Supreme Court nullifies the Seat of Lubansenshi Independent MP Patrick Mucheleka

The Supreme Court has nullified the election of Patrick Mucheleka as Lubansenshi Independent Member of Parliament.

Supreme Court Judge Albert Wood delivered the judgment Lusaka on Friday.

This follows the appeal made by Lazarus Chota who contested the Lubansenshi parliamentary seat in 2011 on the PF ticket.

The High Court had upheld Mr. Mucheleka’s victory in the Parliamentary election.

Meanwhile PF Deputy Secretary General Mumbi Phiri has welcomed the decision by the Supreme Court to nullify the Lubansenshi Parliamentary seat which was held by Patrick Mucheleka.

Ms. Phiri says the PF respects the independence of the judiciary adding that the case has taken four years to conclude.

She says her party is ready to go into Lubansenshi for a Parliamentary by election.

And Movement for Multi-Party Democracy- MMD National Youth Secretary Bowman Lusambo says the former ruling party is happy with the decision by the Courts of law because those aspiring to public offices must have a clean record.

But United Party for National Development -UPND Deputy Spokesperson Cornelius Mweetwa says by- elections are a drain on national resources.

    • Any reasons why the seat was nullified LT? Mucheleka must be a Don to out bribe MMD in power at the time and PF with GBM’ money.

    • I thought the UPND were a rich party and their hierarchy can afford even to start sponsoring football teams or something to benefit the real poor…

      Can HH and GBM help us (Zambia) fund these 3 by- elections and the referendum for the new constitution too, please!!

    • Mr Soko, you can also ask Great Kalu to contribute from the money he got through FIFA bribes. Blatter and his Don friends are a million times richer than HH and GBM. By the way its FAZ responsiblity to look after the welfare of zambia football.

    • International lawyers representing the Barotseland National Freedom Alliance (BNFA) have written to President Lungu challenging him to sign the Permanent Court of Arbitration (PCA) documents to allow for a peaceful resolution of the Barotseland impasse.

      The Paris and New York based Dugue & Kirtley law firm had written to President Lungu on 26th January 2015 to amend and sign the PCA documents that late President Sata had refused to sign but President Lungu has been mute.

      The lawyers have indicated in the letter to President Lungu that should Zambia’s position to deny Barotseland statehood be supported by law a legally binding and final decision by a neutral and independent tribunal must establish it.

  2. Patrick Mucheleka was corrupt. At the time of the election, he used funds from an NGO he was running called CSPR (Civil Society for Poverty Reduction) to bribe citizens who were heavily reliant on aid. Go to hell Mucheleka

    • hahahahahahahahaha! this is commedy! This has nothing to do with the bribes of whatsoever but due to Mucheleka’s consistance in opposing PF and always with UPND. This evil party at the helm of this country will put his nation on fire any day because what is evidant is that our Judicial systems are rotern beyond what scrupulous people can tolerate. Zambians overlooking of issues should not be pushed to the limmites because anything can happen.

  3. Where is the judgement and were did the high fail in making the judgement earlier? It is not true that Mucheleka is corrupt and bribed anyone. On the other hand it is just sad that such cases take so long time to be adjudicated in Zambia. I would not be surprised if Mucheleka appeals and remains the area MP for the remaining time before we reach another judgement.

    • Appeal to which court? The supreme court happens to be the last court of appeal, I believe! Perhaps you could have researched a little more, sir? May be he should appeal to H.E. ECL?

  4. Awe elyo lwanya. I personally supported Pf, but am totally against the ideas of buy elections. Zambia should first of all sort out the load shedding which is currently killing our economy at a speedy rate than going for buy elections which will just drain on our meagre resources. Govt should concentrate on improving the falling kwancha and not ifima buy elections

    • That’s the price you pay for democracy. People will continue to petition election results and no one can stop them. If you don’t corrupt voters you have nothing to worry about.

  5. Mucheleka should ask himself how much contributions he has made to solve problems this country and people of lubansenshi are facing. When an opportunity is given to save this country lets do it because we don’t know what tomorrow holds. How many things has mucheleka failed to do which he said he would do? How will Zambians remember you? You are now another wasted person who used our resources chasing winds. Lets talk less and do more sacrifice for the poor.

Lusaka people am today in Kasama and when i arrived around 16:30hrs we were greeted by celebrating PF cadres!!they were matching along Kasama roads,hey GBM is in trouble!!there is no UPND here and you UPND dreamers must stop giving yourselves fake hopes!!HH AND GBM WILL BE BEATEN PAINTS DOWN HERE AND PEOPLE ARE READY TO EMBARRASS GBM.AS FOR PATRICK MUCHELEKA,ITS OVER FOR HIM TOO!!

  10. This is what I mean when I say this constitution is not worth the paper it is written on.
    So Patrick has been picking up parliamentary stipends “fraudulently”. Is he going to be asked to pay back?
    There should be a transitional period between an election & taking up of office. In this period, a constitutional court should deal with all electoral issues.
    It doesn’t make sense for a seat to be nullified for malpractices after four years.

  11. IT IS SAD THAT PEOPLE SERVING IN OUR INSTITUTIONS LACK PATRIOTISM. HOW CAN ANY SENSIBLE JUDGE THINK OF CAUSING A BY-ELECTION AT THIS TIME WHEN THE COUNTRY IS PASSING THROUGH A VERY DIFFICULT TIME: ECONOMICALLY, SOCIALLY AND POLITICALLY. ALSO GIVEN THAT THERE IS SO LITTLE TIME LEFT BEFORE THE DISSOLUTION OF PARLIAMENT, IT WOULD HAVE BEEN SENSIBLE TO AVOID THE BY-ELECTION TO SERVE SOME MONEY FOR VITAL SERVICES. I FIND THE ACTION BY THE SO CALLED SUPREME COURT TO BE HIGHLY UNREASONABLE, SENSELESS AND IRRESPONSIBLE. WHY THE HELL DID THEY HAVE TO WAIT FOR SO LONG TO MAKE THE COMPROMISED JUDGEMENT TOWARDS THE END OF THE PARLAMENTARY LIFE?

  13. @eddy, so the PF cadres were celebrating in Kasama, are they the only voters there? If you saw pictures on ZWD, cadres for UPND were also celebrating last week. The point is: Do not look at what cadres are doing, results will be known after the voting in the by-election. From your tone, it is like you really are in awe of PF cadres!

    I am afraid Eddy is right. I was also in Kasama recently. There is virtually no UPND presence in Kasama. Just wait for the by-election and you will see this for yourself.

  16. @Saimbwende: yes we shall wait for results but do not give yourselves any hope as there is almost no UPND here.people were telling us that its you in Lusaka who know GBM and UPND and not us here!!PF has done almost all township roads in Kasama.i was shocked seeing how roads are tarred here.People here are still very happy with PF!they even told me that when GBM was on radio mano he said that i’ll stand in Lusaka in 2016 after losing here and he said this after receiving a lot of negative calls from callers who’re against his move!!AM TOLD EVEN FELIX MUTATI WOULD LOSE HIS SEAT TO A PF CANDIDATE IN 2016 AS FOR PATRICK MUCHELEKA,ITS GAME OVER TOO!!SO LUSAKA POLITICS WONT TAKE HH INTO STATE HOUSE GUYS!!

    • Eddy, are you implying that people from Lusaka voted GBM into office in 2011? Time for serious reckoning is up. Reality will open your eyes, but it might be too late by then!

  17. There must be a time frame in which election results petitions should be dealt with. Mucheleka despite losing the seat has already gained much more than the petitioner i.e. mid-term gratuity.

    PF will go down in the history of Zambian politics as the party that lodged more petitions than any other and causing more by elections in their first term in government. Anyway we know the sole purpose was to get more numbers in parliament to pass laws favorable to PF including probably reverting back to one party politics.

      Country men and women we are headed for a big shock very soon, pf want to stay in power for as long as possible. The numbers they are cooking in parley will be used to pass laws that will make zed a one party state, extend a term to 7 or 10 yrs, or anything as they please. Zambia is a sorry side!!!! Tongas and Bembas are very funny if lungu went to south many people will attend his meeting come elections only a handful will vote for him.if HH went to the North millions will attend but come elections only a small fraction. Lastly UPND where are you getting signs of wind of change? To me things are not as good for HH and UPND as they were in the last election

  22. Ba Mucheleka, you want to be a hero by just talking! The people of Lubanseshi were cheated by the NGOS money and no one has ever seen you there since 2011!

    Mucheleka, GBM, HH, Maureen, Mutati, Nawakwi and Mulongolti are all politically gone and no one will remember them in our history. EDGAR Chagwa LUNGU will go in our history books as the Person who defeated the so called Giants namely the cartel, the wealthy and the opposition in less than 30 days of his campaign to Presidency.
    As if not enough, he developed ZAMBIA beyond anyone’s expectations especially those that he defeated.
    Because of his sharpness and steadfast leadership, the people of ZAMBIA voted for him resounding for two (2) solid terms in office just like the Americans did to Obama!

  23. REPEAL ARTICLE 79 OF UPND MANIFESTO; We need another leader

    Article 79 of the UPND manifesto reads:

    “A party president shall be eligible for election for an indefinite period subject to the constitution, provided that a party president who is elected Republican president shall only serve two terms that shall run concurrently with the term of office as president.”

    I urge UPND Spokesperson, Garry Nkombo, MP, Douglous Syakalima MP, and other eminent leaders in our Party to look at the above close carefully. It should be repealed and thereby made redundant to enable us afford others a chance to lead the party. Losing 4 times is not a joke. I might be taken for a prophet of doom but prevention is better than cure. We still have time.

  24. Mucheleka applied to stand on the P.F ticket in 2011 but was not adopted he decided to stand as an independent area MP. So what corruption are you talking about here. People trusted him not your chota.

  25. Bamususule nsuka mambala. Too much talking for Mucheleka has cost his parliamentary seat! People of Lubansenshi have regretted having elected an independent parliamentarian who does not have a fixed aboard!
