Kabimba’s party to boycott Lusaka Mayoral by-election over validation of Education Certificates

Rainbow party leader Wynter Kabimba says his party deliberately decided not to participate in the July 26th Lusaka Mayoral by-election because he has outstanding issues with the Electoral Commission of Zambia.

Kabimba said in an interview that he was going to sue the Electoral Commission of Zambia for disregarding the 2016 High Court judgement ordering the commission be the institution in charge of validating certificates of aspiring election candidates instead of the Examination Council of Zambia.

“We have an issue with the Electoral Commission of Zambia. Every little political party is glossing over this issue until they get caught up in it in 2021, and that is the issue of validation of certificates. Our position is that there is a high court judgement which was delivered I think in May or June in 2016 and it was in the case of Sibongile Zulu versus the Attorney General and the Electoral Commission of Zambia. And in that case, the judge made it very clear that is not right for candidates to be getting their certificates validated by the Examination Council of Zambia. That job is an administrative job for the Electoral Commission of Zambia” Kabimba said.

Kabimba said that the Examination Council and the Electoral Commission were both stealing from poor citizens.
“In other words, the Examination Council of Zambia is stealing money from Zambian citizens that are standing as candidates, in collaboration with the Electoral Commission of Zambia. And these are poor people that even can’t afford a meal, and you are saying that you are promoting democracy in this country? democracy intells that the poor and the rich must participate in the affairs of their country. In the meantime, you are putting in place rules that have been outlawed by the high court, to discriminate against the poor people,” Kabimba said.

“We have written letters to the Electoral Commission of Zambia to say to them, ‘you didn’t appeal, you were a party to this game, Sibongile Zulu versus the Attorney General, the Electoral Commission of Zambia’, ‘So if you didn’t appeal, you must abide by the judgement.’ They have been dilly-dallying in giving us a clear answer. What we want to do now is [to] take the Electoral Commission of Zambia to court for contempt of Court.

So we are not an opportunistic party. This is not about just participating in an election, it is to ensure that the electoral process in which we are participating does not discriminate against any citizen of this country, poor or rich.”

Kabimba however wondered how the electoral commission was failing to implement its own set rules.

“And this issue was agreed in 2016 and we all agreed, the political parties that are participating agreed that the Electoral Commission of Zambia that the validation of certificates should be done at the Electoral Commission of Zambia and everybody now has glossed over that agreement. And yet the Examination Council of Zambia does not even have the capacity when it comes to presidential and general elections to validate certificates for over 10, 000 candidates, if you look at councillors up to members of parliament. You have more than 10, 000 candidates, [but Examination Council of Zambia ] does not have the capacity. In 2016, people were spending nights at the Examination Council of Zambia getting their certificates validated. So you are putting rules in place when you do not even have the capacity to deal with those rules or to implement those rules. So for us as Rainbow party, we have an issue with the Electoral Commission of Zambia and the Examination Council of Zambia, and we want this issue to be resolved, that is the reason,” said Kabimba

  1. The High Court got it wrong. How does ECZ validate school certificates which they do not issue? Kabimba, cite another reason for not participating in mayoral elections.

    • That part is only existant in his mind, saying that the ACC should not dismiss his allegations and should investigate this.

      What deterrent is there for these people forging the certificates? Jail nothing of that kind.

    • How some people would think that Kabimba or Mmembe would mean what they are saying just grinds my gears. WK and FM wake up each day and think, what am I going to say today to appear relevant? How I feel they should shut up and just watch.

  2. I hear u Mr Kabimba. Take the matter to court. In fact, I see no reason why people should have certificate to participate in politics especially in a democratic country like Zambia.

    In my view, people should be allowed to choose who they want with or without a school certificate.

    People with school certificate robe people and they take unfair advantage because those who are not educated cannot challenge them.

    We should then conclude that if u have no certificate u should not vote either. Let those with certificates vote each other. Because they are the ones who understands voting procedure.

    It’s a contradiction to introduce certificate issues in a democratic voting process.

    • @DJ7, have you taken time to find out how these make it into the constitution? It is the same Kabimbas that used to be in parliament and shot themselves in the foot. Is night school still being offered. I guess it is never too late.

    • You are used to being insulted hoping to be more famous – I will not give you the pleasure!

      Whats irrelevant is your comment – he needs to focus on winning atleast a seat so that he can be that change he wants and not boycotting – it gives upper hand to the same people you keep blaming.

      If he has evidence let him go ahead and sue as he said but boycotting is a wrong move.

    • Mushota is nervous because she/he has forged all her/his so called certificates. In fact her/his so called qualifications are a figment of her/his illusions, hence the vulgarity coming our.

    • Mushota might even be a brother or sister of Mumba Yachi. She/he should be deported to DRC if she/he is found to have forged the certificates and NRC. By the way Mushota is out of date now and gone past her/his best by date. Jay jay, junior and Nostradamus are the ‘new Mushota’.

  4. If senior statesmen like Kabimba can reason like that, then Zambia is still living in stone aged period. This is a simple matter that even a grade one can decide rightly.

  5. All Kabimba is saying is that it’s not up to the aspiring candidate to pursue validation of qualifications on their own but the responsibility of ECZ to do so. In other words, ECZ is the one to take up the matter with education council on behalf of candidates.

Examinations council of zambia and Electrol commission of zambia are two different institutions.Examination certificates are to be validated by examinations council and not ba electrol commission.This is the same as telling a teacher to be in a theatre room to do some operations while a surgeon z available.mr kabimba shud think about something else

  7. @ Amano,, I am sure that if you examine the above comments you will see that Education is very important,, it becomes a fact when it is widely accepted and there is written evidence,, if there was a Court ruling, and something was agreed upon to say that it is the Electoral Commission of Zambia to do the certificate verification,, then that’s our fact,, if you give this task to the Examination Council of Zambia then you’re going against the high Court ruling,, Simple,, No wonder People without any form of Knowledge should not be allowed to vote because they can not distinguish between breaking the Law and keeping the Law

The Examinations Council of Zambia issues the Grade 12 certificates and therefore is the right authority to validate them for authenticity on behalf of any other institution that requires this service, including the Electoral Commission of Zambia. It was obviously an omission on the part of the court, or else the judge must have done a ”Don’t Kubeba” on his own grade 12 certificate for him to pass such a lousy judgment knowing very well that the ECZ does not have the capacity to validate certificates. They can only do this through the Examinations Council. Kabimba is a lawyer and he should know better. Common sense isn’t so common after all. In law, it is completely absent. That is why Kabimba is saying what he is saying to suit his political interests even when he knows what is…

    • u are missing the point,the judgement says applicants certificate should be dropped ku electoral comm ,then electoral comm should fwd those G12 cert to examination council who inturn validate them,its a days work naimwe,

  11. The following parties despite their democratic right to exist must disband immediately because they don’t actually exist. Rainbow,Socialist,peoples party, NDC, Mulongotis, nason, Peter Chanda one man show party, FDD which died with the exit of Antonio Mwanza, MMD which despite having two leaders is in intensive care unit. And all the tuma smaller ones oiled by the ruling party, including NGOs found in financial scandals and are aligning with the ruling party to survive proescutions and consequences, They should all go. Here is one trying to be clever and bringing in silly technical issues because they know they stand no chance in the Lusaka mayoral elections

  14. kabimba is right,unfortunately the so called educated comments lack reason,All those who have lived or live in developed countries know that ,its not the applicant to verify if your education is validated,but it is the duty of the employer.ECZ is the employer on behalf of zambians ,aspiring candidates can file all the application to ecz and ecz will fwd the G12 copies to EC,as a ASAP,its can be done within a day or two.i presume all G12 results are store online.
