President Michael Sata is not obliged to physically open Parliament – Sondashi

Opposition Forum for Democratic Alternatives (FDA) President Ludwig Sondashi says there will be no legal implication if President Michael Sata does not officially open Parliament later this month.

Dr. Sondashi says this is because the country’s republican President is not obliged by the law to physically attend the official opening of Parliament.

Dr Sondashi who is a constitutional Lawyer has told Qfm News in an exclusive interview that the President can however send a message to Parliament that can be read by either the Vice president or any Minister whom he wishes to delegate to perform this task.

The FDA president has however noted that this provision of the constitution only allows the republican President to exercise such powers when he is ill or outside the country at the time that Parliament is opening.

  1. Dr Sondashi, if he exercises that option, Will it be the official opening of Parliament or official opening of the National Assembly then? Because the National Assembly only becomes Parliament when he is there.

      Sata is dead why make excuses for him. He is not in Zambia at all.

      Now that the constitution provision requires that the president admits that he is not feeling well to attend the parliament opening ceremony, will the PF admit that Sata is sick and not fit to attend the opening of parliament?. Difficult question for PF minions.

      In an effort to stay compliant with the constitution PF will cook up a lie that president is going abroad for a medical check up so that a fake statement can be released to allow Guy Scott to open parliament.

      If you put a photoshopped picture I will know because I have software that analyses how the picture was put together by reversing the photoshop effects.

    • @gundown-very nice. you are thinking my brother/sister. so sooner or later the presidency is required to open parliament whether ill or not, unless he appoints someone to act as president therefore, the presidency and its powers are then in the hands of that person acting and can therefore go to national assembly and open parliament.

    • Here is how I think PF will play us; Guy Scot mentioned Sata will attend the 69th session of the UN General Assembly on 16th September, 2014. If parley is opening on September 19, then the excuse will be he is at the UNGA, kwasila. At least there, he doesn’t have to utter a word. He can just sit and doze off through the sessions or better yet, he can just lay down in his hotel room watching pay per view po.rn!

    • Sondashi got his PhD from the same school where Chiluba got his degree in political science. This University allows people to get degrees by correspondence. Now you know where Sondashi is coming from. He does not know what he is talking about.

  3. Sondashi got a good check. In any case due to true speculations we command him 2 open parliament. Im sure anyone can open the National Assembly BUT parliament is a prerogative of the president or vice versa. Very soon you wl cheating that anyone can inspect a guard of honor. There is no anyone in the constitution. If Sata can’t open parliament, be assured that nature wl answer people’s cry

  4. …so what Sondashi is trying to tell us is that in the event that he does not open the parly but he is in the country then it must be concluded that he is sick…….with lingering denials, I can for see an arranged working holiday just in time to justify otherwise………
    however, the reason for being out of the country is also porous….unacceptable because the opening date is known well in advance to arrange his schedules appropriately…….
    Its like trying to justify your absence at your parent’s funeral….’because u are not legally bound to’……its just morally wrong not to be present just as it would be morally wrong for the presido not to open parly for any reason other that being sick……..

    • Finally some scrutinizing. in this article Sondashi is simply stating the legal implications. He does not go so far as to suggest that the president will infact not attend. He is most likely insinuating that if the president does not attend he must be sick. Speculation is rife on whether the president is sick or not, and on whether he would attend parliament or not, based on speculation on his health. Sondashi here just provides the constitutional framework within which this is happening with relation to the opening of parly, or national assembly as someone has pointed out, that National Assembly only becomes Parliament when the president is in in attendance.

  5. Dr Sondashi is in no way speaking as a PF Cadre or as a politician. He is giving an expert opinion. I don’t support PF, but to call Dr Sondashi names for an honest advice is rather unfortunate. Don’t blame Dr Sondashi, blame constitution

  7. Will wait till the dday,19 September,but I think he will open parliament giving a speech of no more than 10 minutes and he will say it jokingly that people are saying am sick,so I can’t continue.then back to nkwazi house and life goes on par zed.

  11. All those who preach evil and wish others die, will actually die first before the people they wish to die. Wanzelu or Alibe nzelu will die first, before all those he wishes death. It is demonic to believe in death so strongly, and wish others death on a daily basis. Who is chipuba alibe nzelu or whatever your name that is? God Almighty will safe guard Sata and you will, surely pay your price for wishing innocent people death. Sata is not the creator of your missery. What is it that Sata has done wrong ,for you to wish him dead on a daily basis? Don’t you have anything to do, on this planet Earth? I , ve never being a cadre before or worked in govt but have alot to do than yapping like a rabid dog on a daily basis for no reason. Get employed, you will have less stress .Believe in God .

  12. You can say that again! It is politicking to coerce government officials to perform their duties personally. Official duties must be carried out in accordance with the law. Period. There is no need for niceties when nothing is being achieved. Development is a complex national project where appeasement never works. In this regard, it would be better for senior officials to stop contradicting each other. This is especially true when junior officials contradict senior officials in order to over excel in the performance of their duties. There is no need to undermine senior officials even if there seems to be details that are missing. Team work is the best for government officials.
