Jerabos win first round in court over the Black Mountain fight

THE Kitwe High Court has granted a group of Copperbelt small-scale miners, commonly known as Jerabos, an interlocutory injunction restraining Nkana Alloy and Smelting Company and Tianjin Maolin Technology Company from preventing them from accessing the copper slug dumpsite, Black Mountain, in Kitwe.

Kitwe High Court judge Isaac Kamwendo granted the order recently upon hearing arguments from the small-scale miners through their lawyer and after reading an affidavit in support of the application sworn by Albert Kapalaka.

This is in a case in which the small-scale miners, led by Godfrey Kangwa, popularly known as Shimumbi, and Richard Chileshe, popularly known as Chile One, sued the Zambia Consolidated Copper Mines, Nkana Alloy and Smelting Company Limited, Chambeshi Metals Plc and Tianjin Maolin Technology Company Limited as first, second, third and fourth respondents, respectively, over mining interests at the Black Mountain.

Justice Kamwendo ordered the respondents by themselves, their workers or their agents not to interfere in any way with the plaintiff’s interest by themselves or their workers from accessing the Black Mountain.

The court also restrained Nkana Alloy and Tianjin Technology from claiming authority over the mountain and further restrained them from interfering with the plaintiff’s quiet enjoyment of the mountain until final determination of the matter by the court.

  2. THIS IS MISPLACED JUDGEMENT AND WILL ROB THE NATION OF THE MUCH DESIRED REVENUE. YOU CAN NOT GIVE BLACK MOUNTAIN TO JERABOS WHO DO NOT HAVE ANY PROCESSING FACILITIES AND THEY DO NOT EVEN PAY TAX TO THE GOVERNMENT. THE COMPANIES BEING SUED HERE HAVE THE FACILITIES TO PROCESS THIS MATERIAL AND DERIVE THE BENEFIT OF ALL CONTAINED METALS LIKE COPPER AND COBALT – THEY ALSO PAY TAX WHEN EXPORTING THEIR FINAL PRODUCTS.
    JERABOS WILL MINE THIS MATERIAL AND SECRETLY SELL THE SAME TO THE PEOPLE THEY ARE SUING WITHOUT PAYING ANY TAX TO GOVERNMENT. NO SANE JUDGE WOULD RULE IN FAVOUR OF THESE CRIMINALS. I STORNGLY SUSPECT THIS JUDGE IS ON THE PAYROLL OF SHIMUMBI AND CHILE ONE.

    • Research before you comment. ZRA taxes every truck that leaves the black mountain loaded with the black slag. The JERABOS organised a company that owns a fleet of tipper trucks and anyone who was interested in getting proceeds of the black mountain where put in groups and apportioned a day in which they collected receipts per load that was delivered by the trucks without spending a single ngwee. Every expense e.g fuel, hiring of truck e.t.c was deducted from money obtained from every load delivered, in other words it was free money for everyone who was registered. Such a simple model if adopted on a large scale will help eliminate poverty in Zambia.

    • Ba C-Gen naimwe…yaba…this is not final.. until the court makes final judgement there should be changes to existing arrangement.

    • THERE IS NO LOSS OF REVENUE TO THE COUNTRY FROM THESE SO CALLED INVESTORS AS IT GOES INTO THE POCKETS OF A SELECT FEW. GOOD FOR THE JERABOS IT IS TIME ZAMBIANS BENEFITTED SOMETHING ALSO FROM OUR COUNTRY.

  3. Hear names being mentioned who sprang from KMB as late rogue Willie Nsanda, thief Kambwili, Kampyongo, Kadobi etc. Next through lawless mobs will take over Kitwe council and Chinese companies and Lungu is a lame duck watching.

  4. Godfrey Kangwa (Shimumbi) and Richard Chileshe (Chile one), unfortunately they just had to be Bembas.

    • The very same Bembas whose votes HH so desperately wanted that he made the fat, corrupt violent thug GBM his running mate!
