United Party for National Development, UPND, leader, Hakainde Hichilema, has said that there is nothing new in the way government handled the Chiluba case despite the London Judgment finding the former President liable of stealing $46 million from the Zambian people.

In an interview with QFM, Mr. Hichilema said it was clear from the time President Rupiah Banda assumed office that his government was not going to fight corruption in the country.

He said there was therefore no need for Zambians to be shocked or to cry foul because it was foreseen before that the Rupiah Banda led administration was coming with the intent of not being serious in the fight against corruption.

Mr Hichilema said it is sad that President Rupiah Banda’s government has taken the Chiluba regime system where corruption became so rampart to an extent of retarding the country’s development.

He said while it is a good thing for the government to defend Dr. Chiluba, it is painful to the majority Zambians to see criminals left scotfree despite the crimes they have committed.

  2. But then my question to HH is why then did you jump into bed with a person who wanted Chiluba to carry on stealing according to you for another term? Also, if a judgement is passed that you personally do not like does it always mean that there has been foul play?

Threfore, in light of”Mr [UPND president H.] Hichilema said it is sad that President Rupiah Banda’s government has taken the Chiluba regime system where corruption became so rampart to an extent of retarding the country’s development,” and that PF has an FJT Chiluba regime governing behaviour, it will be interesting to justify why the mighty UPND Group should continue being in a PACT with PF since the best thing for the UPND to do now rather than later is just to stop referring to the PF-UPND PACT without ditching PF but to just concentrate on campaigning with a message of UPND-Zambians’ PACT to form GRZ Administration in 2011.

    I hope PF will take my message above serious and reconsider its being in the PF-UPND PACT when it can ditch the UPND.

By the way, PF is on record of promising to throw away Mr FJT Chiluba cases in 2006 elections time as evidenced in “Chief Chisunka said he was surprised why Mr Sata changed his stance after he promised to drop charges against Dr Chiluba when he supported him in 2006 elections… “What has changed now that Dr Chiluba is called names, is it because he is supporting his political opponents. Mr Sata should be fair,” Chief Chisunka said,” as reported under Sata can’t be trusted — Chief Chisunkain the Times of Zambia Newspaper of today.

    Mr PF/Sata MC also extended his corruption cases recklessness by campaigning in Luapula Province of Zambia and other areas that the Fight Against Corruption was on Bemba speakers and he would stop it once President.

We removed KK and blamed for him for 10 years,The our late President used the law to unmask the crimes committed during FJT’s term,close to 8 years and then came President Banda on the scene, it would appear the agenda is to bury all the crimes and ”start” afresh ,it has been close to 3 years now and no results!

  12. This is the one problem I have with this political midget. Dr Chiluba was tried and prosecuted by the Task Force and acquited of the criminal charge of theft. He is not a criminal at law. In the London High Court, he was convicted of defrauding the GRZ. That is not a criminal conviction but a civil conviction. Mr Mpombo is a convicted criminal. Even in the UK, under the Theft Act 1968, section 15, Lambie (1982) was convicted for purchasing goods from Mothercare on a Barclaycard credit card knowing she was way beyond her credit limit. This is the same as signing a cheque against insufficient funds. It is deception. So please do not belittle Mpombo’s offence.

  14. There seems to be a lot of ignorance about the source of HH’s wealth. Having been a senior partner at Coopers and subsequently Grant Thornton, plus his numerous business interests, it was inevitable that HH be a billionaire. Zambia has a number of people in his position who have become wealthy legitimately.

    In relation to his comments above, he is spot on. RB is trapped in a time warp and his behaving with umpunity is to a large extent due to ignorance of the ramifications of his actions on himself and his family once he is out of office.

  15. no.17. Of the three leading presidential contenders who stinks of tribalism? RB and Sata have a worse tribal stain if that is the game you want to play. Sata was Chiluba’s right hand man when they made all key govt appointments to be held by bembas. He has made numerous tribal remarks that have offended many people including calling ilas dogs, calling luvales namazai and claiming to cleanse all bembas of the thieving tag. RB is well documented for appointing only easterners in key positions in Namboard. KK fired him for appointing easterners only in the Foreign service and even in the current govt most key positions are held by easterners. He recently advised Easterners to chase all those who don’t come from there. If you love Zambia it’s better you avoid playing the tribal card!

  16. If a person who vies to be head of State cannot abide by the judicial decisions, we are going to go backwards in our democracy, where the separation of powers will again be fudged. President Banda is not interfering with the judiciary. If judges are making dubious decisions, why don’t people take up the published judgements and deal with each and every point raised at law? If it was a matter of leniency or severity of a sentence upon conviction, all thge noise made can be understood, but the judge has found no reason AT law to convict. Please point out where in the judgement is there a mistake!

  18. no.22: no matter how much you shout or propound legal jargon no one is going to believe what you are saying. We all no that corrupt African leaders have a habit of interfering with the judiciary. They are known to corrupt some weak judges and blocking appeal cases since they know that senior judges at the supreme courts are not easy to bribe. This is exactly the case with the Chiluba issue otherwise the govt would have appealed. Whoever you are, you can’t to be more knowledgeable at law than the experienced legal minds like professors Ndulo & Hansugule and LAZ who have questioned this judgment.

    Appointing Easterners is not tribalism but you could call it Provincialism. But most people think a person is an easterner because of an Eastern sounding name. Prof Chirwa is a Mufulira, Copperbelt man. The prominent Kitwe Lawyers and State Counsels Nyirenda and Banda have never been to Eastern Province, being born and bred in Kitwe and Mufulira respectively. Besides all this, there have been so many cross cultural marriages in Zambia that this tribalism charge should now be dismissed with contempt. One of the President’s son is half Lozi, quarter Chewa, quarter Ngoni. What tribe is he? HH is not a tribalist, but he came to the helm of his party because of tribal support. He used it to his advantage against Sikota.

  20. Comment 5 HH has not personalised the issue of Chiluba as you have wrongly observed. Its in public interest that the London Judgement be registered and all monies stolen be recovered and used by the Zambian people. We currently have a problem where the Government is seen to mean Rupiah and the MMD as opposed to the people-the common man and woman on the streets. Just walk into a public area and ask anyone their opinion on this judgement. You will be surprised what derogatory remarks even illiterate people use for Rupiah. You are entitled to your views.

    Ther is no one who is a master at interpreting law. Otherwise, the persons you have cited would never lose a case. Thes are academics and perhaps limited in other aspects of law. Human rights law is not criminal law. Criminal law is not Tort law and so on. The LAZ did not criticise the judgement, but suggested that in the interest of advancement of ‘case law’ this should have been appealed to the highest court of the land so that the issues raised may be settled with a more secure precedence. Even if the Supreme Court had registered the judgement, it would not have made Chiluba a thief.

  22. Comments 7,10 and 15 there is nothing wrong with someone taking advantage of situations to make money. HH is one such citizen who saw an opportunity to make money through Chiluba’s own policies. Recall sometime last year, Chiluba made a statement to the effect that HH was paid $12miilion. From that time on nothing. And yet state arms are free to investigae and bring out such thefts. Your claims are lame just as Chiluba’s was. You could be big men with small brians. Question is, ten years from now, who are you going to blame for the privatisation of ZAMTEL? Is it a ZDA officer who has taken an opportunity to do business with the retrenched officers’ benefits or Rupiah and Situmbeko who had the authority to stop the sale but refused.

Sata also used tribal support to win the support of bembas by promising he would champion their cause. The UPND convention in 2006 was attended by equal number of delegate from all 9 provinces of Zambia and the majority voted for HH. How then did HH use tribal support to get to the helm of UPND if delegates from all provinces voted? Sikota was the acting president at the time so he was in charge of the electoral process and could have stopped such malpractices if they happened.   24. In saying all this, am in no way defending HH. Am just trying to be objective. And for all you who are on the issue of tribe, the truth is that all Zambians are trible. Actually all Africans. Even people who in public profess to be anti tribal, in dark corners they are the worst tribalists. My other question is, has a Tonga or Lozi Presidential candidate ever won Bemba speaking provinces of Northen and Luapula? If not, then Bembas vote on tribal lines. Good day bloggers.

    That is exactly my point. The word ‘tribalism’ should be bannished from Zambia. It belongs to the old order of life and surely at this stage in our country we should never bother about the colour of the skin, the language they speak or where they come from, but judge everyone according to ‘the content of their character’ (to borrow from M L King Jr). I once suggested that NR cards should not have ‘Village and Chief’ on them It is so colonial and I am amazed that the man who said ‘One Zambia, One nation’ was the one whose government perpetuated this.

    What most Zambians are unhappy about is why the government is blocking any calls for appeals in FTJ’s cases. The president and his ministers are always quick to celebrate Chiluba’s judgments but always become defensive when challenged to appeal. You don’t have to be a professor in psychology to know that this is an indication of guilty consciousness. RB becomes agitated whenever challenged over the Chiluba issue. There is also some govt complicity in that they have hired a man facing corrupt charges as a political consultant. What message does it send to the masses?

  27. Aren’t there better things to talk about? Is it very difficult to forgive? It is time to forge ahead. Talking about privileged information, RB must be in possession of some information that we do not know hence his decision not to pursue this case to its logical conclusion. People should not forget that FTJ once locked up RB and others on trumped up charges, and could have used this opportunity to settle old scores. Lets start afresh, am sure even HH benefited from FTJ’s presidency. I am sure he did because his firm (Grant Thornton) was one of the least paying public accounting firms in Zambia, people were leaving to join GRZ.

  30. The Saint kudos to you today. We could all learn to be objective, than subjective. Too many fanatics on this blog, for some HH or SATA, are Gods who should be defended at all costs. For me HH owes Zambians an apology for being a beneficiary of a program that cost the livelihood of millions of Zambians. A patriotic person could have walked away like Mwanawasa did, but he stayed like Sata did till the very end of privatisation, milking every cent from the program. Yet today they speak loudest about privatisation, go figure!

    While I do not support any political party! HH needs to divorce himself from the PACT. Even if he cannot take 2011, his is foreseeable future. HH is better off being on his own. He must not worry about M’Membe gunning him down, his time will come. M’Membe is getting finished day after day. The only person that can save M’Membe is (chameleon) SATA. If Sata were to win, he would throw-out all the Zambian Airways cases that have dodged M’Membe and Nchito.

The Creditors wanted to finish M’Membe, but RB stopped them as he was going to be viewed & accused that he was after The Post, from most Zambians and the International community, especially donors. If RB wins 2011, he will let go of the Creditors to grab anything from M’Membe as RB will have nothing to loose.
