Nchito asks for adjournment in RB oil deal case, insists only two witnesses left

DIRECTOR of public prosecution (DPP) Mutembo Nchito has told the court that only two witnesses are remaining before the State closes its case in a matter in which former republican President Rupiah Banda is charged with abuse of authority in a government to government oil deal with the Nigerian government.

Mr Nchito said this yesterday before Lusaka chief resident magistrate Joshua Banda when he asked the court to grant him an application to have the matter adjourned to enable the State attend to certain issues relating to the case.

When the matter was called up, Mr Nchito who is the lead prosecutor informed the court that the case was schedule for continued trial but the State was seeking for an adjournment to enable it put certain things into consideration.

Mr Nchito said that they were certain things which the State needed to attend to before the matter could proceed.

He said that the adjournment would enable the State to consider among other things, whether or not it was necessary for it to bring the other witness other than the arresting officer.

More than four witnesses have so far testified including SARB Energy managing director Akpan Ekpene, former Zambia high commissioner to Nigeria Richard Kachingwe and former Energy minister Kenneth Konga.

Mr Mutembo who apologized to the court for the inconvenience the adjournment could have caused said that the State had in the past endeavored to ensure that there were no adjournments of the case at its instance.

He indicated to the court that the State was most likely to close up its case at the next hearing because they were only two State witnesses remaining.

Mr Banda later adjourned the matter to February 10, 2014 after there was no objection from Banda’s lawyers.

Banda would appear for mention on January 10, 2014.

  1. Nchito there is no case here. What are you afraid of RB? The two state witnesses will testify against the state. Just close the case.

    • Abusers of those they envy typically try to ease their own conscience for their shameful acts of cruelty by either forcefully declaring or implying that their victims are useless, or worse. The torment they inflict is meant to emotionally shatter those they envy and hate so that it leaves an indelible impression on their victims yet they will not happen to RB. They belabor in vanity to soil RB’s impeccable profile built on his 50+ years of illustrious international service and PanAfricanist career. Heavy and smiling, the hated grows in goodwill. Indelible record of dedication and courage to the liberation of the continent.

      Yes for raping you women and rotting the country. If anyone was raped by RB , you and nchito would paid that millions of money to RB cage, but no. If RB rotted your country, he would not have managed to keep money in reserves.
      However, RB has record killing and stealing the body from the mortuary, No records of Minister dying after visiting him. No record when he failed to attend his ministers funerals, No record of Tandiwe garavanting all over the world,
      No records of people killing each other over 30 pin,
      No record ………the list goes on.
      So let RB be jailed because he has record….

    • Gen,if you really want to hang the criminal RB for looting and raping our country and our young women go to Mutembo Nchito and enlist as a State Witness since you appear to have evidence that would convict RB.wITHOUT DOING THIS, JUST SHUT UP.

    • The court shoud refuse an application for nolle. RB deserves an acquittal and then sue Mr. Nolle Mutembo Nchito and coward fake SC Climate for persecution, and false imprisonment.

  2. The State have failed to illegally secure a conviction. Mtembo Mmembe the Homo and this dull lawyer Wynter Kabimba who has never won a case are leading Zambia down the drain.

  3. I am shocked that DPP came to court unprepared and I hope the Defence team asked for costs…..the verdict RB has no case to answer and he will be acquitted unless Fat Desk lawyer can come up with a rabbit from the hat…..what a shame that the office can be used to settle old scores.
