The Supreme Court has sent back to the Lusaka High Court the case in which Matero Member of Parliament Miles Sampa challenged the consent Judgement that declared Defence Minister Edgar Lungu as PF President.
The Supreme court said that Miles Sampa should be joined to the case because he had locus standi or sufficient interest as demonstrated by the Consent Judgment.
Sampa’s interest only arose when Bridget Attanga was replaced by Davies Chama.
Attanga was not served as the Court Injunction was only served on Anthony Kasolo.
The full bench of the Supreme Court ruled that Judge Mulenga misdirected herself when she ruled the matter exparte.
The full bench ruled that a respondent can be joined to a matter even if a consent judgement has been delivered.
The Lusaka High Court will now have to determine whether or not Miles Sampa should be joined in the Consent Judgement.
Defence Minister Edgar Lungu will remain the PF’s Presidential Candidate.
Miles Samoa has been allowed to be joined to the matter of the consent judgement and the case has now been referred back to the High Court to be heard by the same Judge Mungeni Mulenga.
This means that Miles Sampa can now file in fresh submissions challenging the consent judgement which declared Edgar Lungu President. Lungu is however free to file in his nominations this Saturday.
However, with only less than a week for nomination filling for a PF candidate, it is not clear if Miles Sampa can file in a fresh injunction stopping Mr Lungu from filling in his nomination.

I believe the High Court now needs to Hear this Matter on Wednesday and Pass a Final Judgement on Thursday. Now that the Supreme Court has made this ruling Miles Sampa can file an injunction to restrain Lungu filing in his nominations till the case is determined by the courts. Lungu has messed himself!
The case here is not an injunction to restrain EL for nomination, its to be joined to the case that was closed already. And if it has to be opened it will be another request and process. Any injunction can be raised but the High court can throw it again and back to supreme court. And a round robin sets course.. Till 2017

At this stage Miles has lost it because Edgar will go ahead and file in his nomination and finito. Who will stop him thereafter? The best Miles can do is wait and consolidate his presidential ambitions for 2016. Trying is good but for the sack for prosperity, let the dust be as it is now.

1. Supreme Court did not consider Lungu eligibility to be PF candidate;
2. Supreme Court considered ONLY application of Sampa related to the wrongs of Consent Order and ruled in his favor and
3. Sampa interlocutory application was thrown out by High Court because of Consent Order which now has been thrown out giving Sampa opportunity to reapply.
As a matter of fact, Supreme Court did NOT make any pronouncement as to who is PF candidate.
It has become crystal clear that Miles (Kilometer) Sampa is a PARROT programmed to sing the verses tuned-up by Guy Scott, Mmembe, Mutembo Nchito (in background), Masebo.
We know that Miles Sampa is a close relative of the Late President Sata (MHSRIP) whereas Guy Scott is said to be a childhood friend to Mr. Sata. We take note also that Christine Kaseba was a legal wife to Sata.
Why is it that Sampa, Scott and Kaseba are in the forefront to KILL the PF which was formed by Sata. Yet it has to take persons that are not blood relatives of HE President Sata to uphold Sata’s vision by sustaining the life span of the PF party.
Our political reading of the games being orchestrated by Sampa on behalf of Guy Scott clearly entails placing spanners in the works of the PF = KILL IT.

The issue at hand was whether MS could be joined in the consent judgement. The issue of who will be PF presidential candidate never arose at all. EL is the PF presidential candidate. If the Supreme court confirmed that for now EL is the presidential candidate from the PF, how can a lower court issue an injunction restraining EL from filing in his nomination papers as Presidential candidate from the PF?
Tray again, there was also interlocutory application whose hearing was refused because of the content of Consent Order (NOT judgement). If the Consent Order was defective, and Supreme Court said so, there is nothing to prevent MS to reinstate interlocutory application.
