Former Solwezi Central MMD Member of Parliament Lucky Mulusa has called for the immediate enactment of a law that prevents nominated Cabinet Ministers from acting as republican president.
Mr. Mulusa observed that though Mr. Kabimba is eligible to act as president by victual of being a Cabinet Minister he shouldn’t be acting as head of state because he was not an elected MP and was once rejected by voters in a constituency were he hails from Mumbwa.
Speaking at a media briefing in Lusaka today Mr. Mulusa said though it is constitutionally right for a Minister without a constituency to act as president it is not ok for a person who does not represent any fraction of the public to be left with the instrument of power and run the country.
He noted that there is need to respect the spirit behind the enactment of a law that requires a president to be elected by the people hence the need to have an elected Cabinet Minister act as opposed to unelected members of the cabinet.
“I want to remind the PF government that while it constitutionally right for any Cabinet Minister to act to perform any duties including acting as president regardless of whether they are elected or nominated we need to go beyond that and respect the spirit behind the enactment of a law that a president will be elected by the people it means that there is an element of respecting the wishes of the people.
Therefore, unless there is absolutely nobody available who was elected rather than nominated to act, going forward we should ensure that in the absence of the president a person who acts at least represents a constituency and went into government through a vote, through the wishes of the people that way we will be avoiding the unnecessary tendency of ambushing the interests and rights of the people to choose their representative.
I feel that while it is constitutionally right for Mr. Wynter Kabimba to act as president, being a nominated and having previously failed to win an election; meaning that people did not approval of his leadership to be allowed to act as president is actually ambushing the interest and rights of the people.”
And Mr Mulusa has threatened to sue the Speaker of the National Assembly Patrick Matibin for neglecting his duties.
“I have noted that the Speaker of the National Assembly has neglected to respond to my polite request for him to include sanctioning Mr. Mutembo Nchito the DDP for having lied to the parliamentary select committee.
We need to realize that justice is a very important part of governance and we need to protect it and that public officials should protect it.
Our constitution allows for any body to compel public officials to perform their duties under the law of writ of Mandamus I now wish to inform you that using the same law I am going to take the speaker of the national assembly to court to compel him perform his duties,” Mr. Mulusa said.
Ha ha ha dont be funny Mulusa.This thing of advocating for new laws to suit your personal interests is dangerous.It reminds of the time when Chiluba made motor vehicle theft a non bailable offence just because the guy who chewed his wife was facing a motor vehicle charge.

The New Constitution will address such pitfalls. We will not have any more Donty Scotty’s. Anyone that doesn’t qualify to be President shall equally not be elected as Veep.
We should not have ANY nominated MPs in Parliament. It is the legislative arm of government, and as such, the permanent voice OF THE PEOPLE, not the Executive.
This is how an un-elected person ends up being President, an equivalent of a civilian coup! Hope the NEW CONSTITUTION abolishes this anomaly, if we will ever actually get a new CONSTITUTION.

I do not know what Zambians want. They are the same people proposing that Cabinet should be chosen outside Parliament and again saying Kabimba is not an elected MP. Nomination is not illegal he qualifies.
Mulusa is very right and speaking with facts. Winter Kabimba has no mandate of the Zambian people to preside over the affairs of this country. Yes, precedents may been set, wrong precedents for that matter, but we can’t allow this to continue. There is not even a fraction of the Zambian population that Kabimba represents. . It’s a mistake and a very serious one. It’s only in countries like Zambia where such nonsense is acceptable. That’s why we need the new constitutions to address these flaws.

Even the gratuity of RB is a scandal, George Kunda spearheaded the manipulation of the constitution so that RB can qualify, which is wrong because we cannot change laws just to benefit one ONE individual! Most of the so called ”BAD LAWS” in the country were created and targeted at certain individuals so that MMD can maintain a grip on power or continue to steal! Grand theft auto was non bailable but when MMD MPs stole constituency vehicles they pushed for the change in law!!
Mulusa should be researching to find out if it is ILLEGAL to appoint a nominee MP to act as president. We cannot continue to be making laws which are politically or emotionally motivated and targeted at few individuals, the MMD in 20 years kept changing the clauses in the constitution and we have ended up with a constitution which is very different from the original document because of people like Mulusa, they use emotions and power to manipulate laws to suit themselves!
It is about time the Supreme court became pro-active and started to strike down oppressive laws which are undemocratic and discriminatory in nature instead of just interpreting them. Just because someone is a tribalist or racist, we should not let them turn their hate into laws!!
