Government has said that Former President Rupiah Banda has not been allowed to leave the country , because of the travel embargo placed on him by the government joint investigative wing.
Home Affairs Minister Edgar Lungu said that Mr. Banda was not allowed out of the country for fear of interfering with on-going investigation which have not been taken to court yet.
Mr. Lungu said that the joint Investigative wings fear that Mr. Banda may temper with evidence and witnesses, or sabotage the investigations all together.
He said that government has since given instructions to different investigative wings to be alert and not allow Mr. Banda to go out of the country without clearance.
Mr. Lungu said at a media briefing in Lusaka, that the Government Joint Investigative wings mandate is investigating Mr. Banda and if allowed out of the country he might interfere with witnesses. He said that the travel ban will only be lifted once the investigative team advises.
And Mr. Lungu has said that the Office of the Attorney General was not served with the Thursday’s court order to allow Mr. Banda go out of the country.
Mr Lungu said that there was no way government would allow Mr. Banda go out to the country, without the office of the Attorney General being served with the order.
Mr. Lungu said that government only learnt of the court order through the media.
He said he will hold a meeting with the Attorney General this afternoon, to see whether the notice has been served, and discuss whether Mr. Banda should be allowed to leave the country.

Kamalondo, the Government, in my view is NOT mistreating RB. It is simply prosecuting justice on behalf of the people and taking reasonable precautions to ensure that the accused man will always be readily available to have his day in the court of law. How many innocent people has the Government stopped from going out or about their business? I have not heard of any! And by the way, I am one of the very ordinary people in Zambia and am free to go out of the country and to come back unhindered. (I went to and came back from South Africa a few days ago – LOL!).

The AG was not a party to the proceedings, it was the dpp. Unless this was a civil case, you would have been right but not where the dpp was even present when the judgement was being delivered. Hence the embargo. But this happens everyday. When you release some one on bail for an alleged criminal offense they is always risk that something might go wrong eg intimidation of witnesses etc. If this is the policy then we should stop bailing people out. Remand them in custody until the trial is over. To say that the Attorney General was not informed is just another blatant lie. We have a government full of amateurs who have already that the former president is guilty of his alleged crimes.

It is not must that when you have a passport you can travel. There other wings that give a stamp of authority. The court has its area of authority and they are not at exit and entry points.it becomes worse when your cases are tied to people like James who are in flight .
