Secretary to the Cabinet Rollard Msiska has confirmed that President Sata did appointment Justice Minister Wynter Kabimba to act as President before his departure for Israel.

Dr Msiska said President Sata signed the Instrument of Delegation of the Functions of President on Friday, 20 June 2014 and complied with the Law in all respects.

He said the appointment was published through the Gazette Notice No. 385 of 2014 dated 27th June 2014.

In a statement issued Tuesday morning, Dr Msiska hoped that the speculations over this matter will now be allayed.

Meanwhile Chief Government Spokesperson Joseph Katema has challenged people questioning the legitimacy of acting President Wynter Kabimba to read the constitution and see whether there is any illegality in his appointment.

Dr Katema told QFM News in an interview in response to growing speculation that power might not have been handed over properly, that the constitution is clear on the transfer of power for someone to act as President.

Dr Katema said only the republican President can appoint someone qualified to act as President from among members of the Cabinet while he is away.

    Most of the anti-Kabimba noise is being orchestrated from within PF, I wouldn’t entirely blame Opposition on this issue. There is a group within PF that isn’t happy with Kabimba acting as President.

  30. This Statement sounds rigged or fraudulant to me. So do they mean to tell us that between June 20th and June 27th when the president was out of the country, there was nobody acting? Could it be the reason why Dr Msiska refused to answer the same question yesterday until the whole process went through the PF fraudulant machinery. I smell something fishy here.   33. Naimwe ba Saulosi besu, people are entitled to ask and seek clarification. It’s called being alert, and Zambians were taught that lesson many years ago by KK during the liberation wars. Kanshi imwe mwikalafye kwati Zombie? Nothing to do with whether you are opposition or not, even PF cadres had similar questions but not asking for obvious reasons. Now that answers have been given we move on.

  34. Thank you for the clarification Dr. Msiska. The issue would not have escalated to the point that it had if the PF Government had handled this matter in a more direct way, instead, they chose to add fuel to the flames by being secretive about something that is as simple as having the Secretary to the Cabinet confirm that all was in order. This is really the problem of having elected a party that had spent too much time in opposition. They spend too much time arguing about simple matters at the expense of governing the country.

    • DR Msiska is the culprit himself. His statement was as if procedure was not followed. why are you thanking him. Even if am not learned at grade 2, i managed to analyse that statement. After Msoni and Mulongoti spoke louder did Msiska respond. What changed from his previous statement where he stated he was a man of procedure, was he not just corrupted to back date that document

  35. Dr Msiska needs to clarify matters further. Was Sata hallucinating when handing over power to the cartel? Country men and women lets be serious with our democratic institutions.

  36. IF it turns out that PRESIDENT SATA was not in the right state of mind when the document was signed, this will spell the end of the cartel and the likes of Msiska. We know the President is vulnerable right now and has been for sometime but where is the loyalty and compassion from the likes of Mmembe? Can this document be signed by a President who is mentally unstable?

Why then did it take so long to speak, I doubt the credibility of the defense because in my view, I could be wrong, it’s very possible that the gvt could have sent someone with the document to The President so that he can sign it with a backdated date. This is very possible because they hold all the instruments of power which no one in the opposition has access to.
