Lusaka Magistrate David Simusamba has adjourned the treason case hearing involving UPND leader Hakainde Hichilema and five others to Monday, May, 22nd, 2017.
Magistrate Simusamba says he will on Monday make a ruling on the way forward on the matter.
Mr. Hichilema and his five co-accused will remain in police custody.
Meanwhile, PF Southern Province Youth Chairman has said that the acquittal of the UPND leader Mr Hakainde Hichilema on the charge of insulting is proof which echoes the independence of the Zambian judicial system.
In a statement released to the media, Mr Chanda said that UPND struggling to publicly accept the outcome of the magistrate court accusing Magistrate Malumani to be under the instruction of state when he acquitted their incarcerated leader Hichilema who has escaped condemnation for showering insults on the police due to failure by the state witnesses to produce recorded evidence.

“HH INSULTING ACQUITTAL PROOF OF INDEPENDENCE OF THE JUDICIARY” – SOUTHERN PROVINCE PATRIOTIC FRONT YOUTH LEADER SAYS
Today the 15th of July 2017, Hakainde Hichilema was acquitted on the insulting case before Magistrate Simusamba, a development which echoes the independence of the Zambian judicial system.
The self-inflicted arrest of Hakainde Hichilema by the Zambian Police in course of duty to enforce the law has been met with unwarranted accusations on the Presidency. Enemies of progress have been globetrotting painting His Excellency President Edgar Chagwa Lungu black and labelling him as a dictator in their hopeless efforts to gain sympathy.
UPND struggling to publicly accept the outcome of the magistrate court accusing Magistrate Malumani to be under the instruction of state when he acquitted their incarcerated leader Hichilema who has escaped condemnation for showering insults on the police due to failure by the state witnesses to produce recorded evidence.
In its relentless campaign against the judiciary which they claim is under the control of the executive, the UPND leadership is in a dilemma of accepting a judgement favourable to them as that is tantamount to certifying the independence of the judiciary and the outcome of electoral petition
The Patriotic Front believes in the rule of law. Our sworn obligation to protect the constitution also entails that we do not interfere in the operations of the police and in court processes.
As a party, we are happy for our brothers in the UPND who are celebrating the acquittal. This is testimony to Zambia’s free and democratic society. It is our hope that the UPND who are now celebrating will continue to accept respective decisions of the courts on the other cases before the courts of law.
We would like to call upon every well-meaning Zambian to continue to preach and spread peace and love that we have come to enjoy. The democratic structures of the nation remain intact and the nation can rely on the judicial system for fair and just decisions.

How does analysis of court proceedings evidence to arrive at a judgement equate to independence of the judiciary?
A case like this one, even a nursery school going child will not find the accused guilty. Only dogs using instinct and not law can see substance in any such trumped up charge.

Today UPND has celebrated the judgement from Magistrate Malumani and praised the Judiciary,but wait a minute,on Monday Magistrate Simusamba may commit HH’s Treason case to High Court for trial,a move which may keep HH in jail for many months to come.

This is useless. When the DPP issues committal certificate to the high Court, I have never heard in my life where the magistrate will rule on the way forward.
Thousand Zambians are in prison and have been issued with committal certificate to the high Court and the only thing the magistrates does is to read to the accused the explanation of the charges and that the magistrates have no powers only the high Court.
Some have been in remand prison for 9yrs and not convicted, but we have seen HH less than two months and magistrates is ruling on way forward

Magistrate Greenwell Mulumani’s Landmark Judgment has not only dismissed the “Insult” Charge but has trashed the Treason Charge. There is no point in referring the Treason Charge to the High Court becoz the Inquiry has established that HH didn’t commit Treason at all. These Charges are politically motivated and at law are untenable. Lungu should have the courage to drop all the Charges against HH and free him from Jail unconditionally. Clearly Lungu is abusing State Institutions (ZPS and the Courts) to punish his opponents. Let the Petition be heard so that the Zambian Nation can re-unite,reconcile and heal.

That magistrate said and I quote “Mr Mbita arrested Mr Hichilema on all three charges of treason, insulting police officers and disobedience to lawful orders without investigations”. If you take out the other two for clarity, what the magistrate said is clearly contemptuous as he is making a judgement that in the treason case too no investigations were carried out, thus trying to influence or preempt judgement in the treason case. Remember that the insulting case was separated from the treason case at the request of the defence itself in the same magistrate Malumani’ court. The magistrate therefore was ultra vires to refer to a separate…
