H.H urges all Zambians to unite and stand up for their rights

Opposition United Party for National Development (UPND) President Hakainde Hichilema has observed that the rejection by Parliament of the motion urging Government to put in place a roadmap for the enactment of a new constitution is a confirmation that PF will not deliver the constitution.

Parliament on Tuesday rejected by 69 to 42, a motion moved by Mazabuka Central MP Garry Nkombo urging the PF Government to put in place a roadmap for the enactment of a new republican constitution.

Mr. Hichilema told QFM News in an interview that the rejection of the motion is a clear indication that no PF official is willing to give Zambians what they were promised.

He said the PF government is mistakenly comforting itself if they think they will shelve the constitution making process just like that.

Mr. Hichilema said now is the time the Zambian people from all sectors of the society to be united and stand up for what rightfully belongs to them.

He said the opposition and other concerned stakeholders will not rest until the PF gives the people of Zambia a new constitution.

And MMD President Nevers Mumba told QFM News in a separate interview that the rejection of the motion in parliament is confirmation that the PF government has willingly denied the people of Zambia a people driven constitution.

Dr. Mumba said it is for this reason that some genuine opposition political parties, Church Mother Bodies, Civil Society Organizations and other relevant stakeholders will be holding a meeting over the weekend to strategize on the way forward.

  1. The opposition have more than 42 Members of Parliament. Why only 42? They are also not willing to have a new constitution before 2016. Shame on them.

      “Section3 of the Public Order Act subsection 1 reads subject as herein after provided any person who is in a public place or at any public meeting wears a uniform or displays any flag signifying his association with any political organisation or with a promotion of any political organisation is guilty of an offense”

    • The opposition only hold 42 seats partly because most their seays have stolen by pf in the name of nullifications let’s not forget that part. Since pf came to power how many of thrir parly seats have been nullified by the courts as compared to the ones belonging to opposition?

    • The constitution is indeed important. But what else, what other things must we do to improve the country APART FROM politics of/on the CONSTITUTION? The United Kingdom UK has no written constitution and the UK functions under other institutions in place. What else must we really do and move on apart from the constitution? Can we think outside the new constitution?

    • Firstly the disgruntled, fragmented and disorganized opposition political parties must understand that the constitution making process has been undertaken by the PF govt on voluntary basis. No one forced them and no one can push them on something they volunteered to do themselves.

      The best the sloppy opposition can do is think outside the constitution box but that is not possible if you have a Bantustan leader in place obsessed with tribal and regional politics.

How many members of opposition are in parliament?If they are more than 42 then clearly some of them voted against the motion!This means the opposition is not united and they must just wait for the government to deliver the consitution at their own time.No amount of noise will persuade the government to deliver the constitution urgently.The chiefs have raised concern about the article taking away land abd vest it in the president and there must be many more articles that need revisiting so I dont see the urgency in delivering a half baked constitution!HH & NEVERS pls take your time!

    I would like to know what mode of efforts united Zambians should make in order to bring Government officials on their Kneels? Aangezien (Looking at the current unfair detention of 42 youths just for wearing Tshirts demanding the contistution)
    Am guessing government is ready to pound hard on any citizen that will speak against this issue, now …are Zambians willing to go through whatever it takes for the constitution? For with going forward means no looking back, therfore, if you and any opposition leaders are to embark on this journey, I say prepare everyone for a turbulant ride and take along only the die hards!

      By Zambians you mean PF cadres and treacherous MPs from MMD and UPND. Even those from other parties are Zambians. We’ll see what happens. Of course if the opposition political parties go to sleep, as they sometimes do during some elections” PF will use State machinery to “win” the 2016 elections.

      Characters like Shakas should also be cautioned so that he does not give the PF govt an excuse to “use” the law to weaken the UPND. He is known for defecting to the ruling party when a carrot is dangled. As for MMD, ummmm, little hope there. FDD is dead with EZN at the helm. She is happy as long as a Northerner is President.

      What Sata and his PF are doing is arming every Zambian young and old man and woman to get ready for just that one day when a crystal clear message will be sent to Sata and his stooges that Zambians want him out urgently.
      That day Cindy is fast approaching because Fuel price is going up at the end of this month by 15% triggering price hikes for every thing.

      The PF can no longer afford to subsidise for the Kwacha depreciation against the dollar.And as such they will have increase the price of fuel to avert shortages.

      As from next month on wards PF should prepare for more protests even food price riots unless they import more maize from SA.

      UPND and HH only hope.

    So after failing to twist the arm of parley by walking out and disrupting proceedings with their rebellious actions in the past weeks, now they honestly think they can get it with ease?

    In such matters as the constitution, a tug of war is not really worthwhile. The best strategy for the opposition is to support the government, no matter how long it takes to usher in a new constitution. UPND and MMD have neither lock nor key – PF has both. Whether they like it or not, they have no choice but to co-operate or wait for their turn to run the show, or they risk bearing an unnecessary workload and embarassing themselves in the end with the impracticality of their so-called “pressure” once PF suddenly delivers at own will.

  10. The moment that this tribalistic under five understands that in a democracy its the mojority that wins the better. The % in parliament are an indication of what the majority Zambians want. The majority are saying let us not rush the issue. Whichever Zambians HH thinks he represents if he cannot control his own MPs.

In the whole of my life on earth I have never heard of or seen a single Zambian MP going back to the people in his constituency to ask their permission nor their opinion over any motion in parliament.   15. The Mansa seat in Luapula Province fell vacant when the incumbent, Kennedy Sakeni, a N’gumbo passed on. But the seat was contested by different tribes, Aushis, N’gumbo etc.

    95% of the by-election campaigns where conducted not in N’gumbo of Lake Bangweulu but in English. At no time was Kennedy Sakeni’s clan or clan name invoked. BUT our Bantustan leader went to Katuba to exhibit with expressions such as:

    “Na muntu wafwa pamunshi, wa mukowa wafwa pamushi, mwamana kulila, mbutwakalila kuno kuli ba Chikusu, mulakala nobamukowa kubandika…simulyazhina saa… mulabika mutuba na mulabika wa mukowa?” in his Bantu bo tatwe language.

So to all those of you who think that the UPND are any different, i say find something to do and never bank on a politician to change your life.     • What did Shakas say in parliament? if i remember correctly, Shakas said, “this country does not belong a tribal clique”…..and i assume he had in mind the clique Kabimba already told us about….

    The Constitution is in DRAFT form – meaning that it has a long way before it could be adopted as FINAL document!
    Mind you chiefs have already rejected some of its provisions on land.
    So someone and somehow will have to find time to reconcile all the views.
    So which constitution are we demanding release now?

  30. The constitution is indeed important. But what else, what other things must we do to improve the country APART FROM politics of/on the CONSTITUTION? The United Kingdom UK has no written constitution and the UK functions under other institutions in place. What else must we really do and move on apart from the constitution? Can we think outside the new constitution?

    • Do you know how old parliament in the UK you are mentioning is? Zambia is just teething into democracy and you want to compare us to the UK. Do you know what underpins the UK economy and how the country is run? Carefull with your comparisons!

  32. Zambians have waited for a new constitution for 50 yrs. Waiting for a few weeks, or months or indeed years cannot make any difference unless its being pushed for political expediency by a few selfish individuals. In the last 20 years Zambia had deteriorated progressively in terms of standard of living and infrastructure. I for one as a Zambian is looking to the reverse at a shortest possible time.

It is amazing and at the same distressing how some bloggers here and indeed a lot of other Zambians at large, do not understand the significance of having a Constitution that clearly delimits powers, calls people to account and guarantees real rights. It is better to ask, than to ‘fire’ from a premise of ignorance. The UK may not have a written Constitution but have a rich tradition of common laws, equity and institutionalized rules that make it impossible for a leader or a party to ‘ride roughshod’ over the nation. Why do you think countries that are authoritarian, dictatorial or have no mechanisms or regard for the rule of law, also tend to have serious economic disempowerment of the ordinary citizens? What does unfettered power do? You can’t discern the linkages?

    • Iwe Harold, you can have accountability even with the current constitution all you need is institutionalizing accountability framework derived from the current constitution. Where there re deficits, amend the necessary sections of the constitution. What the govt needs to concentrate on is reversing the current rooten state of being the nation is in. Fortunately on the road sector part, there is a large ray of hope.

  39. Albert@ There has always been an issue with Presidential powers in the Zambian Constitution. There are also clauses that have needed strengthening so that independent professional institutions should be allowed to operate as such. I fail to understand why you cannot fathom the linkage between dictatorial regimes that account to no one and the sharp gap between the haves and the have nots ( who are also often rendered impotent in having a meaningful say or control over their socio-economic situation )

  40. In fact I think the current draft Constitution has not gone far enough in proposing changes. I submitted that we needed to change from merely having a Constitution to actually practising Constitutionalism through clipping a lot of Presidential controls on institutions that are meant to be more independent and have more teeth (e.g. the electrol commission, judiciary, auditor generals office, investigator general, etc.)

    The nature of our President ‘has it all’ situation does not allow for many people in the govt. system to being able to suggest informed solutions for the people. Everyone is simply busy saying ‘yes sir’ while drawing allowances and imprest for tours of so-called development projects.

    • Well spoken. Good message to every well meaning Zambian, “Stand up for your rights”. The more the people with ill intent oppose such a simple and clear universal right of every human being, the more they de-campaign the PF Govt.
