PATRIOTIC Front (PF) national chairperson Inonge Wina has asked the Supreme Court to dismiss an appeal in which presidential hopeful Miles Sampa is contesting the declaration of Edgar Lungu as party president.
This is according to an affidavit in support of summons to dismiss an appeal and for multiplicity of actions filed in the Supreme Court by Mrs Wina.
Mrs Wina said there are two separate appeals in the Supreme Court pertaining to the matter of president of the PF, which Mr Sampa is contesting.
She added that there are two parallel proceedings in the High Court resulting in two parallel appeals.
She submitted that apart from the appeals, there are pending contempt proceedings against six respondents, who include Mr Sampa, before the High Court.
Mrs Wina said the parties in the matters are the same and that there is a possibility that the Supreme Court is likely to come to two conflicting decisions over the same matter.
“I am also advised that the court disapproves of parties commencing a multiplicity of actions and procedures over the same grievance. I crave that this court dismiss this appeal for being an abuse of the process of court and multiplicity of actions,” Mrs Wina said.
And lawyers representing Mr Lungu have filed a notice to raise preliminary objections.
The lawyers contend that Mr Sampa’s appeal is incompetent because it includes Bridget Atanga as she is no longer secretary general of the PF.
The lawyers argued that the appeal is misconceived, incompetent and an abuse of the court because Mr Sampa is seeking to enforce his rights acquired from an illegal election.
It was further contended that the election was outlawed by an injunction dated December 1, 2014 and that the order of injunction was “wantonly disregarded, disrespected and disobeyed thereby committing contempt of court”.
“That on public policy considerations, it is undesirable that people like the appellant who do not respect court orders or wish to benefit from an illegality should use the courts of law to advance their cause,” part of the affidavit reads.
They further added that it is undesirable that courts should be abused or used to resolve intra- party wrangles of private clubs and associations.
They submitted that the appeal is bad for duplicity as the reliefs sought are part of contempt proceedings before High Court judge Mungeni Mulenga.
Mr Sampa who has since been joined by Kasama Central member of Parliament Geoffrey Mwamba and Seleman Phangula have appealed to the Supreme Court contesting a judgement by Justice Mulenga where she dismissed their application to be added as defendants in a case in which Mrs Wina has sued PF secretary general Davies Chama.
The trio argued that Mr Justice Mulenga misdirected herself when she held that they were incompetent to apply to be added as defendants adding that she had no inherent jurisdiction not to hear them on an inter parte application.
She dismissed the application adding that the trio could not re-open a matter which was fully determined and that the law is clear on how a matter can be challenged.
By the time these issues are put to rest, Mr Sampa would have missed the ballot paper by many miles.

Miles Sampa’s grounds of appeal are very strong and no competent and fair judge can dismiss them. The least the Supreme Court should do is to order a retrial of this case at the High Court level under a different judge. Mungeni’s conduct on this case not only undermines the credibility and respect of the judiciary but also highlights her own corruption and that of Edgar Lungu and his team. The desperation shown by Lungu’s team to ascend to the PF presidency is frightening while their willingness to destroy state institutions like the judiciary in an effort to acquire power is indicative of what type of government they will install, if elected. I hope the Supreme Court saves the integrity of the judiciary by ordering for a full retrial of this case.

I think when all is said and done, PF should erect statues of these three gallant women at their secretariate: Inonge Wina, Jean Kapata and Mumbi Phiri. These gallant women have fought tooth and nail to wrestle the party from being swallowed and hijack by the Cartel of Mmembe, Kabimba and Guy Scott. Essentially they have save the party from being burried with the founder Sata at embassy park.

What I am wondering is why not ask the court to declare Miles Sampa a VEXATIOUS LITIGANT? That would make it clear to all courts not to continue hearing the same issue unnecessarily. I guess the Lungu camp is afraid to try such a bold approach for fear that if not granted then the courts would essentially be declaring that Miles does have probable cause and his actions are not frivolous. As always Lungu and company are indecisive.

I guess some clarification is needed. The reason why HH was selected to take over UPND was not becuase he was Tonga. HH. Was very instrumental in the formation of the party. He was the brain behind the organization but being the humble person he is he chose to stay out of the lime light and let others take the glory. This is not even to mention that it was important to have a person swith ample resources to keep the party viable and a significant contributor in the Zambian political process. HH was selected becuase he had the leadership atributes and the party needed to have a leader that could devot all his time to building a following without worrying about self sustenance.

You say HH was the brain behind the UPND? I consider that as an insult to the late Anderson Kambela Mazoka (MHSRIP). I believe that if Mr. Mazoka contested the 2006 elections, the UPND could have won, remember he came second at his first asking on the other hand Mr. HH has been third for God knows how many times.

Let me correct you on this. The UPND was formed by Dr. John Mulwila and Mr. Gilbert Temba. These two gentleman then invited Mr. Anderson Mazoka to join them because they strongly felt he had the respectability and appeal to boost the image of the party. Unfortunately for the two gentleman, Mr. Mazoka outwitted them and took total control of the party. The two were completely sidelined with only Dr. Mulwila surviving for sometime as an ineffective Vice President. There was no HH anywhere in the formation of the UPND. He is just an opportunistic usurper.
I am enjoying the comments about Tongas , tribalism and UPND. But have a closer look at what Moscow(OP) and Luapula Fish are putting across defending Bemba speaking people. The truth is there is poverty in Northern, Muchinga, Luapula, and Western provinces. The reason being the few educated and rich coming from these provinces do not want to invest back in their land but wants to use govt resources.

Know one suggested that the formation of UNDP was HH’s idea. However he played a huge role in providing resources and strategy in making UPND the party it is today. To those claiming that Edgar did not embezzle funds belonging to a client, just because his license was reinstated does not mean he was exonerated. When holding funds in escrow you should not co mingle funds and you certainly don’t pay yourself just because a client owes you for services. Once again that is stealing. Lastly it is very evident that the lifting of his suspension was due to political pressure and that’s why it tookso long. Call a spade a spade. whether in PF colors or not guilt is guilt.
