The Lusaka High Court has upheld the 12 months sentence slapped on PF Mufumbwe Member of Parliament Steven Masumba by the Magistrate Court for using a fraudulent accounting diploma to obtain employment.
Delivering judgement this morning, Lusaka High Court Judge Chalwe Mchenga said the lower court proved beyond reasonable doubt that Masumba obtained pecuniary advantage when he was employed as a lecturer at Lusaka Business and Technical College.
Judge Mchenga said Masumba was not supposed to graduate from the National Institute of Public Administration as he had failed in basic accounting and did not sit for the auditing and taxation paper.
And Masumba’s lawyer Mutakela Lisimba has disclosed that he will appeal against the judgement in the Supreme Court.
Masumba who was visibly disturbed with the judgement waved to his family members as he was being led to the holding cell at the Lusaka High Court.

Government needs to set up a qualifications verifications agency to authenticate all qualifications obtained both abroad and locally to avoid fraudulent people getting jobs meant genuinely for qualified Zambians.
My observation is most of those engineering managers that manage foreign companies do not have right qualifications to qualify as engineering managers. Unfortunately, some forge certificates and pay bribes to be registered with EIZ so they can be allowed to practice engineering. This is very dangerous.

Ok – Masumba can appeal just to drug the case to 2016 so that he can get his full parliamentary gratuity.
Otherwise my advice to him is that go to jail, serve the 1 year sentence and be free of this issue afterwards.
The only down side is that you will have a criminal record which means you lose your parliamentary seat and you will not be able to stand again in 2016. But yet again, you have become quiet popular so you can be appointed into foreign service or any other important position within government.

Spot on Mwamoneni. The case is a straight forward one and the result of the appeal to the supree court is already known just like today’s high court judgement was already know. The prosecution has proved the following which Masumba has not disputed:
1. Masumba did not meet the requirements for the diploma he got
2. This was known by Maumba at the time of graduating and the onus was upon him to return it to NIPA registrar
3. Masumba used the impugned diploma for obtaining employement at Lusaka Trades School ( Obtained percuniary advantage).
The above three elements form the offence of ‘obtaining percuniary advantage by false pretence’ for which he has been convicted.
Masumba is just buying time, but i don’t think it can go up to 2016 looking at the simplicity of the case.

The idea is to drag the case. By the time the Supreme court will be upholding the sentence, it will be over one year and the sentence will be effective the date he was first sentenced and by then he will not even need to go to prison. Its a game for the rich………….

..this case goes beyond Masumba…..What picture does this case create especially across the boarders..??…Employers will be very sceptical with our qualifications especially those across the borders. You enclose your Certificates/Diplomas in your application…as long as Zambia appears on the document, Masumba’s case shall always overshadow one’s CV in employer’s mind and immediately trigger sense of doubtfulness if at all those Certificates represent the genuine qualifications of the candidate…. I can assure you that
I once worked for an educational institution in Lusaka where we were processing on average 10 requests from South African employers about Zambian certificates. Sadly on average 4 out of 10 were forgeries…

Iwe! When you are overpaid you are supposed to notify the pay office. When you are given a certificate you do not warrant you are supposed to notify the Registrar and not accuse him when you are CAUGHT! Ala!
What a relief! For a second I thought this guy would go scot-free. I know he is apt to appeal to higher court but if he is not careful the final sentence will be passed against him when PF is out of power and it will likely be double time for wasting the courts’ time.

NIPA must also come clean on this matter, basic accounting is a fundational paper which leads to advanced accounting. You cannot do advanced accounting before passing the basic accounting paper. How did he procees without somebody noticing this?
