A Zambia Daily Mail Limited Sales Agent for Chinsali District in Muchinga province has been convicted and jailed for four years imprisonment with hard labour for stealing over K32, 890 realised from the sale of newspapers.
Patrick Chisala, 32, of Mucheleka Village stood charged with five counts of theft by agent contrary to section 272 and 278 of the Penal Code Chapter 87 of the Laws of Zambia.
It is alleged that Chisala in count one, on the date unknown but between the month of January and September this year being a servant of the Zambia Daily Mail employed as a Sales Agent did steal K 21,125 which came into his possession on account of his employment the property of the said Zambia Daily Mail.
In the counts two, three, four and five Chisala was charged for fraudulent false accounting contrary to section 326(A) of chapter 87 of the Laws of Zambia.
It is believed that on different dates and months but between 15 March, 9 July, 20 August and 21 September, 2013, being a servant to the Zambia Daily Mail as a Sales Agent for Chinsali did falsify documents namely Finance Bank Cash Deposit Slips purporting to show
that he had deposited money amounting to K32, 890 in the Zambia Daily Mail account number 0014464190008 when in fact not.
In passing judgment, Magistrate Chongo Musonda said the court had found Chisala guilty as charged upon his own admission of guilty and convicted him accordingly.
Magistrate Musonda said the court had heard all what the convict had stated in his mitigation and that she had also taken into consideration the fact that he was a first offender who readily admitted the charges he is facing.
Magistrate Musonda said the crimes Chisala was facing carries a maximum sentence of up to seven (7) years each.
She added that the accused was malicious in his action and breached the duty that he had to his principal.
Magistrate Musonda slapped a four years imprisonment for each count all to run concurrently.
In mitigation, the convict told the court that the low sales of newspapers coupled with the coming of the paper late by a day and failure to dispose them all is what made him to do what he did.
Chisala further asked the court to exercise leniency on him as he was also sick and that he was the one taking care of his parents, a child and wife.
