the head of State. Running away from government duties is not necessarily the solution. Government by its very nature bears soft duties and hard duties. This one is hard, but essentially a duty that must be borne with integrity. Why not give him the chance to prove his innocence without further disruption? This looks quite serious but manageable to me.

    • It is your tribunal, you the people with Mulusa as ring leader, why should Mwansa Kapeya government spokesperson comment? Just go before this tribunal and tender your evidence, let’s see where this end up!

    • yes, why is the president so quiet on the issue?even if it is loving kabimba this time i don’t see any hole for them to hide and manipulate things.

  14. The issue of Mr Lucky Mulusa must be carefully looked upon because even people like us who never studied law can still see that something is not in order.
