The Electoral Commission of Zambia (ECZ) has set Thursday 26th September, 2013 as the date for the Petauke central, Malambo and Mulobezi parliamentary by-elections.
ECZ Public Relations Manager Cris Akufuna in a statement issue to QFM News said the Commission has set Tuesday, 10th September as the date for nominations in the three by-elections, following the directive by the High Court to the electoral body to accept nominations of Dora Siliya, Maxwell Mwale and Hastings Sililo.
Mr Akufuna said campaigns for the three by-elections will commence on Tuesday, 10th September,2013 after 15:00 hours and will end at 18:00 hours on Wednesday,25th September,2013.
Yesterday, High Court Judge Mungeni Mulenga overturned the decision of the ECZ to bar Dora Siliya, Maxwell Mwale and Hastings Sililo from recontesting their nullified seat.
The trio lost their seats after the Supreme Court upheld the High Court’s decision to nullify the seats after it was established they engaged in electoral corruption in the 2011 election campaigns.
Judge Mulenga ruled that there was no basis to bar the trio from filing nominations in the by-elections in the absence of a report from the High Court to the ECZ in accordance with the Electoral Act.

I read somewhere that the state is appealing.. So this is a non starter as very soon the state will serve ECZ with a stay pending determination by the supreme court.
And we all know what the rulings from the Supreme court have been in the recent past with Chibesakunda at the helm. This is why the PF won’t let her go.
It is actually PF through Kabimba who will appeal and of course the outcome of such an appeal is a foregone conclusion. Chibesakunda will hear the appeal pass judgement in favor of the Python. But we the people will pass the better judgement whoever will replace the affected candidates. Nayamikila Kwambiri.

The learned judge misdirected herself.She states in her judgement that no names were mentioned as to who was found corrupt.The question that begs an answer is “when the court nullified the elections due to malpractices and corruption,who did the court in it’s wisdom was the guilty party”? Was it the winner or the loser.And since corruption is committed by individuals please tell us who????????? This issue of hiding behind technicalities on straight forward cases wont take this nation anywhere.
That is law Bwana! In law there are no right or wrong answers. There are only better arguments. Wherever you go technicalities will win or lose the case. So stop cheating yourself that Zambia will never develop. This is not as straight forward as your narrow mind thinks. there are alot of issues that the learned lawyers from both sides presented. At the end of the day, the one with better arguments won. Bravo the high court!

What bwana Kabimba is saying must be rubbished and I have never heard of him winning any case because he has no convincing points to stop the court. Him being a minister of justice, he must not be found in smaller issues. What is wrong wnen the court makes a ruling. He must leave others to handle such cases.
