LOSING United Party for National Development candidate Sylvia Masebo says she could not verify the total number of votes she got in the August 11 2016 parliamentary election because of the absence of the Gen 12 forms at most polling stations in Chongwe Constituency.
This was in the continued hearing of her petition against the winning Patriotic Front (PF) Member of Parliament Japhen Mwakalombe on accusations of electoral malpractices in the last general elections.
Ms Masebo said the August 11 elections were not transparent, free and fair as there was a lot of irregularities beginning with the intimidation of her supporters as well as the absence of the Gen 12 forms, documents which were supposed to be used for recording final results at all the polling stations in the area. She told the court that most polling stations in the Constituency had no Gen 12 forms which documents should be used for the official records of total votes at a particular polling station.
Ms Masebo explained that most of her agents did not assent to the elections results at the various polling stations where there were no Gen 12 forms to endorse the results as being genuine.
“My agent had called me from one of the polling stations near the Airport to inform me that there was no Gen 12 form. I received a series of phone calls from other polling stations that they had no Gen 12 forms.
“I even called ECZ director Priscilla Isaac who promised me that she would deliver the document but that problem was not sorted out,” she said. She explained that as a result, even at the end of the voting process, she was unable to verify the results because she did not have results as recorded on the official ECZ documents.
She further explained that even at the district council, they did not have the official ECZ results to verify the Gen 13 certificate which gave consolidated results from across the constituency.
And Ms Masebo also told the court that at some point, suspected PF cadres had taken over the management of elections at one of the polling stations in the constituency as they ensured some people did not wait in the queue but were pushed forward to vote quickly against her supporters who stayed for long hours.
“My agents felt intimidated when PF cadres who walked into a polling station at Madido and literary took over management of elections at the centre.
“Even the police presence at the centre failed to do anything and they had to call for reinforcement to help the situation,” she said. She accused the police at Madido polling station of tilting against the opposition as their support seemingly leaned towards the ruling party.
And in cross examination, Ms Masebo informed the courts that most of the activities she has alluded to were just reported to her by her agents, who would come before court as witnesses to attest to the happenings.
She has since asked the court to declare the election of Mr Mwakalombe as Chongwe MP null and void, adding that “the illegal practices committed by the 1st Respondent or/and his agents affected the election results and that the same should be nullified”.
Ms Masebo in her petition has cited Mr Mwakalombe, the ECZ and the Attorney General as 1st, 2nd and 3rd Respondents respectively.

Gen12 forms were also missing in nearly all polling stations in southern province. Could it a reason why hh for a lot of votes there.
This is how the elections were rigged in and around Lusaka. Numbers announced by ECZ cannot be agreed to properly signed and witnessed prescribed Gen 12 forms. All Gen 12s that ECZ provided at Mulungushi ICC were fudged and PF then spent days after trying to get them signed after the event. That’s how PF and ECZ rigged the elections in Lusaka and made sure a PVT was impossible as counts were never properly completed or were ignored at polling stations. The truth and facts that were chortled in the Presidential petition are slowly coming out.
Masebo has a very good case.. In a normal country with normal judges and a normal judicial system, this seat can be nullified straight away…
H H & gbm should av presented such evidence, if there was any, or should have consulted Masebo but they failt during the two weeks in concourt. Good luck.
PF made sure the petition could not take off by raising trivial preliminary issues that Annie Mwewa entertained throughout only to come up and say that there was no time to pass judgement.
And UPND was very happy to be entertained with “trivial” preliminary issues at the expense of time. Try 2021 poor chaps, UPND lacks steadfastness.

A priority task is to remove the current ECZ and establish a more independent-based ECZ. I would like political parties, civil society organisations and churches to go through a process that will soon remove the current ECZ and to establish an Independent Electoral Commission of Zambia. It is not enough to be complaining about the inadequacies of ECZ and other so called independent governance institutions such as the Judiciary without taking steps to avoid current arrangements where key staff of these institutions are appointed by the executive of the ruling party!!

This is just a tip of an iceberg. If the Presidential Petetion was heard we would hear horrific stories. That explains why Lungu ,PF and ECZ are blocking the UNDP Petetion In Concourt at all costs. Lungu did not win the election at all that is why he is not prepared to prove in Concourt how he won this election. It will be embarassing for Lungu to hear how ECZ and PF rigged the elections in his favour. What a shame bribing Concourt judges to block the Petetion Hearing. As long as this UPND Petetion remains unheard Lungu will remain an illegal and illegitimate President.
The Presidential petition cannot and will never be heard because the ECZ does not have properly completed, signed and witnessed GEN 12 forms for the whole of Lusaka. All the forms that ECZ have are fake because the GEN 12s do not agree with polling station counts, and were never witnessed by the monitors and party agents, with any signatures being procured after the event or even faked in a huge cover-up scandal. This is the absolute truth that senior PF cadres know and hence the concerted buying off of the KanCourt judges. Lungu knows this very well and that’s why he is so brutal against HH. Lungu wants the truth buried in every way possible.

People are getting too personal, Masebo lost the election in 2011 Yes and 2016 Big yes why because Chongwe is bigger than Mesobo Tembo. Chongwe people are not her people. and that is that bottom line because i say so. Those who few people benefiting from her are the ones cheating her.
this argument is similar to watching football on TV. would it not be a joke if a person in my village argued that Zambia did not loose to Nigeria because the nation did not see the referee’s report. Loosing is witnessed on counting and not on writing. With or without the Gen 12 document, results are stuck to the wall at every polling station and actually declared to the public just after counting. I would not give Gen 12 as an excuse but would rather give the variations in figures. Don’t get surprised if some political party members decide to commit adultery one day just because their bible is torn on that part.
