A Lusaka Magistrate court has convicted Sport Deputy Minster Stephen Masumba for obtaining pecuniary advantage by false pretences.
This is in a case in Masumba had used an erroneously issued National Institute for Public Administration (NIPA) accounting technician diploma to get a job at the Lusaka Business and Technical College as an accounting officer.
Delivering judgment this morning, Magistrate Wilson Muma ruled that he did not find any truth in Mr Masumba’s evidence.
He said it was clear that Mr Masumba used the qualifications he erroneously obtained to find a job.
Magistrate Muma has since ordered that Mr Masumba be remanded in custody awaiting sentencing on Wednesday.

I am pretty sure he is not alone in this scandal. And please extend the inspection to these overseas on-line ubiquitous qualifications as well.

@John what you say is true. I was once erroneously award 5 points on a question in a test last year. The lecturer asked those that had issues with their marks to return the papers for remarking. I returned my paper showing him the extra points for a wrong answer. A week later he returned our papers but my mark was the same with a note from the lecturer reading “5 points now awarded for honesty.”

This shows that one is above the law. The only sad thing is that NIPA have not been punished for their mistake, especially that they did not recall the certificate when they realized the error. Even if he did, that someone should also have been punished. That is justice!

@ St. Jude, it appears NIPA wanted to recall that certificate, but the man was not willing to return it. And that is why a NIPA representative was a prosecution witness in this case. But when you go by Masumba’s testimony, you cannot rule out collusion between Masumba and someone from NIPA academic office. How else would Masumba have gone to attend graduation when he knew that he had not completed his course? There must be a bad among NIPA staff, and that bad is what the law enforcers should target now. Really it’s shameful. Another by-election. More thousands of Kwacha down the drain, all because of that dubiously obtained certificate.

ii. Masumba will then appeal to the Supreme court which will declare that the High court and Magistrates erred in their judgement and the conviction will be quashed with costs.

I have no sympathy for Masumba. Let him go to jail. It is i.d.i.o.t.s like him who fake degree certificates and end up not performing and as a results the general public lumps everyone who has gone to school together that we don’t perform. Good riddance! Some of us have worked hard for our professional certificates and to compete for a job with somebody who just bought his or her certificate at Matero University is very annoying. I wish they sentence him to 5 years in jail. This is the beginning of the end for Masumba. By next month Sata will appoint somebody else to replace him at the Ministry.

I wonder how many of us can stand up to say that this document has been awarded in error. Why are we directing the anger of unemployment to him? NIPA is to blame, you can imagine how many the are out there in the same situation.
Knowing PF they may not allow the courts to sentence him accordingly. Instead, he will be given 48 hours community service and yet what he has committed is a criminal offence. The PF is not a government of laws. They do not respect the law. Just recently, a fake post mortem of a cadre that was killed by fellow PF cadres was done. No Sir, it’s not a forgery! A forgery is where one makes a document and Masumba did no such thing! NIPA made the document themselves and if anything, they are the ones that forged. I repeat, IT’S NOT A FORGERY!
St. Jude is correct. It was not forgery. It was generated by NIPA, authenticated and sealed by NIPA, conferred and handed over by NIPA. The catch word is ‘erroneously”. NIPA handed it it to Masumba erroneously. And we know what that means. It could have been collusion between Masumba and some corrupt officer from NIPA. But still it was not forgery.
If he was MMD people should have cried foul. But many are now celebrating. Why? Because justice has prevailed. That is the way.
This Masumba case will bring a lot fights in Solwezi,and this time it will be inter party and more reathal.

And that very poor management by NIPA. When you give exams, you must have knowledge of who has written it and finished and passed. How do you present a certificate to someone who did not do the exam? It simply means a lot of certificates from NIPA are false. There are a lot of forged certificates from matero also. Other people are even working and earning money using them, and life goes on, while some of us are spending sleepless nights studying.

Hon. Masumba is a victim. He did not forge his documents. A public training institution judged that he had met all the necessary requirements for the award of a diploma. Therefore, Mr. Masumba cannot be held responsible for the INCOMPETENCY of the nipa management. CBU for instance is able to withdraw your degree if it is later discovered that even the grade 12 you used to get into the university was forged. Therefore, I propose that the Ministry of Education should with immediate effect downgrade nipa to grade 4 (lowest) as punishment.

Even the way he conducted himself when he resigned from MMD one could tell that there was something the chap was trying to cover up. Any way he is not worried he will appeal and when he reaches the supreme court queen Chibesakunda will declare him very innocent. What with his justice minister who became state counsel without winning a single case except when he was represented by others. Sata fire chap. He is an embarrassment to your bad government.
This really makes sad reading indeed. Even as a PF supporter its unacceptable! Period! Not to justify anything here but these are issues which can happen to any sitting president. It is just afortunate that Mr. Sata is in the right place at the wrong time. Even if it was HH or Mumba or Mpombo this issue would still be sad development.

I have followed this case. But i can not understand how the internal controls at NIPA failed. Who signed the certificate?, who handed over the certificate?, who made Masumba sign for the certificate?, when was the mistake discovered and by who?, how did he attend a graduation ceremony? How was his out put where he was working?
I have failed to find answers please help.
I personally feel his not worse off the many leakage graduates out there incompetent failing Africa which still is recording false statistical graduates hence no wonder the west in international organization still employ more non-Africans as majority you fail to deliver……. Quality controls ,alumins,data base of attending and graduates and posted scores and marks will help. Nicely candidate profile and data kept all the way to the approval of graduating candidates.
Making use of national examining body like Tavet and ECZ acting as a seal of approval will help segregate examination process from academics thereby giving credence and quality to many qualifications, rewarding and giving rewards to good students or candidates of the book/course many who genuinely put up an effort first for their own edification and secondly for others.
Its time Zambian certificates were competitive to others its begins with courses and examination quality assurance.It can be enshrined
To say that Masumba is not to blame but NIPA is not the correct way to look at issues. You cannot, for example, use the money that is wrongly credited into your bank account. If you did that you would be stealing from the bank. Masumba should have declined to receive the certificate because he knew that he did not deserve it. He just showed us how dishonest he is. When you hear someone was at a college during a certain period those of you that were at that college that time please prove to us that you saw him. There is no disputing HH was at Kalomo Secondary School, ZNS and UNZA and I can prove it because I went to eat with him at the dining hall. Even for Chiluba no one could tell us which school he attended, no classmates and not even friends that played with him when he was 7 years old. That is precisely why the pygmy was able to rule Zambia despite being a foreigner. This is good development. Well done Magistrate Muma. We have a lot f cheating in our education institutions such as buying examination papers at Grade 7, 10 and 12 levels. Cheating has extended to higher institutions of learning! No wonder the majority of law graduates cannot make it at Zambia Institute of Advanced Legal Education (ZIALE). Most institution have leakages. Many MBAs cannot even write a business proposal. ZIALE is the institution with high level of integrity!

Masumba is innocent since the college awarded him a certificate. It is only in zambia where certificates are awarded to students or candidites erroneously. It maybe happening in a lot of institutions based on tribalism and similiar nepotic behaviours.
