Former Roan Member of Parliament Chishimba Kambwili still remains prohibited from defaming Lusaka Businessman Valden Findlay who he accused of being a drug dealer.
Mr. Kambwili has also been condemned to pay costs to Mr. Findlay.
High Court Judge Elita Mwikisa said this when she confirmed the order of injunction that if freedom of speech is left unrestricted it can damage people’s liberties in a democratic state.
Judge Mwikisa further said if Mr. Kambwili is not restricted Mr. Findlay may suffer irreparable injuries.
She said Mr. Findlay has shown that Mr. Kambwili’s defense of fair comment has failed because he has not provided reasonable evidence to that effect.
Mr. Findlay has in this matter sued Mr. Kambwili for accusing him of dealing in drugs using the Presidential jet.
He is also seeking damages for libel and slander among others.
But, Mr. Kambwili has argued that words complained of can be justified because they fall under fair comment.
But we hear Findlay and his Boss influenced the decision to legalize cultivation of marijuana.

Many people will end up being in trouble for cateless talk without any tangible evidence. People should stay away from careless talk against innocent citizens. So ba Kambwili will pay a lot of unnecessary costs and damages.
The problem we have is Zambia is that the level of trust in all our institutions has gone down such that even if a judgement had to be pronounced people will still not fully see it as fair due to the credibility of our institutions PF has actually destroyed everything even arrests at the police are targeted, what kind of country are we living in, imagine even medical evacuations are political.
Nothing has changed about our institutions. The courts are intact and will improve further. The problem is they are being abused by id!ots like Kambwili and upnd. How does one just wake up and come up with wild accusations without evidence?? Just to excite those who hate Edgar Lungu?? Well, in life, actions have concequences. This is all a sham! Findley could not have been found guilty of drug trafficking using the presidential jet because it would have exposed a lot of secrets! Hence the not guilty verdict against Kambwili by that Kangaroo court!
Kambwili is just a rabid buffoon, however, the things we hear about the Presidential Jet are worrying and unprecedented. This is the Presidential Jet that has been flown by an entire Commander, it’s the only one junior officers have complained about taking off to unknown destinations without the President. It is common knowledge that Findlay was called a drug dealer during mandrax days, and having him always on the presidential jet does raise a lot of questions that people must ask

I was almost hastily Condemning such a ruling by saying that the Judicial System has been completely captured but then,in retrospect, I kept my head on and figured, wait a minute! Is it not only fair that when someone says things like that they go further to provide irrefutable evidence as proof to back up their claims of Drug dealing and the eventual mode of conveyance of the said Drugs? If you were the one who was equally accused of this Crime of Drug Trafficking, would you not ask for evidence to support the accusation? If you were the presiding High Court Judge in this matter, what ,in all honesty,would your Ruling be in the absence of a convincing enough evidentiary deposition as opposed to mere speculation from the accuser? Does not dragging the Presidential Jet into the accusation…

The only issue is that CK made the statement as a matter of fact, without backing it (in other jurisdictions he may possibly even have gotten away with it by arguing that it was fair comment)
