Further evidence of Zambia’s eroding Judicial System

When concerned Zambians requested Wynter Kabimba to step aside following his appearance before the Tribunal, he saw nothing wrong with staying on at the helm of the Ministry of Justice and staying he did. When Judge Hamaundu was also requested to recuse himself given his closeness to Wynter, he too declined to do so.

Half way through the tribunal sitting, Hamaundu got a promotion to the post of Supreme Court Judge. While Hamaundu was preparing the Tribunal report on Wynter Kabimba, Wynter on the other hand was also preparing a report recommending Hamaundu on his suitability as Supreme Court Judge.

Last week, Wynter duly appeared before the Ephron Lungu led Parliamentary Select Committee appointed to ratify Hamaundu. Neither Wynter nor Parliament saw anything wrong with this clear attack on jurisprudence!

Parliament depleted of good debaters who unpacked issues without fear or favour and now filled with useless PF MPs is likely to ratify Hamaundu without so much of a fuss.

All these misdemeanors are in addition to the ignorance of both PF State Counsels and the Acting Chief Justice representing and sitting on cases respectively where there are conflicts of interest. They saw nothing wrong with that.

As Zambia this year celebrates 50 years of Independence it is disheartening that we are seeing the rapid decline of Zambia’s Judicial system before our very eyes.

  1. Haabaponta – so you are cool with wats happenin? It’s dweebs like you that don’t care sh..t for the land of our ancestors. You messin up for us man ,you and your cronies in government, that grandma shldn’t be Chief justice, that snake shldn’t be president, that judge needs his head examined and that mister kabimba needs to join his clan in the zoo.

    • We want them listed , because if my memory saves me right the state just entered a nole with a certain gentleman. that doesnt hapend in a non functional judiciary. So list! boss list!

    • Tell the twit man! Some people are so blinded by weird loyalties that they can not see wrong even when it is staring in their faces. The current happenings are a poisonous seed being planted to be harvested by the future generations and it is up to the youth and all progressives to speak out. Do not be discouraged by the sellouts who are part of the rot instead of being part of the solution

  2. As we see our judicial system slide into decay fellow country men and women, dont lose hope in Zed. All of us have only one mother land – Zambia. These poeple destroying our country, their time will come. it will definetely pass. Lets all keep the pressure on by talking about the injustices, and supporting our colleagues on the ground that encoutering these injustice on a daily basis. Viva Zambia Viva ZED

    ITS ROTTEN TO THE CORE…

WHY DO THINK THE PRESIDENT’S FIRST ASSIGNMENT WAS TO REVIEW THE JUDICIAL SYSTEM BY APPOINTING THE CHIKOPA TRIBUNAL?

WE SAW JUDGES START RESIGNING ON THEIR OWN…WHY?

THAT TRIBUNAL WAS A FIRST STEP IN THE PRESIDENT’S EFFORT TO ASSESS THE COMPETENCE OF OUR JUDGES.

    • But wait boss ….., the Chikopa tribunal was a fraud – you cant rectify a wrong with another wrong. Mr Sata did not mean to do a good job for the betterment of all zambian citizens. He wanted to purge judges perceived against the PF. That is NOT getting the rot out of the judiciary ..

    • SATANA the BEAST wanted to reverse the judgement against Fred M’Membe and Mtembo Nchito which asked them to pay the K14 billion back to the Zambian people.

  4. A basic principle of law – Justice must not only be done, but must be SEEN to be done!

What do we see in Zambia? An unqualified “acting” Chief Justice illegally appointed in direct contravention of the constitution that Sata swore an oath on the Holy Bible to uphold! This is a CRIME against God and against Man. He must answer for this.

We must restore the RULE OF LAW in our mother Zambia otherwise no man can be free.

  5. Am not supporting other peoples views but the acting chief justice is very corrupt. I had a case in his court in 2009 but before she delivered her judgement she called us to her chambers to threat us with imprisonment if we protest at her judgement. It’s long story but i pray for God to change her.

  6. time will tell..these chaps will be banished some day!!watch the space..the future generation will thrive with prosperity and unity come 2016 elections under UPND!!

  7. So we will continue like this! What can remove these people from these offices! Death or? pliz something should come to our aid!

  8. “Separation of powers, therefore, refers to the division of government responsibilities into distinct branches to limit any one branch from exercising the core functions of another. The intent is to prevent the concentration of power and provide for checks and balances. ”
The President of Zambia has too much power and the Judiciary has none, that is what is wrong here people!
