Supreme court nullifies outspoken MP Lucky Mulusa’s seat

The Supreme Court has nullified the election of the Opposition Movement for Multiparty Democracy (MMD) Solwezi Central Member of Parliament Lucky Mulusa on account of corruption.

Acting Deputy Chief Justice Florence Mumba who made the ruling at the Supreme Court this afternoon said the earlier judgement of the High Court which dismissed the petition was overturned because the High Court Judge misdirected himself.

Justice Mumba said Mr Mulusa made a K 1,000 church offering to an Evangelical Church in Solwezi during the campaign period for the 2011 general elections.

She said Mr Mulusa’s further actions of asking the congregants to vote for him amounts to corruption.

Justice Mumba also stated that Mr Mulusa made another donation of K 100 to another church in Solwezi and promised to buy musical equipment for the church after the elections.

Speaking to journalists shortly after the judgement, Mr Mulusa said he had accepted the court verdict.

  1. We have a very oppressive government and a very corrupt Supreme court.Kabimba was donating money to a church before some by election and the seat was never nullified.Zambian youth like Mandela we have to do something.

    • Very docile Zambian leadership and citizen that would let the government juggle rules like a yoyo while everyone is just watching like indwi. How many by elections have they been since PF took over the gvt? How much tax payers money are we talking about? and what are members of parliament doing about it? Does Lusaka look like Cairo or Zambia look like Tunisia? For how long can one gvt continue to take people for granted? Wake up! Zambia! wake up it’s 21st century and not 1964.

Such injustice is calculated to eliminate all sharp minded MPS so that PF and Sata can pass the constitution- 2 terms of 10 years each. Arise zambians, Dont say you were not warned!!

      Sata is doing this to make sure that when he changes the constitution only parliament will be allowed to vote on it. We are slowly going back to one party state. Sata is following exactly what KK did when he banned all parties.

      Now I can see the only way out of this mess is by the barrel of a gun. Zambians prepare for some blood shed to get rid of this monster at state house. South Africa and Botswana can supply the arms. I am prepared to die for the sake of my grand children. Democracy should be shelved for now until the PF regime is oust.

    • People, I think for an election to be nullified someone has to file a complaint/petition. If no one filed a petition in all these other elections we are complaining about, COURTS CAN NOT just jump in and nullify them.

      And as far as I can tell no one has petitioned the Kapiri central election, the Livingstone election, or the election in which Namulambe was elected. If there are petitions pending in all or some of these elections, they will come to a resolution at an appropriate time. And that is dependent on the quality of the evidence in court, not PF!

      I am not sure if it was smart or not for PF to do a “wholesale” sort of election petition, but it seems to be working for them. They seem to be winning these cases in court, where the fight is correctly supposed to be waged!

    • Happy to note that people have finally discovered the hired guns and it is true these people are so dull at times they fail to debate, but resort to voting down anything which is not in line with defending the failed policies and implementation of programmes by their loved leaders. If the topic is out of their scope, all they do is voting and they are 12 in number, with a dull voting pattern which any one can predict. Shame to the people who have hired these people.

    • Former Honourable Mulusa had it coming, he knew he would not last that was he always talked fearlessly, proudly and stubbornly without traces of humble leadership in him. At least he has humbly accepted the verdict and does not wish to re-contest the seat.

    • What is the point going to Court? The final ruling will be doctored as all previous rulings by the person which is illegally highest judicial authority. Independence was achieved 49 years ago. Unfortunately, there is no yet freedom.

  10. Lets understand one thing here. Corruption can only be committed by opposition party members or any other person who has divergent views, presidential ambitions or simply anti – ruling party. Ruling party members can only be cited for corruption after they have left office. This cycle will continue and so will our poverty. It’s a rat race. Running fast, doing a lot but going nowhere.

When Mulusa donated the money he went on to introduce himself as a candidate in the elections. he promised more after being voted in. This proves the element of inducement. I wonder why the high court didn’t see that. Had he donated freely, without inducing voters by word and deed his seat would not have been nullified.

  18. The only problem with Mulusa is that he has never denounced his South African citizenship. This means he was an illegal MP as the constitution does not support dual citizenship.

  19. I don’t know where we are heading. So it is now an offence to give offering in church. Shallow judgment. The Judges are operating according to their master’s wish. When are we going to settle down in this country? We are tired of bye elections. Please channel those resources to other developmental projects. Mulusa you will remain my man no matter what. The fact that we have managed to nullify too many seats means the whole 2011 general election was fraudulent! We therefore need to save money by calling for fresh general elections in 2014 otherwise we have become very petty as a country!

But when did donating to a church via a tithe and promising to donate equipment ever amount to corruption? So a politician who made a promise during campaigns should have their elections nullified? Please put your house in order before 2016.This can be avoided and the money can channeled to meaningful development.We love you Pf but don’t forget people are critically analyzing your performance.

Mumba, are you sure that an offering of K1,000 to Church in Solwezi by Mulusa is bigger than GBM’s K100,000 donation to a Church during one of the by-elections or Wynter’s donation of several tens of thousand kwachas to another Church again during another by-election, or the recent promises of development by snr PF officials to Mansa Central residents during the recent by-election there? Please, is this ruling credible, Madam Mumba? Remember, these rulings of yours are tied to your name and you will go down in history as an Acting Chief Justice who totally abused her position during this period. If K1,000 influenced 2011 election results in Solwezi, what about GBM’s, Wynter’s, and other recent donations and promises?
