MISA Zambia Chairperson Hellen Mwale speaks to Journalists after she toured the closed Post Newspapers

The Media Institute of Southern Africa (MISA) Zambia has demanded the immediate and unconditional release of M’membe, wife and Post Editor Joseph Mwenda.

In a statement released to the media and signed by MISA Zambia President Helen Mwale, MISA said the arrest of the POST Newspaper Staff, despite being in possession of a court order, proves that the Newspaper is being Politically victimised and called on President Lungu to immediately rise to the occasion and intervene in the matter if he really believes in the freedom of the press and democracy.

Below is the full Statement

PRESS STATEMENT
For Immediate Release
28th June, 2016.

MISA Demands Immediate, unconditional Release of M’membe, wife and Post Editor Joseph Mwenda

We are alarmed by the arrest of Post Newspaper Editor-in-Chief, Fred M’membe, his wife Mutinta and Post Deputy Managing Editor, Joseph Mwenda for attempting to access their office premises following an ex-parte order staying execution of the Zambia Revenue Authority’s warrant of distress issued on June 21st, 2016.

The arrest of M’membe and his Deputy Managing Editor, who had an ex-parte order is proof that the action by the state is politically motivated and only aimed at crippling the newspaper.

It is saddening that the Police who are charged with the duty of upholding law and order decided to defy a legitimate order of the court.

State institutions, including the Zambia Police and Zambia Revenue Authority must not allow themselves to be used to achieve petty political aims but must act in a fair and reasonable manner which is above board.

It is clear that the matter is worsening by the day because of the refusal by the ZRA and other institutions to treat the Post Newspaper fairly like they would any other tax payer or media house in Zambia.

We demand that the paper be treated in a non-discriminatory manner in the interest of a media house’s freedom and continued duty to provide a platform for open debate and exchange of ideas, even those deemed to be critical and dissenting.

We strongly appeal to His Excellency, President Edgar Chagwa Lungu, to immediately rise to the occasion and intervene in the matter if he really believes in the freedom of the press and democracy.

We say so because President Lungu stated at his press briefing on May 13th, 2016 that he would ensure media operate independently and without any interference or censorship from the state.

It is our belief that if President Lungu really meant this statement, the situation with the Post would have been amicably settled by now.

We call on the Inspector General of Police, Kakoma Kanganja and the Police command to immediately and unconditionally release Fred M’membe, his wife Mutinta and the Post Deputy Managing Editor, Joseph Mwenda.

It is saddening to note that in a country that boasts about being democrat, law enforcement agencies are being used to break the law and disobey court orders.

The attempts to muzzle the Press in Zambia using force will not succeed as this has already reflected badly on the current leadership with their character currently under question internationally.

Political leaders must know that this decision to close the Post Newspaper, in addition to political violence, restriction of fundamental freedoms of association, expression and movement undermines the holding of a free, fair and peaceful election.

Hellen Mwale,
MISA Zambia Chairperson

    • Power is really sweet. I now believe Chiluba, especially if you have recently acquired over K20million within a short time without paying tax on it. ZRA stuff say there’s no evidence of any tax having been paid by Edgar Lungu after having made all that money. They say he can even be charged for money laundering. Unless he inherited the money from one of his uncles in Dubai. Even then he has to pay tax it seems. Then telling off the west is was made a lot of African dictators to be taken to the Hague. The west has a 1000 ways to bampula power away from African leaders who disrespect them.

Lungu is cerebrates when he hurts others then rushes to church to hide his evil plans. • MISA, if you are going to release a statement demanding the release of one of your own journalists, at least do it bravely. You know deep down that it’s Lungu who is instructing his state machinery to victimise Fred Mmembe. Just call it like it is.

I would like to believe that all this is the work of RB, doing payback to Mmembe. Lungu a coward who is too weak and scared to pull out a move this big. He is receiving instructions from Rupiah Banda.

RB knows he lost the elections because of Mmembe exposing the results before they were manipulated. They want to take him out of the equation.

And you can see them trying things and ‘testing the waters’ to gauge the reaction of the local and international support. Unfortunately for Mmembe he has lost much of the support and the…

Unfortunately for Mmembe he has lost much of the support and the influence he used to command after his DBZ and partisan support for PF and Sata. Thus without any pressure on the government from sympathisers. I’m afraid that this may end badly on him.

We should all stand up and give solidarity to Mr Mmembe. This man despite all his weaknesses is actually the ‘devil’ the country needs. He provides good balance of power between the government news media and his Post Newspaper. I say Release Mmembe right now!

    • We are the only country on earth where everyone is issuing ultimatums on each other. Misplaced or not, i wonder if we ever know that when they turn stale with zero results, they leave irreparable damage on the issuer. Today we’re 3 days shy from the expiry of Hichilema’s reckless ultimatum that he will paralyze the whole country in 10 days time. Maybe he meant his campaigns. But failure to follow through leaves him a hollow hoax motormouth.

  1. UPND will get the benefit of M’membe’s arrest. Women and villagers will have sympathy for Mutinta and that will work against PF and especially President Lungu. PF lacks strategic thinking! 2016 is lost.

    • Post’s influence in elections is long gone. What it is now is that those that don’t want PF like the Post and the opposite can be said. Its not like because of Mmembe’s arrest someone somewhere who was not decided of whom to vote for will decide now not to vote for PF. As i said, long gone.!

  2. MISA, you should know that as a country we boost of democracy because we are a country of laws. Mmembe is not above that law and when he breaks it he should face it. What he is trying to do is buy sympathy from citizens and a few like you are falling for it. Help him pay and this will be over soonest otherwise he and his employees must observe the closure mandated by the highest court of the land. That ex parte order said the Post must surrender assets worth the debt, the question is did they…at 01??????

LEST YOU DON’T READ HISTORY, YOU ARE REMINDED OF THE FATE OF THE FOLLOWING MIGHTY DICTATORS: MOBUTU, MOHAMMAD GHADAFFI OF LIBYA, MUBARAK OF EGYPT, SADDAM HUSSEIN AND IDI OF UGANDA. 3. Mwale, what court order are you talking about? The order from the SUPREME COURT OR THE
order from the tax tribunal court. The supreme court order was issued last week and ZRA acted on
this order. The supreme court is the highest court in the land. Can a lower court overturn the
decision of the supreme court? You guys, stop this nonsense. If you want to help, mobilise
donors and raise the money wanted by ZRA. We average Zambians are tired of this pettiness
where some people and their businesses are more equal than others,
The days of reckoning for the post are here. Tax evasion during Mwanawasa and Sata’s reign are
over. Please get this into your thick skulls. Just tell your membe to pay up.

    • I can’t agree more. Post isn’t more equal than others and as such they must pay taxes. If you sympathize with them, help them pay. In case you have not noticed, ZRA is not backing down.

    • Indeed why is PF scared of the post? Reaching this extent is inhuman. Why would Lungu command for the arrest of Mmembe and his wife? Is that not desperation at its highiest order? NGOs where are you? Human rights bodies where are you?

  4. Surely PF is in trouble. Why are they so scared of this paper. They should just sontapo and people will choose to believe or not believe them. I did say that what Mmembe is doing is a trap for these guys. He is ahead of them and knew that they are desperate, they will act desperately and their scheme will come to light. For sure their scheme has come to light. Since they are so keen to close down the paper, they have been exposed when they refused to obey the court order. Freddy warned you that when things get tough him and his small team can multiply 4 times. Come rain come sunshine The Post will not close and the paper will be there to cover the election events. I will encourage them to increase the price to K20.00 as this is the only way we can support them.

  5. Mmembe called his perceived enemies thieves, fools, incompetent and all sorts of names while himself was not paying correct taxes and paid only when and what he desired, is that what it means to be a democrat as he claims? Chiwamila galu.

MISA, you dont break laws of land in the name of press freedom. That is encouraging anarchy. Let not this word PRESS FREEDOM get into your heads and cloud your thinking. Why hasnt the POST honoured its obligations since as far back as 2009? It means Mmembe thinks he is law unto himself but now it is time for reckoning.

How can a person demand for UNCONDITIONAL release of a criminal? do we really understand the term “unconditional”. why do people think so low at most times. Joseph Mwenda paraded a schedule of payments to ZRA vehemently claiming they have paid their dues. WHAT IS THIS TRADE OFF OF VEHICLES AND TRUCKS??? Can we have a press statement on this? The issue at hand is s straight forward matter, and I see no reason why there all this drama taking place. If it was a comman man stealing a comb of maize or a chicken, all this noise was not going to be there apart from saying the commom man faces the law, but now that it has happened on someone who considers to be above the law, the learnt want to talk loudest condemning the law that a common man would have been subjected to. Those getting very little are subjected to pay tax, why should others be allowed not to pay? Don’t forget that we are equal in the face of the Lord. Let the tax invader payand life continues.

  24. FRED MMEMBE ATTEMPTS TO TAKE OVER THE POST AGAIN, ARRESTED.

Armed with a dubious revenue tribunal order, Editor-in- Chief and owner of The Post, Fred Mmembe went to the paper’s premises in the night and attempted to take over and begin operations.

The Supreme Court has ruled that The Post owes over K53m in tax obligation and penalties.

The Supreme Court also allowed the Zambia Revenue Authority to issue a demand notice and recover the money.

ZRA has since seized the assets of the paper relying upon the Judgement of the final court in Zambia – The Supreme Court.

But on Monday, Fred Mmembe through his lawyer, Mutembo Nchito obtained a yet-to-be-explained ex-parte order from the Revenue Tribunal.

The Order stipulated among other things that ZRA should return the assets and…

  25. The arrest of these three in contravention of the Court Order confirms that the closure of the Post is politically motivated. We said it b4 that this Is not a tax collection issue but a political strategy by Lungu thru ZRA &ZRP to muzzle and silence the Post. To Lungu the closure of the Post is priority number 1 to conceal his election rigging plans. Lets all unite to block these plans and get rid of this thief and thug of a President. They went their on the basis of the order. If some of you as you express your ignorance that the court order came from the lower court then you have to challenge it through the same court processes and not by disobeying it. But Lungu will dance serious pelete one day. ZRA employees be careful with this slippery Lungu. Already he is running away from his responsibility when faced with questions by saying that it is not him but ECZ for registering Malawians or it is ZRA for closing the Post.
