UPND MP loses in court, expulsion from the party stands

THE Lusaka High Court has refused to grant expelled Sinazongwe Member of Parliament (MP) Richwell Siamunene an injunction restraining his party from expelling him from the United Party for National Development (UPND) on grounds that his application is misconceived.

In her judgment yesterday, High Court judge Anne Sharpe Phiri said there was nothing to restrain the defendant from because his party had already expelled him at the time he was suing it and had also written to the Speaker of the National Assembly informing him of the party’s decision to expel him.

This is in a matter in which Mr Siamunene had sued the party’s Secretary General Winston Chibwe and sought an injunction to restrain the party from going ahead to communicate to the Speaker over his expulsion.

“As such I find that this application seeking an injunction to restrain the UPND from communicating his expulsion to the Speaker and restrain it from bringing the matter up for consideration is misconceived,” she said.

Judge Phiri said it was not the role of the Court to decide who should or should not associate himself with others belonging to other given clubs and that the rules of natural justice were not followed by the defendant when bringing the matter to court.

  1. Mmmmm……not true ba either Tumfweko or Judge Phiri. How can a sane judge say all these in the same Judgement? Defendant or Plaintiff didnt follow natural justice?
    Court cant rule on membership in a club? AnaPhiri, mwati muli blind justice?

When you made up your mind to accept the offer you were at the same time ready to face the Consequences attached to it as a party we warned you but no you wouldnt listen and thought you are bigger than the party by decideding to bit the finger that made you what you are today such that even pabwato would like to work with you so my dear for the shame that you brought to this party i think you deserve everything that you are and yet to go through I would mind if you lost the by election thanks
