The Lusaka High Court has declared that Justice and Defence Minister Edgar Lungu was duly elected by the Extra-ordinary General Conference which was held in Kabwe over the weekend.
After hearing the matter this afternoon, Judge Mugeni Mulenga ruled that Mr Lungu was duly elected as PF President.
The court also prohibited any defendants whether by themselves or their agents, candidates, superiors, or subordinates be restrained in perpetuity from purporting to have been elected as Party President, other than Mr Lungu.
The Court heard from new Secretary General Davies Chama who instructed his lawyers, Messrs Mosha and Company to enter into a consent Judgement.
On Monday 1st December 2014, Lusaka High Court, through Justice Mulenga issued an injunction against the holding of a General Conference by Acting Secretary General, Bridget Attanga, her agents, her superiors or her candidates.
Bridget Attanga or her agents proceeded to hold the Conference in defiance of the court order and in defiance of the restraints by the court.
Because of this, newly elected PF President Edgar Lungu fired Bridget Attanga and her deputy Anthony Kasolo.
In her place, Mr Lungu appointed Davies Chama.
Mrs Attanga and Mr Kasolo did not contest their dismissals.
As new Secretary General, Davies Chama chose to reconcile the party on the issue of the General Conference and appointed lawyers and hammered out a consent that was brought before court.
The Court gave an order of Judgement that declared that Mr. Lungu was duly elected.
Meanwhile, Matero MP Miles Sampa has sued Mr. Lungu to restrain himself from performing his functions.
This matter was referred to Justice Mulenga.
A consent judgement cannot be appealed to.
Edgar Lungu is this weekend expected to kick off his campaign with a rally at Freedom Park in Kitwe on Saturday, and another rally in Mansa on Sunday.

Truthful and what a pity, PF failed to follow their own constitution. Both Sampa and Lungu are PF’s illegal presidents. Even though Sampa’s election was genuine but quashed by the court injunction, apparently with corruption involved. As for Lungu, it was raising hands up without the initial voting. Moreover, the other candidates where not part and parcel of “picky pickiner picky doli” or picking a class monitor.
Only a convention presided by the PF party president, of which its Dr Scott, he and others where not in attendance.
In short, both PF & MMD have illegitimate presidential candidates.

Firstly you would have to prove to the courts that you have standing but secondly and more importantly the courts are going to cite Lewanika Vs. Chiluba and Lungu still wins.
Your deal would only work at party level if you were a PF member, after the party levels are done away with, at national level the Republican Constitution kicks in including other stare decisis precedents.

We would like to see peace and a proper contest between PF and the opposition so that if PF has to loose they loose without excuses of internal wrangles bla,bla.Even if by now some damage has already been done, it can be repaired. My understanding is that both PF conferences were possibly irregular
Talking about irregular conferences? Zambia is irregular at the moment based on what is being portrayed to the outside world. Are things ever going to be normalised in Zambia or do we need the two folks HH and EL to consider forming a Government of National Unity in the interest of the nation that has suffered so much in recent times. The two young men can rise above personal interests and help regularise the mess the country has been subjected to in recent times. Am no constitutional expert but the events of last few months can only be solved by some radical measures to be spearheaded by the judiciary and or legislature (or a special committee of the two). The Executive has polarised the nation and the country is in a mess Nationally and Internationally. RSA did it so can we.

3.Returning Officer was appointed by Dr Guy Scott
4.They formed the quorum

6.Dr Guy Scott approved this conference though he didn`t attend.
7.This conference passes the test of reasonableness. Edgar and the group waited for Scott who was right in Kabwe to officiate but, he deliberately played delaying tactics which attract a red card from the courts of law.
8. The police report says the venue was full of peace on 29& 30th.
9. All presidential aspirants were invited albeit only Edgar obeyed.
10. The office of the President was declared vacant in a right way.

No one punishing PF, it is called democracy … It is not perfect but it is the closest thing we have to self-rule. Now I can punch holes into the system all day if I want but it functions even as dysfunctional as it gets.
Secondly, the learned Judge Mulenga issued a “Consent Judgment”! These kinds of judgments bear no right to appeals once issued at High Court or Supreme Court level. Lungu being of a legal mind has summarily completely undercut Sampa by requesting for a consent judgment.
The only thing left for him is to now make nice with Lungu, he is now his Party President whether he likes it or not. He’s still young and if he aspires to the presidency, he needs time and grace to play smarter than he’s doing now.

The Zambian Judiciary is corrupt. How do you enter a consent judgement without the people who are sued? Edgar sues Atanga and Co and a judge goes and delivers a consent judgement with Lungu’s agents Davies Chama and NOT Atanga and her agents. Absolute corruption. “Consent Judgement” means that the parties have reached an agreement outside Court and the Judge only “confirms” that agreement so that it stands and desposes of the case.
So without Attanga’s Lawyers agreeing to this, there is not “Consent Judgement”.
It is only a fo0l, like Scott, who would be argue that Sampa is an elected President if the returning officer has said that “I did not declare Sampa a winner”.
Therefore, in this case it is your mind that is corrupt.

The returning officer did not declare Sampa as the winner because there was an injunction served on the event.
He can still be declared the winner if it is proved that injunction was out of order or illegal, gain under the Courts.

It is because Atanga never appealed the dismissal which in itself means she has consented in absentia by law. Furthermore, the declaration by the returning officer at the 2nd PF convention that he did don’t declare Miles Sampa a winner because a quorum wasn’t met was the final nail in coffin.

Please check the dictionary and understand what “consent” means. The article does not say Judgement in absentia. It says “Consent Judgement” and that means that both parties to a case have agreed outside court and the Judge agrees and disposes of the case.

Apologies if I came out to harsh in my post at 16.1 and like you, I am neither pro-Lungu nor Pro-Sampa. But a Consent Order is the most fair way of resolving issues because it is not necessarily made by the COURTS, but drawn up by the Lawyers of both sides. The Court (Judge) only rubber stamps the agreement if it looks fair.

against the holding of a General Conference by

the Conference in defiance of the court order and
in defiance of the restraints by the court.
Because of this, newly elected PF President Edgar
Lungu fired Bridget Attanga and her deputy
Anthony Kasolo.
In her place, Mr Lungu appointed Davies Chama.
Mrs Attanga and Mr Kasolo did not contest their
dismissals.
As new Secretary General, Davies Chama chose to

Lusaka High Court Judge Mulenga Mungeni was Wednesday afternoon duped by the Edgar Lungu’s team to sign a fake and faulty consent judgement.
Meanwhile, Lawyers representing Matero Member of Parliament Miles Sampa are tomorrow expected to file in an application to set aside the faulty and fake consent Judgement that Judge Mulenga Mungeni was duped into signing.
A consent order is a judgment signed by parties to a court case agreeing to end the case. The parties agree outside court then go to court for the judge to endorse it and withdraw the case.
In this case, the parties in the matter in court are Edgar Lungu, Inonge Wina, Davies Chama and others on one side; on the other side is Miles Sampa, Bridget Atanga and others. A consent judgement in this case can only be signed when Lungu…
The serious issue now is, WHO KILLED RUTH MBANDU? Contestant Edgar Lungu MUST reveal the name of killer(s) and everyone involved? No more masobela.
A consent judgement means the other aggrieved party has agreed to the terms but how can Chama who was appointed by Lungu give consent, it was supposed to be either Bridget Attanga or Miles Sampa,” one lawyer said.
Meanwhile, the Lusaka High court is tomorrow expected to set aside the dubiously obtained and questionable consent Judgement as Miles Sampa’s lawyers were by Press time preparing documentation.
This is the level of desperation the Lungu camp has reached. They go to the extent of deceiving a judge.

Its Like the operations of our courts is it one man or its a team of learned judges who study the matter and issue a well informed opinion
Clearly the Judge in this case knows the due process and he exercised his judgement well informed unless he was negligent and negligent in this case calls for professional sanctions as its too gross not to notice the process
I know though that the judge exercised diligence and due care before announcing the judgement to the floor
Sometimes courts should bring sanity by avoiding intended injunctions that refuses the outcome always or beating the courts or gaming the courts carefully
Unlike engineering, law seems to be abstract. If law was a physical science, engineers would employ vector calculus to solve PF’s problems, but alas, law is neither here or there. The only real solutions are engineering. Look at the dams, aircraft, space crafts, etc all real. Now compare with the Lungus and the fake judges. It appears they can switch laws at will.
If I know my fellow Zambians in PF (and I think I do) they will brew such hostilities between the Lungu camp and the Sampa camp that which ever man comes up on top on election day will leave supporters of the other man so peeved that they will rather withhold their vote or even vote for the opposition. Either way the opposition is looking good at this point.

Its simple PF and other parties like UPND have constitutions in place even Zambia has, the courts simply have to determine that before issuing or granting an injunction
Though I have studied and grossed over commercial law and some civil and torts, I know that in some cases injunctions are not even necessary because most of these entities confirm to some form of common governance that should be read and a declaration judgement is made

Our courts need a complete overhaul. The levels of corruption are highly conspicuous for all to see. This is embarrassing to our justice system
If you have a constitution that you have enacted and its full proof where obtain an injunction on constitution issues why not seek the court to declare according
Should people be using the courts to hide buy time and unjustly disadvantage others in the due process when its clearly determined in the constitutions
If an injunction has to be made it has to be on serious matters normally grey to all otherwise other sanctions and remedies must provide within the parties as enshrined by themselves
The key is for the constitution to be all thorough and avoid cheapening and thinking that politics is all courts and legalities

One does not need to open his/her eyes to see why UPND sponsored Zambian Watchdog has not publicised the declaration of Edgar lungu by the Lusaka High Court as the legally elected PF President because they know that HH will lose to EL in the forthcoming Presidential bye elections. Why is it that the so called ZWD has come out forcefully to write negative and unsubstantiated stories about EL instead of concentrating on the campaign trail of HH. Please ZWD and your UPND supporters be objective in what you write about Edgar Lungu because you know very well that your HH will have to work extra hard to ursup the support EL has countrywide as compared to your regional support of a few provinces only.

I have read all comments and it seems HH supporters would be comfortable with Miles Sampa . Now they are sweating with Edgar Lungu.
HH must sort out the problem of concentrating on one province, one who takes copperbelt province wins the elections. I doubt if HH has done enough work here.
On the contrary HH will find it easier to beat Lungu than Sampa. As of now Copperbelt is a 50/50 case. HH will get Copperbelt rural and Lungu may get Copperbelt urban. But then Lungu still has the hurdle of the parentage clause in the constitution to contend with. Sorry, I forgot that in the Zambian judiciary under PF anything goes.
