ACTING MMD national secretary, Chembe Nyangu has submitted to the court that party president, Nevers Mumba refused to abort the national executive committee (NEC) meeting despite serving him with an injunction.
Meanwhile, MMD chairperson for the tourism, Lucky Mulusa has applied to join in the matter where two MMD vice presidents have sued Dr Mumba for contempt.
The two, vice presidents for politics Michael Kaingu and his administration counterpart, Brian Chituwo have asked the Lusaka High Court to cite Dr Mumba for contempt for going ahead with the NEC meeting despite having being served with an injunction restraining him from holding the meeting.
According to the affidavit verifying communication of the injunction to Dr Mumba and other NEC members filed yesterday in the principal registry, Mr Nyangu stated that he only read statements from some NEC members and lawyer Makebi Zulu that no documents were served prior through the press.
Mr Nyangu said on April 27, 2014 around 14:10 hours while preparing for the meeting at the MMD secretariat, he was personally served by Messrs Milner Katolo and Associates what appeared to be an ex-parte injunction.
He said the injunction was granted by Judge Eddie Sikazwe restraining him from convening the NEC meeting on the same day and he acknowledged receipt.
Mr Nyangu said upon being served the injunction, he tried to call Dr Mumba on his mobile number but it went unanswered.
He then called Dr Mumba’s spokesperson Muhabi Lungu asking him where Dr Mumba was and informed Mr Lungu about the injunction.
He said later, Dr Mumba told him that he would go ahead with the meeting adding that while he was on the way to Kapingila house where the meeting was being held.
And Mr Mulusa has filed affidavit in support of summon for an order to join the contempt proceedings.
Mr Mulusa said that NEC members were surprised that on April 28, 2014, himself and four others, Dr Chituwo, Dr Kaingu, Dora Siliya and Tobias Kafumukache received disciplinary letters from Mr Lungu preferring charges against them demanding that they exculpate themselves within 10 days.
He said to avoid possibility of multiplicity of actions and to conclude the matter meaningfully, he needed to join the case because he believed that the notices of disciplinary action issued by Mr Lungu were illegal as he was appointed by an illegal meeting.

We have been told that the NEC meeting took place at MMD Secrtariat where he received the injunction.Why did Nyangu not serve the same papers to Dr. Mumba before the meeting started????

However,where in his submission does Nyangu state that he physically took the Court Injunction ( CI ) to the NEC meeting and showed it to any member of NEC.If Muhabi Lungu is to be believed,he stated that Nyangu was the one who distributed files to NEC members during the meeting but merely left after this assignment.So Bob,it is not a matter of being of fixed position brother but analyzing what happened.

There is no question in my mind that this good man turned rascal, short-circuited democracy within his political party; mainly to ward off an on-going campaign against him. The NEC meeting was called out of desperation as a way to incapacitate his opponents; who had determined that they had had more than enough of his petty politics and were absolutely resolved to fight for his demotion from the party presidency. It would seem though that his initiative may have backfired and the fight is still on. Cutting corners is not the best way to win a race.
Jerry: Am humbled by your response. At least we still have people who can debate with sober minds. However, i still believe both camps have not handled the rangles in the MMD as expected from mature people. Two wrongs never make right. Abrogating the law with impunity is not the best way of resolving the current issues in the former ruling party. For me, it is like Dr, Mumba was in a hurry to push his own director of communication in a vantage position so that he can easily deal with the Kaingu group. Now it seems this has backfired. you cant disregard the injunction on the pretex that it was issued on saturday or sunday when this is a normal practice world over. Judges work 24/7.
Even recording phone calls this has been a big plot but God shall expose it for the sake of the innocent team.
These activities in the past few weeks have clearly not been about failed leadership but rather about petty jealousies and other factors. In life people will reap what they sow to the innocent team be strong and courageous this too shall pass and make you stronger.
Has Mumba been found quilty of contempt by a lawful court? Zambian educated people are to quick to response this is why country is where we are. There is no need to rush to inclusions based on evidence or affidavit sworn by one person. Have you read the affidavit in defence sworn by the opposing side? Wait for the judge to pass judgement. The guilty can only be confirmed by the learned judge.
The courts are supposed to discharge justice and they need to be respected. Nevers disrespected the Courts by ignoring the injunction. Why kind leader is he who behaves is above the law before he becomes even state president? Nevers behaves like Sata, no respect for the law. He is a bad egg. While people are saying Kaingu and Team are sponsored by PF, I would like to contend that it is actually Nevers and Muhabi who are sponsored by Sata. Sata is close friends with Muhabi’s father Mkhondo Lungu. People are being taken for a ride by believing that Kaingu, Chituwo, Mulusa and Siliya are supported by PF. The ones supported by PF are Nevers, Lusambo and Muhabi. Watch this space!
