UPND Blames The DPP and Judiciary for HH’s lengthy stay in Prision

United Party for National Development (UPND) has accused the Director of Public Prosecutions ( DPP ) and the Judiciary for the lengthy stay that their leader, Hakainde Hichilema has endured in prison.

In a statement made available to the media, Mr Katuka said that despite allegations that allegations that Hakainde Hichilema’s lawyers are to blame for his continued incarceration, the reality of the matter is that in Zambia an accused person (and his lawyers) have little or no say as to when such a person is brought to Court.

THE JUDICARY AND THE DPP SHOULD TAKE PUBLIC INTEREST INTO ACCOUNT IN HH AND 5 OTHERS’ TREASON MATTER-UPND

As UPND we believe that when there is a conflict between public interest and the law, public interest takes precedence.

It has been over 90 days since the imprisonment of the leader of the largest opposition party in Zambia on treason charges that threaten to divide the nation.

Despite a lot having been said by the PF and its leaders, including allegations that Hakainde Hichilema’s lawyers are to blame for his continued incarceration, the reality of the matter is that in Zambia an accused person (and his lawyers) have little or no say as to when such a person is brought to Court.

It is all in the hands of the Director of Public Prosecutions ( DPP ) and the Judiciary.

It has now been over 30 days since HHs committal and yet nothing has been heard from the DPP or indeed from the Judiciary as to when he and other accused persons will be brought to trial to face his accusers.

While it is understood that the DPP and the Judiciary are very busy, it must equally be understood that they have a duty to mother Zambia because justice delayed is justice denied.

A speedy conclusion to this case is a very important step towards healing our divided nation and the onus lies squarely with those two offices to simply do the right thing.

Zambians want to believe that our Judiciary and the DPP are above partisan politics and each of them now has the best opportunity to prove that, not for the sake of HH and his co accused but for mother Zambia and all of us, her citizens and future citizens.

We wait with prayer on our lips.

    But what does the law say? How long can the DPP drag it’s feet before he or she can proceed with the case of this magnitude? If the law is silent then let all be silent.

      I also believe in justice but the first thing that I prefer is not to commit a crime because prevention is always better that cure, all this was very much avoidable remember no how big the opposition can become the sitting government will always be superior to them

      Like it or not the country is at a stand still, Everyone is waiting for the out come of the case, I am sure EL and PF are very happy because their division therapy is working, Everyone seams to have forgot about the country’s problems and just focussed on this case, In a way i can say EL, RB and Kaiza have brains and its working for them, Just look at the NEWS item on LT, 90% of the news is connected to HH, One would think Zambians have no problems and its now a developed country.

      HH insulted Judges, the Police, called the President Clue less Hyena and now the same people he insulted are the ones calling the shots. So the Judges will follow the cause list and HH will only appear next year maybe and the trial will take two year to complete. SO LEARN TO RESPECT GRZ INSTITUTIONS OR YOU SUFFER.

      it’s just so disappointing & hypocritical of how a former ICC (International Criminal Court) judge can become an architect of a DICTATORSHIP by the malawian moslem dictator. Maybe she’s also be malawian. She needs to be be tried & sentenced after the snakes head is cut off.

    Your point is clear,we are all eagerly waiting to hear how the state arrived at the treason charge. Apart from that, the nation is not divided it’s only you guys who want everyone to believe that we are divided. It’s only you and your followers who are preaching division.

    HH has a right to be brought before the courts of law speedily… but UPND has no right asking the intervention of NUMSA, DA and now EFF… Most academics in UPND are actually dull. The dullness that don’t achieve results in real life. I actually think the treason case can easily be thrown out without even a hearing. Just the merits of the case are very shaky. Manje ibuyanga.. if your axe is blunt you have to work harder achieve same results. Whats with the salaula jackets and UPND? Miserable sight. I miss Mazoka One Zambian that would have put us out of UPND misery today

    Hechi Hechi is better placed where he is than outside. This man started his politics well but his first speech was that he would bring sanity into Zambian Politics. May be this man feared those leaders who were there at the time. Even during Mr Sata’s time, somehow he was sober but now, he wants to prove that he is the only cock in this world and insulting leaders and yet forgetting that where your Human Rights ends is where other people’s Human rights start. A leader is always a leader despite his age, body size and how he looks. We should not forget that there is always a future and if you do not give respect to Leaders of today, how will you be given respect when you become a leader tomorrow.     HH HAS BEEN INSULTING JUDGES, THE CHIEF JUSTICE, THE PRESIDENT, THE SPEAKER, THE POLICE. SO THEY TOO WANT TO TREAT HIM “FAIRLY”. IF THERE ARE OTHER CRIMINAL CASES PENDING ON THEIR LISTS, THEY SHALL NOT BE RUSHED INTO PASSING JUDGEMENT EVEN ON THIS ONE. THEY SAY FIRST COME FIRST SERVE. HE IS ON THE WAITING LIST. WHEN THEY ARE DONE WITH OTHER CASES THAT THAT CAME TO THEM EARLIER, THEN THEY WILL COME TO HIS CASE. NO NEED TO RUSH. NOT EVEN THE BURNING OF MARKETS, CUTTING OF ZESCO PYLONS AND CONSULTATIONS WITH NUMSA, DA NOR EFF ETC WILL FORCE OUR JUDICIARY. LET THE LAW TAKE ITS DUE COURSE.     With No Rule of Law and lack of Respect for Court Orders and Rules Dictator and Sadist Lungu is in no hurry to Try HH for Treason in Court. Lungu knows that he has no Evidence to prove that HH committed Treason. Lungu is using Treason as an excuse to keep him in Jail simply becoz Treason is unbailable. Lungu is abusing State Institutions to persecute HH and the 5 accused. Lungu has declared SOE to target HH,UPND and all those opposed to Lungu’s newly found Dictatorship.

    Just be patient, the DPP has so many cases to deal with. HHs case is not priority. When time comes he will be allocated and come to court. The HH case is not a special one. Just chill ……katuka

    I wonder why upnd complain about none vital issues.how long does innocent and poor Zambian detainees stay in jail before the DPP commits them to High Court?very long,some even years.SO WHAT IS VERY SPECIAL ABOUT HH?WHY SHOULD HH JUMP ALL THOSE POOR ZAMBIANS ON A WAITING LIST?Its not fair.
    Please madam DPP take your time and focus more on commiting poor Zambians to high court because they have nobody to push you for them!!if all judges have cases in 2017,then HH’s treason case can be heard in june or july 2018.

    I propose to the DPP to give priority for cases where there is no bail so that people, who are presumed innocent until found guilty, do not serve a ‘sentence’ and then be found innocent. This is not justice. Those who are on bail or bond can at least wait since they are coming from home

    It is amazing that educated people could actually agree to pass laws regarding so called unbailable offences. This contradicts the presumption of innocence, the corner stone of modern law.
    I believe if a person is not a flight risk and would not continue to pose danger to society then bail should be granted with appropriate restrictions and conditions. Failure to comply with these conditions would then result in the accused being held in jail. This law seems to be so backward. Imagine being accused of any of these so called unbailable offences only to be found innocent a year or two later. We need to rethink.

    No Mr Steven Katuka, leave the Judiciary and DPP out of this, the blame rests squarely on your shoulders and the rest of **********. As a seasoned politician you should have advised the poor Under-5 that what he was practising was not politics but incitement to violence. As someone has said above, prevention is better than cure. This should serve as a good lesson to the next UPND leader as this one is in for a long haul. Looking at the long list of people awaiting trial U-5 is probably no. 152 on the Cause List. Add to that trial and adjournments and preliminaries in between, we could see January 2021 as the end of it all. Assuming of course that U-5 can manage all the legal fees, remember that LAZ increased the lawyers fees recently, what a coincidence! But we are enjoying more peace…

    Just a small correction Mr Katuka, the DPP is equally waiting for a date to commence trial…..kikikikikiki. So everything depends on the men and women you and underfive called all sorts of unpalatable names.
    Also the Judges are tied up with underfive’s pending cases. You may have to consider withdrawing some or all of them…..

    There is nothing special about hh, if the court cases are full and the place is fully booked….let him wait beside it’s because of his pride and foolishness, Don’t even blame the courts of law, hh is stupid…pride goes before the fall…The country is so much at peace even in southern province from the time hh was arrested may he remain in prison.

    You are too early to talk about his release because the burning of things which are going on now we have to know who is behind them. I think hh is a suspect so tata relax this will be also a lesson to other dum politicians. We are pray for our president to weaken all enemies of good Zambian people to the last.
