Magistrate rescues himself from handling a PF cadres case in Kasama

Kasama Principal Magistrate Kelvin Soma has today rescued himself from presiding over the trial of six Patriotic Front cadres aligned to former Defence Minister Geoffrey Mwamba after information emerged that he was spotted in the company of accused PF cadres eating nshima supposedly bought by the accused persons.

Mr Soma said a police officer who he only identified as Bwalya raised the issue that the magistrate had been seen at a restaurant where the accused persons bought him a plate of nshima.

“My standards would not allow me to enter an establishment of such caliber, however, since the report has been made, I cannot continue with this matter,” Mr Soma said.

The case, in which Christopher Malama, 33, XCharles Chama, 41, Mwila Chitongo, 36, Frank Mbewe, 34 and Wilson Sinkololwe 39 have been charged with conduct likely to cause breach of peace, has since been handed over to the new magistrate Vincent Siloka.

The six accused took a fresh plea of not guilty. Malama and Mbewe were charged with an extra count of assault occasioning actual bodily harm to which they pleaded not guilty. Particulars where that the six, on Dec 26 jointly and while acting together engaged themselves in conduct likely to breach the peace. Malama and Mbwewe are on the same date accused of assaulting Chiba ward councilor Rose Chilufya.

Earlier on members of the public following the trial of six PF cadres aligned to GBM were warned against treating the court room like a political rally.

Magistrate Siloka threatened the people in the packed courtroom, of which most had come aboard a Kasama Central Constituency 26-seater bus, with a night in detention at Milima State Prison if they continued with bad behaviour in the court room.

Because the court room was filled to capacity, some members of the public were forced to follow proceedings from outside through the windows.

The crowd had been mumbling in court and mobile phones ringing before the magistrate gave the warning.

  1. The second lordship to rescue himself. If courts are being treatened, thieves still from MTN, on lookers say nothing, and even still from the minister office, police shooting people and MP firing gun shoots instead of fireworks, Ministers failing to resign when been investigated and no press conferences.
    Where are we going?
    Cadres wearing military uniform and publicly announcing that he took part in assaulting innocent people at church and markets, mentioning people who destroyed someone’s property.

    • This is a good move, not the old Musona who took advantages of cases to access free things from rich guys, but refused to rescue himself but instead send people to jail and deny them bail.

      hopless even not acknowledging the bail from high court.
      some are there to eat and not to serve.

    what is happening in kasama? GBM has been detained in kasama, he has been refused to leave kasama, his diplomatic passport grabed from him, he is now any illegal Zulu in bembaland facing deportation to South africa… the chitimukulu sosala is also facing expelsion from his kingdom… lucky enough he has been offered aslyum in choma until after 2016

    • They had it right yesterday, but I don’t know what happened since then. It could be the author stumbled upon some hidden tujilijili before finding his pen and paper. Lol.

  3. I suspect most magistrates are trapped in the PF’s or King Cobra’s jaws so they have to rescue themselves.-lol

  4. Lusakatimes…. Please, as the others have pointed out above, the correct word to use is “RECUSE” and not RESCUE…
    It’s “RECUSE,” “recuse”, “r e c u s e…!”…………..
    I ‘ve seen many articles with the same mistake on this before!!! Please take note for all similar articles in future and improve on simple spelling mistakes!!!
