Chief appears for plea in defilement case

Chief Kazembe has yesterday appeared in Lundazi Magistrate court for plea charged with defilement of a girl under the age of 16 years contrary to the laws of Zambia.

Appearing before Resident Magistrate Edward Chisanga was Chief Kazembe whose birth names are Vincent Banda who was represented by Kampamba Kombe from Andrew and partners.

Particulars of the offence are that Banda on dates unknown but between October 1st and 31st, 2018 unlawfully had carnal knowledge of a minor under the age of 16 years.

Before plea, magistrate Chisanga took time to explain to the accused how he can defend himself stating that he can only defend himself if the child is 16 years and above, and the accused has since pleaded not guilty to the charge.

Meanwhile, trial continues after the court ordered that the first witness of the four who is a victim aged 14 testifies in chambers before it continues in the open court.

    Would have expected the traditional chiefs to thwart it and sweep it under the carpet.

    • Ba Mfumu sure! If this is true then it’s a sad story. These are the young people you should be protecting now you are devouring? And how many wives do you have? What’s wrong with getting someone of your age?

  2. The LAWS are not for the ordinary only but all of us. Anyway the chief is STILL innocent until when the judge shall strike that small but huge hammer to pronounce the verdict.

  4. Sexual perverts, whether chiefs or any person, should face the wrath of law if found guilty. One cannot hide under the canopy of a profile to commit heinous crimes. Laws should apply to every one if they are broken. It will be extermination of justice if issues of law breakers are swept under the carpet.

  5. This is not a rape case because seemingly there was consent. .The magistrate is already biased . He says ” You can only defend if she is above 16 . FALSE ; you can and should defend if you do not agree with the acusation.
    The victim is referred to as witness 1 ,who is the complainant? Some parent ? Was he there? What method or pressure was used on the victim to extract such information?
    In what circumstances did the two meet? Did the acused know the girls age?
    Did she not decieve him , or misrepresent her age by patronising venues prohibited for underage , eg bars , on any occasion?
    If the accused was unknowingly misled into this demise, then both the complainant and witness are guilty , and must be…
