A 24 – year – old adulterer of Chebele village in Senior chieftainess Chungu of Luwingu district in the Northern province is battling for his life at Luwingu district hospital after being axed on the head by the husband of the woman he is accused of having an affair with.
Northern Province Police Deputy Commissioner Lackson Sakala and Luwingu district police station Officer in charge Mwelwa Sampa both confirmed the development to ZANIS in Luwingu today.
Mr Sakala said that Major Kaoma 24, was axed on the head by Chitoshi Bwalya 37, who caught him committing adultery with his wife in the couple’s matrimonial house yesterday morning, barely 10 days after his wife gave birth.
It is also reported that Chitoshi has been in marriage for 9 years and has five (5) children with his wife found committing adultery with another man yesterday.
“They got married in 2003 and everything was going well until sometime last year when Kaoma came into their lives. When he complained about him, his wife, told him (Chitoshi) his that she wanted to have a brown son.”
Reports reaching the local police station revealed that suspicions of the relations became prominent when Docas Bwalya 24, (Chitoshi’s wife) gave birth to brown a child amplifying rumours that Kaoma was the father.
“He tried to advised the young man to distance himself from his wife but he wouldn’t listen. Instead, the more time he spent with her, the more she became hostile and abusive towards Chitoshi but yesterday the husband found the two committing adultery barely 10 days from the time Chitoshi’s wife gave birth,” Mr Sakala added.
Mr Sakala said Chitoshi was at his maize field when Kaoma approached him saying he was going to Mumba village in the same chiefdom, but he was tipped that whilst he is at the maize field, Kaoma quickly rushed to his home.
Kaoma did not know that his tricks were already tipped to Chitoshi who followed him behind at a distance.
When Kaoma entered the house, Chitoshi was waiting listening to their conversation until they decided to have sexual intercourse.
After a while Chitoshi forced open the door and found Kaoma in the act and, without wasting time Chitoshi picked an axe and axed Kaoma on the head and the accused victim was saved by people who gathered around to witness the commotion.
Mr Sakala further said that Chitoshi surrendered himself to police after realizing that he had made case and while there he explained the ordeal to the police officers who later arrested him for assault.
Police have since arrested Chitoshi for assault case contrary to the laws of Zambia and will appear before Luwingu magistrate court soon.
Meanwhile, Docas said she loves both of the men in question.
The opposition MMD has denied owing any sums of money to the Bank of Zambia and NAPSA.
The two public entities are all seeking colossal sums of money in debt held by the former ruling party.
This week, the central bank it was seeking to recover over K4 billion which the MMD owes while NAPSA filed a law suit demanding the payment of over K90 million for failure to refurbish its former headquarters at the NAPSA Lusaka House.
But MMD Vice President for Political Affairs Michael Kaingu told a media briefing in Lusaka Tuesday that some disgruntled elements working with expelled National Secretary Major Richard Kachingwe are the ones behind such attacks on the party.
“We are perpetuated by the happenings in our country today. There are some people that are throwing mud at our party. I want to categorically state that the MMD does not owe the two institutions any amounts,” Dr. Kaingu said.
“There are no judgements against the MMD involving these two institutions. What is been portrayed in the media is just sour grapes and malice from disgruntled persons.”
He appealed to MMD members countrywide to dismiss these allegations with the contempt it deserves and continue reorganizing the party.
Dr. Kaingu also strongly condemned the arrest of MMD leader Nevers Mumba and four MP’s on the Copperbelt.
Meanwhile, MMD President Dr Nevers Mumba and seven others failed to meet bail conditions so they have been remanded at Kamfisa. Irene Kunda who is acting for the accused confirmed that due to lack of time, they failed to meet the conditions set for bail.She will reapply tomorrow morning. The conditions are K2 million each with two working sureities
The Patriotic Front says it will take action against any of its members in the province that will be found to be working against the interest of the party or secretly working with other parties.
This resolution was brought to a close following the PF provincial consultative meeting held on Sunday 9th December 2012.
In a statement availed to ZANIS in Lusaka today, Lusaka Province PF Chairperson Geoffrey Chumbwe said the consultative meeting reaffirmed the importance of unity in the party.
Mr Chumbwe observed that despite reaffirming the importance of unity, some Ministers, Members of Parliament among others were serving interests other than those of the party.
“As Lusaka Province, we therefore call on the party leadership to act decisively and deal firmly with those betraying the party”. He said.
Mr Chumbwe stated that there is no reason for the PF to continue keeping people whose loyalty had shifted away from the party.
He said Lusaka province therefore recommends that those who will not repent be expelled from the party.
“It is our view that it is not in the interest of the party for leaders to abuse their positions for the purpose of advancing their selfish interests instead of serving the country,” he said.
He emphasized that his provincial party wants President Sata to go for a second term in 2016.
The Provincial Party Chairperson has since urged all loyal members to work towards that objective by mobilizing the party and ensuring that the government succeeds in fulfilling the PFs development agenda.
President Michael Sata today met 26 Chiefs from six districts in Muchinga province to discuss among other things developmental projects to be executed in their chiefdoms.
The traditional rulers who were present at State House include Senior Chief Kopa of Mpika district, Senior Chief Kambombo of Chama district and Chieftainess Nawaitwika of Chinsali district.
Others Chiefs that were drawn from Chama, Chinsali, Isoka, Mafinga and Mpika district were chiefs; Chibesakunda, Chewe, Chikwa, Chifunda, Chikwanda, Kabanda, Kabinga, Kafwimbi Katyetye, Luchembe, Lundu, Mubanga, Mpepo, Mpumba, Mukungule, Mukwikile, Mulilo, Muyombe Mwenewisi, Mwenechifungwe, Nabwalya, Nkweto and Tembwe,
The President also took a photo session before holding private talks with the traditional leaders.
The rest of the meeting, however, was closed to the media.
The Head of State has also held similar talks with chiefs from two other provinces namely Eastern and Southern provinces respectively.
Chiefs and Traditional affairs Minister Nkandu Luo, Muchinga province Minister Charles Banda, Chinsali District Commissioner Evelyn Kangwa and Muchinga province Political Secretary Catherine Chama were also in attendance at the meeting at State House.
Information and Broadcasting Services Deputy Minister Mwansa Kapeya, Eastern province Minister Malozo Sichone, Home Affairs Deputy Minister Stephen Kapyongo and his Foreign Affairs counterpart Effron Lungu, Mafinga Members of Parliament were other parliamentarians who expected to attend the meeting but they could not because they were in parliament for the eleventh session which is sitting.
Muchinga province Permanent Secretary Charles Sipanje was also not present at State House.
Zanaco coach Keagan Mumba says the 2012 Faz Super Division champions should not relax when they face Mbabane Swallows of Swaziland in the CAF Champions League preliminary round.
The six-time Super Division champions host Swallows in the first leg on February 16 before travelling to Swaziland during the weekend of March 2-3.
Winner over both legs has a potential first round date with Orlando Pirates or Comoros champions Djabal in March.

A Kitwe Magistrate Court has set Christmas Eve, December 24 2012 as date for mention in the matter in which MMD leaders Nevers Mumba has been charged with unlawful assembly.
Dr. Mumba, four MMD MP’s and some senior party officials denied the charge when they appeared in court Tuesday afternoon.
They were released after paying K2 million bail each.
Kitwe Magistrate Penjani Lamba set Christmas Day as date for mention while trial commences on January 12 2013.
The MMD leaders had been in detention since Monday afternoon on grounds that they had addressed an illegal meeting in Lufwanyama.

Barrick Lumwana Mine Managing Director Boyd Timler says his company has employed 5 000 employees directly and 15, 000 other
indirect jobs to Zambians through contractors since it the company commenced operations three years ago.
And North Western Province Minister Stephen Masumba urged the mine to consider employing qualified Zambians in managerial positions.
Mr Timler said most technical jobs have been outsourced mainly from the copper belt due to lack of technical skills by local people surrounding the mining area.
He explained that many locals in the mine area hail from agricultural backgrounds as compared to their colleagues from the copper belt and other parts of the country.
This came to light when North Western Province Minister Stephen Masumba toured the mine in Solwezi yesterday.
Speaking earlier, North Western Province Minister Stephen Masumba urged the mine to consider employing qualified Zambians in managerial positions.
He said it was disheartening to see that mainly expatriates take up managerial positions at the expense of qualified Zambians, a situation he said must be revisited.
Mr Masumba was on his familiarisation tour of the giant mine in the province since his appointment as provincial minister by President Sata in November after he scooped the Mufumbwe Parliamentary by-elections as the first Patriotic Front Member of Parliament in the province.

The Law Association of Zambia (LAZ) has refuted claims made by President Michael Sata last week that the country’s Anti-Corruption Commission ACC needed permission from him to investigate senior party officials.
This is contained in a media briefing released to the media. According to LAZ, the assertion by his the President that the law requires ACC to get permission from him before investigating or prosecuting a party or government official is misplaced and wrong.
Last week President Sata castigated the Anti Corruption Commission for not getting permission from him when investigating senior party officials. He explained that by law the commission was supposed to get permission from him to investigate any senior party official. President Sata wondered why the commission was not approaching him to get permission to investigate senior party officials when the law is clear.

PRESS STATEMENT ISSUED BY THE LAW ASSOCIATION OF ZAMBIA (“LAZ”) AT LAZ SECRETARIAT ON
11TH DECEMBER 2012 AT 09:30 HOURS

The LAZ is mandated under Section 4(l) and (p) of the LAZ Act Chapter 31 of the Laws of Zambia (“the Act”) to seek the advancement of the rule of law and the rights of the individual and to do all such things as may be necessary for the attainment of its objectives set out in section 4 of the Act. It is against this background that the association deemed it necessary to issue this statement in the face of recent events and occurrences in the Nation indicative of a breakdown of the rule of law. Sadly, these events and occurrences have, by and large, been orchestrated by the Executive arm of Government in apparent abuse of the power and authority vested in it.
Of particular concern to LAZ are the following:
1. Corruption matters:
The attention of the media and the general public has recently been drawn to the investigations being carried out by the Anti Corruption Commission (“ACC”) with respect to two very senior members of the Government, namely the Honourable Minister of Justice Mr W. Kabimba S.C. and the Honourable Minister of Defence Mr Geoffrey B. Mwamba. On 4th December 2012 we issued a statement condemning the behaviour of the Minister of Justice with respect to this investigation as it was a mockery to the justice system.
Subsequently, His Excellency the President of the Republic of Zambia, Mr Michael Chilufya Sata was quoted by a wide section of the media supporting the actions of his Minister of Justice in defying the intended interview at the ACC and declaring that he would not suspend either of the two Ministers facing allegations of corruption until it is proved to him that they are guilty of the acts complained of. His Excellency further stated that senior members of the party are not to be investigated and thus prosecuted without the investigative wings first obtaining permission from him.
LAZ wishes to reiterate that the actions of both the ACC and the Minister are inconsistent with what is expected of a well functioning institution charged with investigating matters of a serious nature such as the allegations the Honourable Ministers are facing. We maintain that the Honourable Minister of Justice erred by using his influence in the ruling party and in the Government to intimidate the investigating officers. This situation does not in any way assist in the dispensation of justice and LAZ reiterates its call that the Ministers involved should proceed on leave to allow for a free investigation which it is hoped will exculpate the Ministers. We equally call on the ACC to exhibit the level of professionalism expected of them in the execution of their duties.
On his Excellency’s pronouncement that permission ought to be sought from him prior to the commencement of investigations against senior members of the party (PF we assume), we wish to inform the public that no such provisions of the law exist. Even assuming that such a law by misfortune exists, LAZ wishes to state that such a state of affairs cannot be allowed to exist as it is a recipe for anarchy and is decidedly in contravention of the provisions of Section 3 of the Anti Corruption Act No 3 of 2012 by which the autonomy of the ACC is guaranteed. The assertion by his Excellency the President that the law requires ACC to get permission from him before investigating or prosecuting a party or government official is therefore misplaced and wrong.
We implore the Executive, for the sake of justice and good order, to observe the rule of law and allow the investigative processes and procedures to reach their natural conclusions without any explicit or implied undue influence from the executive.
2. Recent deportations:
LAZ has observed, with increasing concern, the use of the powers vested in the Minister of Home affairs seemingly to achieve ends that may not be in the wider interests of the general public. The perception that has been created by the recent spate of deportations and revocations of permits to remain in Zambia is that the power to deport is being used unlawfully against persons that are not in good standing with the ruling party or its close allies or associates.
The Executive should desist from these acts if indeed they are being perpetuated for the perceived purpose. LAZ appreciates that the decision in these circumstances is made purely in the subjective approbation of the Minister of Home Affairs. While this may be as it is, it is not in the best interests of the country. This type of conduct does little to improve the perception that the investor community will have of our country if it appears that the Government of the day is in the habit of maligning personalities and targeting deportations at companies that are not seen to be in “tow” with the ruling PF party.
To effect deportations without according the affected persons an opportunity to be heard flies directly in the teeth of Natural Justice. We are alive to the fact that the Immigration and Deportation Act does give the Minister discretionary powers but we are of the considered view that such powers must be used judiciously and it appears to us that this is not the case in respect of the recent deportations which have been widely reported in the media.
We have sufficient laws as a Country to deal with many scenarios and we implore the government to make use of such laws where an offence has been committed or is suspected to have been committed rather than effect unnecessary deportations. Proceeding in this suggested manner will promote the rule of law in that affected persons will be given opportunities to be heard and defend themselves. This is how we would expect Zambians to be treated should they find themselves in similar circumstances in foreign country
3. Stakeholder Engagement
The LAZ has noted that despite its numerous attempts to assist the Executive with the Governance of the Nation by offering its advice on matters of far reaching legal consequence the Executive has largely chosen to ignore LAZ on such matters in consequence of which the rule of law has either been jeopardised or put at serious risk. As a key stakeholder in the affairs of the State, LAZ finds the stance taken by the Executive most unfortunate.
The above notwithstanding LAZ will continue to contribute to the development of the rule of law in this Country by whatever means allowed under the law. We will were possible strive to partner with and work closely with the Government of the day on an apolitical and non-partisan basis but we must emphasise that in the fulfilment of its mandate the LAZ will not hesitate to seek redress from the Courts of law on any matters of National concern where government actions are clearly unconstitutional and go unremedied.
The LAZ is committed to fostering development and prosperity under the leadership of the Government but reiterates that the reasonable attainment of this goal can only be realised in an environment where the rule of law is respected and observed. We therefore urge the Executive to take corrective action now to avoid a total breakdown in the rule of law.
A rude shock awaits opposition MMD leader Nevers Mumba as the National Executive Committee is strategizing his early exit from the party, expelled national secretary Richard Kachingwe has disclosed.
Reacting to Dr Mumba’s statement that his expulsion was part of the rebranding process of the MMD, Maj Kachingwe said worse things awaited Dr Mumba in the party.
“My expulsion is part of his destructive moves and not part of his rebranding, like he claims,” Maj Kachingwe said.
Maj Kachingwe accused Dr Mumba of causing serious divisions in the party, which the NEC should raise to the occasion of defending the party’s Constitution.
“The NEC is not happy with the way he (Dr Mumba) has hijacked the party, and I will fight him until he goes. I have reliable information that the real NEC is working and planning his eventual exit, I am in touch with NEC members and I know what is happening,” Maj Kachingwe said.
Maj Kachingwe said in an interview in Lusaka yesterday that time was now for the MMD’s NEC to take decisive steps and get rid of Dr Mumba before it was too late.
Maj Kachingwe said Dr Mumba used his nominated NEC members to force his exit and wondered how NEC chairperson was failing to take a strong stance and guard the opposition from collapsing further.
“I am disappointed with the manner the NEC has failed to come out and condemn what is happening in the party and it is failing the party because they have to come out and condemn Dr Mumba. Whatever happens, if the NEC doesn’t take decisive steps to address this issue, they will not be forgiven by the general membership,” he said.
He added that Dr Mumba had failed to avoid the collapse of his two parties namely, the Reformed Party and National Christian Coalition, and questioned the leadership that he would bring to the MMD.
“I have stood firm against Dr Mumba and he knows it, I stopped him engaging in early campaigns for 2016 and I told him, he was not going to re-contest the position at the next party convention, I told him and as national secretary I had a duty to protect the party from infiltrators and that is what Nevers Mumba is, an infiltrator and a destructive person, look at what he has done in his two previous parties.
“I know people will say that, why did we allow things to go this far. I can only say that, at the time Dr Mumba came to the MMD, he was from the Foreign Service and we assumed as a former envoy, he would be a person of credibility and would not con his way into the MMD, but this assumption was wrong,” Maj Kachingwe said.
He added that the rebranding the MMD leader was embarking on was not yielding any positive results but aimed at being destructive.
“He wanted to bring the Zambia Shall be Saved slogan in the party, but we refused and told him that, we were not his flock,” he said.
He reiterated that Dr Mumba was surrounded by church pastors that were issuing orders on the running of the party and “they are the ones controlling the kite’s movements”.
“He is surrounded by pastors that are issuing instructions that is how things have seriously gone wrong. Nevers Mumba is just like a kite, and other people are controlling the strings, they are issuing instructions to party organs, if he challenges I’ll damage him,” he said.

Zambia Association of Chambers of Commerce and Industry (ZACCI) has awarded Airtel Zambia as the leading company in education support under the category of corporate social responsibility.
In a statement to ZANIS in Lusaka today, Airtel head of Corporate Communications and Government Relations Chabuka Kawesha said the award was presented at the ZICCA gala held at Pamodzi hotel last Friday.
Presenting the award, Minister of Commerce Trade and Industry Bob Sichinga said Airtel has been recognised for its sustainable support towards education under its corporate social responsibility.
Dr Sichinga said the award was presented as a gesture to show both government and private sector appreciation to the company’s commitment to vulnerable children in rural schools.
And Dr Kawesha thanked ZACCI for the recognition and award, emphasizing the importance of corporate support to the vulnerable society.
He said Airtel has so far assisted over 460 schools countrywide and pledged its support in line with the company’s corporate social responsibility project.

MMD Vice President for administration Brian Chituwo says it is cheap politicking for Mr. Kabimba to insinuate that some PF members are working with the opposition.
Dr. Chituwo says Mr. Kabimba should make the confidential matters he is talking about clearer because he understands that no well meaning leader can be careless in giving out certain information.
Speaking to QFM News, Dr. Chituwo says there is nothing wrong with ministers sharing their developmental programmes with any citizen because what makes up government is not the president and ministers but all citizens.

Meanwhile, MMD National Chairman Kabinga Pande says any party member opposed to the appointment of Kapembwa Simbao as acting National Secretary and the expulsion of Major Richard Kachingwe should use the right channel to bring out their concerns instead of using the media.
Mr. Pande says it will be wrong for any party member who has concerns over the administration of the party to use the media as a channel when the party has laid down procedures.
Speaking to QFM News, Mr. Pande says there is need for party members to desist from using the media as a channel to voice out on matters affecting the party as it will be inappropriate for the party.
He states that the leadership of the party is open to listen to any advice from any member of the party as long as it is passed on using the right channel.
Mr. Pande has since appealed to the membership of the party not to be demoralized by the happenings in the party stating that there is still hope to revive the party.
MMD President Nevers Mumba remains defiant and he is in high spirits after spending a night in detention at Kitwe’s Nkana East Police Station, his aide has revealed.
The opposition leader was arrested late Monday afternoon after paying a courtesy call on Chief Nkana at this palace.Dr. Mumba along with four MMD MP’s was scheduled to pay another courtesy call on Chieftainess Shimukunani when police officers intercepted them on their way back from Kalulushi and ordered that they drive back to Kitwe for questioning.
The four MP’s include Howard Kunda (Muchinga) Anne Chungu (Lufwanyama), James Kashiba (Kafulafula) and Mike Katambo (Masaiti).They were detained for allegedly committing unlawful assembly.

In an interview Tuesday morning outside Nkana East Police Station, Dr. Mumba’s aide Raphael Nakachinda said the opposition leader remains in high spirit despite the detention.
“He knows that this is the price that he has to pay on behalf of all Zambians and he has taken it well in his stride. We are here at the police station still waiting for further instructions as to whether we are proceeding to court or not.”
Nakachinda however denounced the dictatorial tendencies that President Sata’s government is using to silence the opposition.
“They are using every trick in the dictators manual to kill democracy and Zambians must stand up and say no,” Nakachinda said.
Bank of Zambia (BOZ) has now joined the bandwagon of institutions demanding money from former ruling party, Movement for Multi-Party Democracy (MMD). BOZ is seeking to recover over K4 billion which the former ruling party owes.
The Central Bank has on numerous occasions written to the MMD demanding the settlement of a total K4, 044,049,420 but the former ruling party has not responded to the demand.
This is according to a letter obtained by the Times of Zambia dated October 18, 2011, by BoZ Assistant Director – Regulatory Policy and Liquidation Norbert Mumba and addressed to the MMD National Secretary.
The BoZ is demanding for the K4, 044,049,420 owed to it in respect of MMD and MOPED Investments Limited, Commerce Bank Zambia Limited (CBL) and Meridien BIAO Bank Zambia Limited (MBBZ) both in liquidation.
“We write to demand settlement of outstanding debt owed by your party amounting to K4 billion. The breakdown is as follows, MBBZ K 2,801,150,684.93, Moped Investment Limited debt (MBBZ) K 798,348,493.15, CBL K444, 550,242.37,” the later read.

The letter was also copied to the Deputy Governor Operations, Director Bank Supervision, Liquidation Coordinator-Meridien BIAO Bank Zambia Limited and Liquidation Coordinator-Commerce Bank Zambia Limited.
The letter further stated that the MMD needed to make a prompt settlement of the debts and that it could call on Mr Mumba the BoZ official.
“You are no doubt aware that the Bank of Zambia and the former Liquidation Managers have on several occasions written and contacted your party seeking settlement of the debt but to no avail,” official correspondence between the BoZ and MMD further read.
But MMD vice president in charge of politics Michael Kaingu said he was not in receipt of the demand letter and charged that the Government wanted to ensure that the former ruling party was wiped out.
It was not clear whether the MMD would settle the over K4 billion debt as it had struggled to pay K400 million it owed the Registrar of Societies. It had so far only paid K300 million towards the debt.
Last week, the National Pension Scheme Authority (NAPSA) filed a law suit demanding the payment of over K90 million for failure to refurbish its former headquarters at the NAPSA Lusaka House.
The party had since been given a seven-day ultimatum in which to settle the outstanding amount.
Hosts Zambia is guaranteed five medals in boxing at the ongoing Zone 6 Youth Games in Lusaka after five out of its seven boxers qualified for Tuesday afternoon’s semifinals.
However, bantamweight Obedy Mutapa and Mbachi Kaonga both failed to advance.
