Government refuse to release RB’s passport despite court order

Former President Rupiah Banda
Former President Rupiah Banda

FORMER President Rupiah Banda has for the third time failed to travel out of Zambia, this time to Tanzania for the Global 2013 Smart Partnership dialogue after State agencies could not release his passport on Friday.

The former head of state was to join other former Heads of States at the Dialogue, and these include Benjamin Mkapa of Tanzania, Joachim Chissano of Mozambique, and Jerry Rawlings of Ghana who are bestowed with the status of Fellow Emeritus due to their involvement with the Smart Partnership Dialogue.

This followed a latest court order allowing him to be out of the country for four days.

On Thursday Lusaka High Court judge Anesi Banda-Bobo ordered the State to release Mr Banda’s passport after the former president filed inter parte summons to vary bond conditions, and for an order for release of the passport pursuant to Section 126(3) of the Criminal Procedure Court.

Justice Banda-Bobo’s ruling read: “The application to vary bail conditions is hereby granted, and the State is directed to release the passport to enable the applicant (Banda) to travel to Tanzania from 28th June to 2nd July, 2013. The passport is to be released into the custody of Mikatazo Wakumelo, one of the sureties who shall accompany him so that he surrenders the passport immediately upon return to the State.

“The government joint investigative team (GJIT) is ordered to release the passport for a period of four days only, from 28th June to 2nd July, 2013.”

But yesterday, Mr Wakumelo, who is also administrative secretary in the Office of the Fourth President, told the media that the passport has not been released.

“We are not travelling because the passport has not been released. He was supposed to travel yesterday [Friday] but when I went to the government joint investigative team, they told me to go to the Registrar General where I was told to go to the Chief Passports Officer. There I was told to go to the Ministry of Home Affairs but the permanent secretary [Willies Manjimela] was not there in the afternoon.

“So we are not travelling. We have not been given the passport and the former President won’t travel to Tanzania,” Mr Wakumelo said.

Last week the government cancelled Mr Banda’s passport because of the on-going investigations against him.

In her ruling, Mrs Justice Banda-Bobo noted that Mr Banda is a former President of Zambia and has roots embedded in the country as he deposed that he has properties.

“He has young children in Zambia. He has, on the basis of the above, not struck me as a flight risk. Further; the invitation is from a serving head of state of Tanzania [Jakaya Kikwete] who is hosting the Global 2013 Smart Partnership dialogue.

“According to the letter of invitation, the dialogue, being what it is, requires personal participation of the applicant. The applicant is on bail. All he is asking for is the variation of the bail conditions by the release of his passport..,” Mrs Justice Banda-Bobo said.

She said she has taken cognisance of the fact that even though Mr Banda is seeking variation by the release of his passport, the holding onto the passport by the GJIT was not one of the bail/bond conditions, the fact which was not disputed by the State.

This is the third time Mr Banda has been blocked from flying out of the country. In June this year, immigrations officers stopped him from leaving for South Africa to attend the 2013 African Presidential Roundtable at the invitation of the Boston University African Presidential Centre.

He has since commenced contempt of court proceedings against the immigration officers, contending that they acted against the court order that allowed him to travel out of the country.
Earlier in April 2013, Mr Banda was stopped from attending the inauguration of Kenya President Uhuru Kenyatta.

TODAY’S SCRIPTURE

“…Though it tarries, wait for it; because it will surely come…”
(Habakkuk 2:3, NKJV)

TODAY’S WORD from Joel and Victoria

If you will keep God first in everything you do, He promises that He is going to crown your efforts with success. Because you diligently seek Him, a reward is coming. Favor is coming. Good breaks are coming. Promotion is coming. A shift is coming. Healing is coming. Restoration is coming. It may seem like it’s taking a long time; you may feel like you’ve been holding on forever, but keep holding on. The promise will be fulfilled through faith and patience.

Waiting doesn’t mean do nothing; it means get prepared. Now is the time to get ready. God doesn’t want you to live an average, ordinary life. Because you depend on Him, He is going to increase you. You are going to bear much fruit. He is going to make you more productive. You’re going to get more done in less time. He is going to make your life easier and take you where you could not go on your own. It’s going to be greater than you ever even dreamed of. Get ready because it’s coming — every promise you’ve stood in faith for, every dream He’s placed in your heart that you’ve contended for is coming to fruition in Jesus’ name!

A PRAYER FOR TODAY

Father, thank You for Your faithfulness and goodness in my life. I know that through faith and patience I will receive Your promises. Help me to be ready; show me what to do so that I am in position to receive everything You have prepared for me in Jesus’ name. Amen.

Public media biased towards ruling party – Justice Ireen Mambilima

ECZ Chairperson Justice Ireen Mambilima
ECZ Chairperson Justice Ireen Mambilima

Electoral Commission of Zambia (ECZ) chairperson, Justice Ireen Mambilima, has observed that the public media have been abrogating the Electoral Code of conduct as it provides unbalanced coverage of news among political parties.

Speaking during a youth conference against electoral malpractice and violence under the theme, Support Peaceful Elections, Justice Mambilima noted that the public media have been biased towards the ruling party as observed in the 2006 and 2011 general elections.

She noted that even during the nominations for the Chipata Central Constituency by elections last Thursday, the public media covered the ruling PF while the opposition political parties were not covered.

Justice Mambilima said that the national broadcaster, ZNBC, only aired the filing in of nominations by the PF candidate, Lameck Mangani, and not the other four parliamentary hopefuls.

She stated that the ECZ intends to discuss the matter with ZNBC and noted that it was unfair for the media to show biasness towards one political party.

She, however, stated that the ECZ has not been experiencing such problems with the private media.

Meanwhile, Justice Mambilima has called on youths to promote peaceful elections as they go to the polls on July 25, 2013.

Justice Mambila said youths have a role to play to ensure elections are held in a conducive environment in the district by refraining from engaging in violent activities which could influence apathy.

She said the commission has notice that most youths are vulnerable as they are used as tools of violence during elections.

“You should not allow them to use you to settle their political scores. They cannot allow their children to engage in such activities because they know it has repercussions,” she said.

Justice Mambilima stated that the commission is committed to ensure violent free elections by engaging youths in the electoral process, adding that they should also encourage others to register and also participate in the elections of the country.

She said youths were the future of the nation such that they should be responsible to uphold the peace the country was enjoying.

Justice Mambilima said youths should be ambassadors of peace and stressed the need for them to share the knowledge acquired from the interaction with their colleagues who did not have the opportunity.

“When you engage in a violent acts, you scare away voters, hence the need for you to desist from violence during campaigns and to the run up to the polling day,’’ he added.

Justice Mambilima also urged all political parties to be tolerant with each other to avoid misunderstandings characterized during elections by engaging in issue-based campaigns.

She said there is need for tolerance among political players, adding that she expected violent-free elections in Chipata central.

Justice Mambilima said the forefathers already shed blood for the country and that there was no need for youths to die but what was required is to consolidate the democracy that the country was enjoying.

And Justice Mambilima said ECZ is an independent body that does not succumb to pressure from both the ruling and the opposition political parties.

Justice Mambilima said the commission enjoys being an autonomous electoral management body promoting democratic governance by conducting elections according to the law.

And speaking at the same function ECZ Director, Priscilla Isaacs, said the when the commission met traditional leaders earlier this week, chiefs raised a concern of youths who were being ferried from town during campaigns.

Ms Isaacs said the chiefs complained that drunken youths from town caused violence in rural communities during times of elections.

She said from the meeting it was expected that the youths would come out untied.

Defending champions Zanaco on Saturday eased to a 2-0 win over Konkola Blades in the FAZ Super Division Week 13 match at Konkola Stadium in Chililabombwe.

First half goals by strikers Davies Mwape and Aubrey Zulu propelled Zanaco to their first away victory at Blades since 2003.

Mwape netted a long range cracker on 15 minutes after pouncing on a loose ball headed by Blades’ Micheck Chaila.

Zulu doubled Zanaco’s lead with a 25th minute goal after beating an offside trap erected by the home side’s backline led by Amos Simwanza and Kerry Sichilya.

Zanaco had Mwape’s 62nd minute goal ruled out for offside by Mufulira referee Francis Lombe.

This is Zanaco’s second win in a row having beaten Nkwazi 3-1 in last weekend’s match in Lusaka.

Meanwhile, midfielder Isaac Chansa was not in the Zanaco team, that travelled to Chililabombwe, for unknown reasons.

Zesco put Nkana in their place

22

Zesco United rallied to beat Nkana 3-1 and replace the kitwe giants at the top of the FAZ Super Division table.

A brace from striker Wnston Kalengo silence boastful Nkana to leave the former leaders reeling to their second loss of the season.

However it was nNkana who took the lead in the 46th minute through Festus Mbewe.
Sadly the lead was all but just an illusion when Kalengo equalised in the 53rd minute.

Kondwani Mtonga extended Zesco’s lead in the 74th minute with an effort from the edge of the area.

Kalengo silenced Nkana with his second from close-range and set the record straight that it was actually a two-horse race come week 30.

Mailoni brothers buried

22

The three infamous Mailoni brothers, who were gunned down on Monday, June, 24, around 15:00 hrs, have been buried.

Kabwe District Commissioner, Patrick Chishala, confirmed this to ZANIS in an interview this morning.

Mr Chishala said the three brothers were buried, yesterday in Kabwe around 17:00hrs and that they were accorded a burial befitting their status as criminals, who had gruesomely murdered more than 12 people in the interior of Luano Valley.

He, however, appealed to the public not to demonise the surviving family of the deceased brothers which includes their mother, Janet and brother Nelson.

He further appealed to the people of Luano, who migrated to other villages for over seven years, to get back to the area, which has now been upgraded to a district level and help to develop it.

Mr Chishala said government will ensure that development is taken to the district because the chapter of the Mailoni brothers is now permanently closed.

Government bans payment for tuitions

38
Dr JOHN PHIRI
Dr JOHN PHIRI

Government has with immediate effect banned paid-for public tuitions in learning institutions.

Education Science Vocational Training and Early Education Minister, John Phiri, announced the ban on paid-for public tuitions in all the schools in the country on Thursday when he graced the inaugural Provincial Careers Day Exhibition and official launch of the Campaign against Malpractice in Zambia held at Mpika Boys’ Secondary School in Mpika district of Muchinga Province.

Dr. Phiri said with immediate effect, no school shall be permitted to hold tuitions in holidays or during weekends unless such tuitions will be paid for by the school and will involve all the schools.

He, however, said internally arranged tuitions which attract no cost at all to the pupil are encouraged.

Dr Phiri observed that paid-for public tuitions in schools disadvantaged pupils from poor families.

The minister also warned that no school, government, private or Missionary, will host learners from other schools to provide extra tuitions unless that particular school organizes its own pupils using the school money.

Dr Phiri also announced that with immediate effect all class teachers from Grades 8 to 12 shall avail subjects’ syllabus to all the pupils at the beginning of each term.

He said subject teachers should write the syllabus on the board for the pupils to copy or give them hand-outs of the syllabus if resources are available so that they (pupils) can know what they are supposed to cover in that particular term.

The minister has since directed all head teachers to ensure that the directive is implemented, adding that the move would help the school administration to effectively supervise the teachers in their respective schools.

Dr Phiri also called on the pupils in all the schools to ensure that they report to the school administration through their class monitors or prefects any teacher failing to finish the syllabus in that particular time.

He warned that any teacher failing to finish the syllabus of particular terms will be charged accordingly.

“We want to completely do away with examination malpractices in the country. Government will not allow a situation where pupils learn only 3 subjects out of 18 in a year. The genesis of the examination malpractices is failure by the teachers in respective schools to finish the subjects’ syllabus forcing the pupils and the teachers as well to find other alternatives means of ensuring that they pass the examinations, “said Dr Phiri.

Dr Phiri charged that government can effectively stop the examination leakages if teachers diligently delivered their lessons and pupils’ diligently accepted that deliverance.

He further warned that any school head teacher whose school persistently reports cases of examination malpractices must be charged and that the punishment should include a demotion for the head teacher who will be found wanting.

On Provincial Mock Examinations for Grades 7, 9 and 12 classes, Dr Phiri said they must be consistently be done on time to allow the Provincial office reflect on them and make a decision, adding that best performing head teachers and their staff must be rewarded.

And government says it remains committed to providing quality education to all its citizens. However, said that the state is concerned about low literacy levels which are currently prevailing in the country.

The Education Minister noted that the current situation with regards to the literacy levels, if left unchecked, has the potential of denying the learners full participation in quality education.

Dr Phiri said reading skills are important to children s success in school and work, saying reading can be a fun and imaginative activity for children which he said opens doors to all kinds of new world for them.

And in launching the Provincial Careers day exhibition, Dr Phiri said government attaches great importance to the need of having an effective guidance programme aimed at preparing youths for future roles and productive lives.

Dr. Phiri said it is common knowledge that today’s learner is seen as a developer needing not only academic knowledge but also information about the world of work.

He said that there is vital need to prepare young people about the realities of employment situation to help them relate knowledge and skills acquired in education to their lives after school.

Dr Phiri said he expect teachers to guide pupils in terms of subjects that can help them meet the required qualifications or grades without any destructive motive, adding that humiliating pupils in the name of providing Career Guidance will haunt some teachers for the rest of
their lives.

The minister, however, implored pupils to develop interest in knowing and understanding themselves before they make a decision about the career each pupil wants to take.

And University of Zambia Manager for International Liaison and Public Relations, Mulenga Musepa, told the pupils drawn from all the seven districts in the province that it is not difficult to get a place at the university but that pupils lack knowledge on the courses and the subjects they will need to do for them to do a course of their choice.

Mr Musepa appealed to the pupils to consult their teachers when choosing a career.

Meanwhile, Dr Phiri has warned the teaching staff to stop humiliating pupils in the name of carrying out their duties as teachers.

Dr Phiri said teaching should not be perceived and taken as physic training but as a calling from God which has a lot of blessings once children become good leaders in society.

He noted that some teachers have a tendency of venting their anger caused by their personal problems on innocent pupils who are expecting professional conduct from the teachers to help them realise their dream careers.

Speaking at the same function, Muchinga Province Education Officer (PEO), Jobbicks Kalumba, said the objective of holding the Careers Day Exhibition is to give pupils career guidance and prepare them for future challenges.

Mr Kalumba explained that his office decided to host the provincial careers day as another platform of information sharing with both teachers and pupils while exchanging ideas on professional exhibitions.

Exhibitors at the Career Exhibition Day included Chilonga Nursing School, TAZARA Training School, University of Zambia and the Zambia College of Agriculture, Anti-Corruption Commission (ACC) Drug Enforcement Commission (DEC) Zambia Police, Zambia National Service (ZNS), Zambia National Commercial Bank ( ZANACO) Finance Bank, Indo Bank and Local Government.

Others were the Immigration Department, Zesco, Zambia Wildlife Authority (ZAWA), Drug
Enforcement Commission, Zambia Prisons Services, and the media.
The Provincial Careers Day and launch of the Campaign against Malpractice was held under the theme” EFFECTIVE TEACHING AND DEDICATED LEARNING, A PILLAR TO QUALITY ACADEMIC PERFORMANCE”.

ZRL to purchase new telecoms equipment, improve safety

8

Zambia Railways Limited (ZRL) says out of the US$120 million government has injected in the rail company, one per cent will go to the purchase of new telecoms equipment that will improve communication on the mainline and improve safety.

Exhibiting at the Zambia International Trade Fair after ten-years of absence, Zambia Railways Director for Marketing, Sydney Tembo, said part of the money from government will be used for the rehabilitation of some railways infrastructure and rolling stock and purchase of passenger coaches.

“There is an overfull demand for passenger services. People scramble to get on our trains because they are 20 per cent cheaper than road fairs. In order to meet our customer demand, we need to purchase 50 passenger coaches. 21 per cent of the money will go buying the passenger coaches while 11 per cent will go purchasing more wagons,” he said.

Mr Tembo said 60 per cent of the money will go towards rehabilitating the tracks and will result in improved speed capacity and in the end offer better service deliveries to customers.

He said by September this year, ZRL would have started receiving equipment to start rehabilitating infrastructure because the company has started the tender procedure and will soon find a supplier.

Mr Tembo said freight transportation is the core business of ZRL and the company is involved in the transportation of inter-mine, local, exports, imports and transit cargo for Zambian and regional economies, adding that with new and improved equipment in place ZRL will compete favourably and network with other countries in the region.

Mpulungu residents question CEEC application procedure

1

ceec

Residents of Mpulungu have questioned the procedure being employed by the Citizens Economic Empowerment Commission (CEEC) in selecting applicants for business loans to boost the fishing industry in the area.

The concerned residents have accused the commission of going against promises made on how the loans would be granted to citizens.

CEEC Director General, likandoMukumbuta, could not be reached for comment by press time as he was said to be locked up in a meeting whilst his mobile phone was off.

The complaints came after rumours that the commission had on Monday summoned five loan applicants from Mpulungu whose applications were said to have been approved out of the over 400 applicants.

Mpulungu District Loafers’ Association Secretary, Peter Sikazwe, said many applicants had been left with a lot of questions because the commission was allegedly going against its promises.

‘’We have information that only five people were called to Kasama and given acceptance letters after which they were told to develop business plans……but the procedure was that after the selection, a final list of those to be chosen was going to be stack at the notice board at the civic centre for transparency. So, why is there a sudden change?’’ Mr Sikazwe asked.

Mr Sikazwe wondered what type of citizens’ empowerment the commission was talking about if only five people could be picked out of over 400 applicants.

‘’There is a lot of unemployment around here, especially among the youths and women, and the soft loans could have helped the youths and boost the fishing industry in a way….Now if they pick just five, who is going to finish the KR 3 million?…Let us have some answers from the commission,’’ said Mr Sikazwe.

Sikazwe said the feelings of residents were that the ‘new CEEC’ would not be manipulated as was the case during the MMD government, saying the issue was serious and could make the PF government unpopular, especially among the youths and women.

And some of the beneficiaries spoken to said they were equally surprised by the ‘sudden secrecy’ by the commission, saying they only received phone calls to collect their acceptance letters in Kasama.

‘’It was a pleasant surprise! We were just called to Kasama and given the acceptance letters and we were told to engage people to develop our business plans even when the commission had promised to engage Business Plan Developers (BPDs) on behalf of citizens and they emphasized to keep this as confidential as possible. We also suspect that things are not well here, ‘’ said one beneficiary.

On March 13, 2013, CEEC Director General, Likando Mukumbuta, addressed Mpulungu residents where he explained that the commission had set aside KR 3million to give out as business loans to eligible citizens for investment in the fishing industry in Mpulungu.

‘’Zambia is among the top 20 countries in the world with abundant natural resources……but, sadly, our nation is also among the top 20 poorest countries in the world! So the government has said enough with the poverty, it’s time to empower the citizens,’’ Mukumbuta had stated.

He said the ‘new CEEC’ would strive to empower as many citizens as possible especially the youth, women and disabled.

‘’For Northern Province alone, we will give KR 3 million each for Mpulungu, Mungwi and Kasama to support citizens go into areas of fishing, groundnuts production and soya bean growing respectively….40 per cent of these monies will go to the youth, 30 per cent women, 20 per cent to support the disabled/physically challenged while the men will share the 10 per cent in each district,’’ Mr Mukumbuta said.

Mr Mukumbuta advised people to apply for the loans in line with the industrial clusters identified in each district.

He said the commission would only fund the districts for 2013 after which they would move to other districts the following year (2014).

By April, 15, 2013, the deadline for submission of applications, over 400 Mpulungu residents had pushed in their applications for the business loans.

Workers constructing Home Affairs offices in Kapiri not paid for months

1

Workers constructing the State-of-the-art Ministry of Home Affairs Offices in Kapiri Mposhi district have complained over none payment of their salaries for over nine months now.

Government engaged Risbel Enterprises Construction to build the Home Affairs offices in Kapiri Mposhi district at a total cost of KR33 million to house the ministry’s departments of National Registration, Passports and Immigration.

Risbel Enterprises is also building the Ministry of Home Affairs offices in Luangwa district at the same amount.

The workers complained to ZANIS yesterday that they had gone without pay for over nine months now.

Speaking on behalf of the workers, Laston Chirwa said some affected workers have even stopped work because of none payment of salaries by the construction company’s management.

But Risbel Enterprises Construction Director, Abel Chunga, said his company has not been paying salaries to its workers because of delays by government to finalize the payment for the project.

In a telephone interview with ZANIS today Mr Chunga said his company was still awaiting transfer of funds from the government.

Mr Chunga appealed to the workers to remain calm because government has assured the construction company that it will transfer the funds next week.
“Government has assured us that they will transfer the money next week… the process delayed because there is procedure in government which requires that the funds move from the Ministry of Finance to the Ministry of Home Affairs and then to us… otherwise we regret the inconvenience that we have caused to our workers,” Mr Chunga said.

Meanwhile, the construction of two Home Affairs Offices in Luangwa and Kapiri Mposhi districts have reached advanced stages.

Mr Chunga said over 95 per cent of the works have been done on the buildings and will be ready for handover to government soon.

The projects were supposed to be completed and handed over to government last year.

Once completed and commissioned the offices will solve the acute shortage of office accommodation for the departments of National Registration, Passports and Immigrations that currently rent in private buildings.

Acting Chief Justice is incompetent, abusing her office to please Sata-Kasenengwa MP

ACTING Chief Justice Lombe Chibesakunda
ACTING Chief Justice Lombe Chibesakunda (L)

Kasenengwa MP Victoria Kalima has launched a scathing attack on Acting Chief Justice Lombe Chibesakunda for alleged incompetence.

Ms. Kalima has since demanded that Justice Chibesakunda immediately resigns from her position in the interest of the nation.Ms Kalima said it has become clear that Justice Chibesakunda has continued to act in her position in order to deliver the PF’s wish of creating a de facto one party state.

She said, “Acting Chief Justice Chibesakunda is highly incompetent, she does not have the qualifications to head the Judiciary in this country. She was nominated for the purpose of pushing President Sata’s selfish agenda.”

“This woman should resign immediately. Infact I wish to appeal to her conscious if she still has one to leave the bench. She is way past her retirement age and Parliament has rejected her appointment. It is clear that she is not wanted by the Zambian people.”

Ms Kalima said the manner in which the Justice Chibesakunda’s led judiciary is nullifying MMD and UPND held parliamentary seats points to a conspiracy.

“There is no way a record number of seats could be nullified on sometimes flimsy grounds. This woman running our Judiciary is only there to serve her master who happens to be President Sata at the expense of democracy.”

She challenged the women’s movement to stand up and defend democracy in Zambia.
“We cannot continue sitting back and watching our hard earned democracy be butchered by a group of individuals who don’t mean well for Zambia.”

Moden Star appnt Kawilo as assistant coach

Ex-Nkana coach Benjamin “Kawilo” Chilongo has joined FAZ Super Division side Kalulushi Modern Stars as an assistant trainer.

Kalulushi Chairman John Mitonga confirmed on Friday.

Chilongo is assisting Kalulushi interim head coach and ex-Zambia international John Lungu.

Lungu was made caretaker coach earlier in June after Levy Chabala ditched the club to join Lime Hotspurs.

“We are with Benjamin Chilongo the former Nkana coach, he is assisting John Lungu,” said Mitongo.

Chilongo bounces back into coaching more than a year after being fired at FAZ Division One North side Chambishi.

The continued skyrocketing commodity prices since the removal of subsidies on fuel and agricultural product buttresses the resolve by the consortium of Civil Society Organisations (CSO) championing the Black Friday to continue the campaign until government finds a lasting solution in ameliorate the sufferings of the poor people in the country.

The rise in inflation by 0.3% as announced by the Central Statistics Office vindicates our argument on the negative impact of the government’s unilateral decision on the removal subsidies. In this regard, we are resolved to sustain the campaign and is so humbled by the overwhelming support from individuals, communities, CSOs and professional bodies.

In this vein, this week’s Black Friday Campaign was observed in the communities while sympathizers are urged to continue putting on black attire every Friday.

In preparation for the national prayer vigil coming in the next few days, Black Friday members and sympathizers are urged to visit and seek permission from various denominations and church leaders on Saturdays and Sundays to talk about the rising cost of living and the need for them to be part of the forthcoming national prayer vigil once the date is decided.
