President Sata appoints two new tribunals to probe two High Court Judges

President Michael Sata has appointed two tribunals to probe Ndola High Court Judges Emelia Sunkutu and Timothy Katanekwa.President Micheal Sata has since suspended the two Ndola High Court Judges.

The tribunal to probe Justice Sunkutu will be headed by former Chief Justice Mathew Ngulube while the tribunal to probe Justice Katanekwa will be headed by Justice Frederick Chomba.

President Sata has also appointed Justices Sylvester Simachela and Bobby Bwalya as members of the two tribunals while Chilombo Maka-Phiri will be the Secretary of the two tribunals.

President Sata held a swearing in ceremony Tuesday morning at State House for the appointed Justices.

He however could not specify why the two judges are being investigated and when the tribunals will start sitting.

Mr. Sata said that there was need for Zambians to know the truth about the two judges and expressed confidence that two retired Justices will execute their mandate with no challenges.

    • President Sata has no advisors and that president post is very huge for him, the man is so confused that he does know if he is coming or going!! PF cadres you should starting crying and worrying!!

    • Those two fired Judges should sue against the tribunal, that’s whats others like Judge Musonda do.
      This might end-up another circus for Sata like he has the Chikopa, a ghost employee.

    • I agree with Ndobo…..the president is truly drunk with power. He has tribunals for everything and everyone but has failed to instill discipline within PF! Awe shuwa….I am pretty sure that Zambia has far more pressing needs than whatever the judges are wrong of. As a parent, just because I am head of the household does not mean I should wake up in the night, kick out my daughter and convene a tribunal headed by my dog, three chickens as members and ask for investigations! PF truly has no clue what they are doing in my view….all those commisions that were appointed immediately after 2011 elections – you have some where reports and recommendations shared but since they did not meet the presidents verdict they were tossed out. Others simply have not even concluded sitting!

    • when is this guy Sata going to learn that, even the president is required to follow the constitution – constitution provides a mechanism for which the president can call for a tribunal. Complaints have to be presented to the Chief Justice, who submits the complaints to the Judicial Review Board. Based on the MERITS of the complaints this board then recommends for a tribunal or not to the Chief Justice who advises the president whether to go ahead or not.

      But bcoz Sata is drunk with power, he doesnt see the need for this constitutional requirement. Levy M, is among the few honorable Zambian to resign a senior govt position bcoz he could not live with the injustices being committed at the time.
      i urge the honorable retired judges on these kangaroo tribunals to follow Levy’s example

    • There is a reason for this just wait and see guys. Some judges have errored in their judgements and have sent wrong people to jail. Let them defend themselves. You may not know the reason for their suspension now but i can asure you that very soon you will know just like in the case of Prof. Chirwa

  1. This is good for the nation!!!! I wish Judge Chikopo would have been the one to lead these two tribunals so that he puts more money in his pockets!!!!

    • I like the comment that Judge Emelia Sunkutu is the one who dismissed three election petitions by the ruling Patriotic Front with costs on grounds that they lacked merit and in some cases allegations could not be substantiated.she is also the one who upheld the three-year jail sentence slapped on Patriotic Front cadre Judge Ngoma who was jailed after being convicted for assault…I guess Sata is out to get those judges,who unlike the chief Justice Chibesakunda do not rule in his favor.Executive messing up the judiciary.And yet we learned in Civivc that there are 3 arms of the government.Seems the only arm is Sata’s

    Its unbelievable that Sata can appoint retired Chief Justice Ngulube to probe the Judges,when and yet Ngulube was removed from that sit under questionable circumstances!!
    PF is just a bunch of imbeciles who dont know whether they are going or coming!!

  3. Not again,these things costs money for christ’s sake! From Useless COI to this now man of action sure apply that little energy to Economic and development issues e.g SI 55,Constitution,KCM,poverty reduction programmes not these CCTV issues naivo

We are talking about judges here – they send people to prison, curtail people’s freedoms they must conduct themselves diligently and if they are found wanting someone MUST judge the Judge. So hold your fire until when the issues are known. Why are you people so comfortable with corruption eh?

  4. It doesn’t make sense…we deserve to know why these judges are been probed. These guys have been judges for a very long time and have made enemies because of their responsibilities to the nation. Some chap with a personal vendetta against a man of the law, close to plot 1, can cook a tale about a judge and the president listens. Let what these judges are accused of be known to the public. The public know these people and they’ll judge whether the accusation warrant plot 1’s intervention. We don’t want a situation where the legal fraternity are made impotent by cartels powerful enough to influence the president, do we?

    • So easy to read the plot. And yet it’s proving nearly impossible to institute a tribunal to investigate Masebo as requested by William Harrington.

    • Boss, you have a short memory Justice Sunkutu actually nullified a couple of seats and their was a general complaint that she was being protected by the President. In fact, Sakala CJ sent her on leave for 6 months to compel her to deliver the 150 or so judgments she had pending from the Industrial Court and High Court. And this Tribunal is long overdue as her competence has been challenged by LAZ and many stakeholders.

  10. Never as a Judge rule against the PF or the friends of the President. I now understand why the Linyungandambo want out of Zombieland. The institutions are rapidly been bastardised. What sort of justice is it that an accused person nor the taxpayer is not made aware of the charges necessitating the appointment of a tribunal? And who the heck is the complainant? Bongobongoland par excellence!

    • Lunatic is you who condemn without getting facts. Wait for the right moment, after you gather facts. Judges are not above the law. And the law provide for tribunals and not out right dismissal.

    • Just imagine how much we have spent on accommodation on him for almost 12 months residing in Pamodzi hotel (Presidential Suite paying $850/nite) or Fallsway Apartment…I think I will invest in high-end real estate lettings in Zambia.

    By the way how many tribunal is going to appoint?? What has happened to barotse commission of enquiry? I guess it gathering dust like many other commissions he appointed.

The judicial system in this Country is rotten,so before you start calling names wait until you hear what wrong they have done.Do you think these judges oppose the tribunals because they are innocent?NO WAYS!Hatred for the president will not help them let them account for their wrongs and if found NOT GUILTY that is fine!There is a lot of resistance within the legal community fo change whether the like it or not change will come.

    – The retired Judges will be insulted if the report is not favourable to the President.
    – As usual it will not be made public

Is this not the chap who acquitted the man who murdered Ms Mwanza in cold blood because the murderer was a son to some wicked leader of one country in Africa ..falsely claiming self defense when the victim was gunned down from behind? Poor Ms Mwanza was shot at the back of her head and died instantly.

  18. There is a Judicial Complaints Commission in existence in Zambia.I think the first step should be to take the complaint to the commission.Not using the same is what has brought the chikopa saga.It appears the Cobra does not learn.Well i may be wrong.

  20. The President cannot just dream of appointing the commissions. He has reasons. Just wait and see. This judiciary was rotten under RB.

    There were no such things under RB that’s why some of you are surprised and raising unnecessary complaints. Much as reforms are coming, there is need to start the clean up now.

  22. Some thing is terribly wrong with bloggers here. It appears Watchdoggers where some people have been bared from contributing because they talk sense have migrated to here. Editor moderate your site before you loose readers and risk being hacked to behind the scenes. How can a normal human being condemn everything without even getting facts. Typical of some opposition leaders, hence their voices are being ignored by well-meaning Zambians.

  23. Public funds will be spent and it’s only sensible that the nation be told what this latest circus is all about. But again, it is not sensible to expect sensible things from ‘Man of Action’ because he is only a standard three drop-out. Kabimba has been sidelined and this must GBM’s doing.

  24. MK Judge NGULUBE resigned because of a scandal. he was having an affair with a Daily Classified Employee (CDE) and a picture showing a pant belonging to the CDE was shown in the print media in fact the Post Newspaper.

  25. Obama is regularly seen on the white house podium to address the press. Why cant we have a press conference than these tribunals.These judges are also law inforcers.trying them is too costly and time consuming. Look the minion Chikopa tribunal.Musonda went on to resign rendering the presence of chikopa a high cost to our moneys.Its like acting on rumours.yaaah
