Andre Mtine, 2 others arrested for money laundering

NDOLA resident, Andre Mtine, has been arrested along with two senior employees at Zambia Postal Services (ZAMPOST) in Ndola for money laundering and theft involving more than K100 million.
Drug Enforcement Commission (DEC) spokesperson, Rosten Chulu, confirmed the arrest of Mtine, 43, a Football Association of Zambia (FAZ) committee member along with ZAMPOST Finance manager, Gilbert Kapambwe, 42, and Financial accountant Ignatius Kapembwa, 49, all of Ndola.
Mr Chulu said in an interview yesterday that the three were arrested on Saturday and would appear in court soon.
In the first count, the three, who are on bond, were charged with theft contrary to cap 87 of the Laws of Zambia while in the second count, they were charged with obtaining money by false pretences.
The third count was money-laundering contrary to section seven of the prohibition and prevention of money laundering Act 14 of 2001.
The total amount involved is K110,737, 000.
“I can confirm that Andre Jabulani Mtine of 35 Lualaba road in Kansenshi was arrested on July 7, 2007.

He was arrested with two others namely, Gilbert Mofya Kapambwe Finance manager at ZAMPOST of 5628 Itawa extension and Ignitius Kapembwa Financial accountant of Kasusu road in Northrise,” Mr Chulu said.
He said Mtine was arrested as consultant and director of Riskmate Limited and charged jointly with the two ZAMPOST employees for the offences allegedly committed between January 1, 2004 and June 26, 2007.
“The three are alleged to have been making bank transfers from Africa Banking Corporation, money amounting to K110, 737,000 to Riskmate limited. They will appear in court as soon as possible,” Mr Chulu said.
When contacted, Mr Mtine refused to comment and referred the matter to his lawyer Chimuka Magubbwi.
Mr Magubbwi confirmed that he was handling Mr Mtine’s case.
“He is our client in the matter. This is a matter, which is coming up in court and we are going to defend it. We’ve not been given a date yet,” Mr Magubbwi said.
In Chingola, Police have arrested a Lusaka illegal currency dealer who was also found in possession of other stolen items.
Chingola Police chief, Felix Mulenga, confirmed the arrest and named the suspect as Sydney Mukosha, 23, of Lusaka’s Chaisa township.
Mr Mulenga said police received a tip off from members of the public who had seen the suspect dealing in currency.
“Following his apprehension, police officers went to search his house where they found a briefcase containing millions of money in different currencies.
“We also found him with a Laptop that helped us to trace the details of the owner. The suspect is detained in custody,” he said.
The currencies included United States dollars, New Zealand dollars, South African rand, travellers cheques, Indian Rupees, United Kingdom pounds, United Arabic Emirates currency, Nokia and Motorola Cell phones, two pieces of precious stones of diamond and emerald.
At the weekend, police arrested Evans Mwata Michelo, 27, who was trapped between burglar bars in his intention to steal from Mimosa Evertake Preschool in Chingola’s Kabundi north township.
Mr Mulenga said Michelo went to the school at night and squeezed his head in quite well but the body failed to go in and his effort to get the head out failed.
The suspect later started screaming for help as he swung between the burglar bars helplessly, prompting the people in the neighborhood and the owners to call the police.
He was arrested for felony with intent to steal.
Mr Mulenga said the two suspects would appear in court soon.
And Police in Lusaka have picked up a man who is alleged to have been planning to marry his niece.
Police spokesperson, Bonny Kapeso, said the man had been picked up by police to assist with investigations following a report on the matter.
Mr Kapeso said that the man has since been remanded in police custody while investigations have been instituted to establish the relationship between the two.

  6. Marrying ones close relative is a criminal offence. It is called incest.

    Medically we are told it is not advisable. Ofspring of such a union have high chances if deformities due to similar gene types with the same reccesive factors which would then become domininant in the Children.

Investigations on issues of interest takes many ways among them being rendition, publicly announced detention, and consensus based interviews tedious or otherwise.So Ba Joze considered a pervert by many in society could be detained to establish if he is being the pioneer of that line of perversion about to wreck our society. That is how homosexuality started now engulfing the world. It is an abomination in our society. It was Andre the major culprit. Under customery law you are not allowed to marry your close relation because of medical problems that can result from such a product .i.e disabilities. Moreover we distinguished animals we are not like dogs, monkeys, who dont have morals. Morality is not just delivered from the bible its a foundation of any society. In addition we have values and norms. In Zambia we have a problem e.g. Mwansa Mbulakalima is still FAZ member despite hold a two senior positions MP and CB minister. How do you expect someone to perform with such amount of work no wonder people like Andre Mtine resort to stealing because is a short cut to get rich and there is no punishment for it

His opening statement reads “I know that marrying ones niece is a taboo but is it a crime?” From a moral and religious stand point we are all against that. But is it a crime ? Shouldnt this issue be handled by elders in the community and church leaders intead of the police intimidating the man. When a person gets to such a position they need psychological help.

I dont think from a legal stand point intending to marry his niece is a crime. But it is moraly wrong. Arresting him is not a solution. we know the Zambian justice system is broken down. This guy can be put in Chimbokaila for 20 years before he even sees a judge. Issues like this should be left to society to deal with and not the police. The other thing is why are we not talking about the niece herself. She is the problem here. She wants to marry her uncle. She willingly started living with her uncle.   23. I agree that Singogo is a pervert, but morality and the law do not always coincide, in fact law is always behind. What Chapi asked is a genuine question which, bieng in the diaspora, I have also wanted someone at home with access to the Zambian penal code to educate us on. Some of us who were old enough will remember that VJ, when arrested for dealing in Mandrax back in the 80’s won his case simply because, while his actions were considered morally abhorent, there was no law against dealing in Mandrax.

    Let us use this forum for honest and well informed debates. So somebody please tell us, what is the legality of ZP detaining Singogo? Those are the kind of quesions judges and the law have to contend with, not moral opinions.

    I would like the ZP to state something Like “contray to section so and so subsection blah blah..” If the law does not exist, or does not cover this particular offence, then it is high time Parliament legislated or ammended the law.

    The other thing here i think you are confusing morality with legality. As Chapi and everyone here stated its a taboo to even contemplate marrying your niece. But its not a crime. The police and the justice system can not resolve moral issues. They are there to deal with legal issues. Like i pointed out, almost all the 73 tribes in Zambia permit marrying with in the extended families i know bembas allow cousins to marry. In other parts of the world thats un heard off. We have to put things into context. Moral vs Legal. I know Zambia operates on both constitutional and trditional rules. for instance legal marriege is by the marriege certificate. our parents got married traditionally. they dont have marriege certicates but they are maryed

    Singongo is only limited by Law and Social norms in his desire or decision to marry his niece. The law can easily be defeated using a agood argument and provisions.
    The Bibilcal argument wont hold as Lotti and also Adam/Eve and his populating the whole world is of incest basis whatever argument you present. The conclusion is incest can be permitted inspecial circumstance.
    Medically, we discourage close/inter-breeding or having children with family members. This is to avoid undesired genetical abnomalities which exist in some families. We encourage Genetical spacing for de-benefit of human Kind . The spacing however is dependant on a number of samples available and their reliability, and affordability to breed.
    I hope the police wont use their myopic eyes and push singongo and his niece underground.

  30. Let us assume, Singongo and Ngabo’s Mother have the same Biological Father(Partenity test). This makes them achieve over 99.95% partenal and Maternal heredity and can easily be matched 1 to 1 or most traits. If thier Mother cheated, and they have different fathers but same legal father this complicates..These things happen(VISA appl 4 USA Mudala). If Singongo and Ngabo Mother have no known dyfunctional conditions, then Singongo has things his way, on the basis that..Ngabo has a dirrent Father(assuming it not family again)..

Police have misdirected themselves in remanding this person in custody – calling him in for questioning is a different ballgame altogether & would have been the most reasonable course becoz we don’t live in a police state & we expect the police to know their remit & not respond to knee jerk reactions. Abhorrent as his utterances may be, he lives in a society which gives him his freedom to air his views, the onus is on society to correct his warped thinking, not throwing him behind bars, as he has not commited any crime whatsoever – unless anyone has proof to the contrary. I think he has every right to sue the state for false imprisonment as things stand! Police should be chasing up others in Mtines league such as Mpondela who persistantly fail to account for public funds & not two naive-love birds – who are very soft touch.

As Andre and the others have been charged, it would be good to look at the outcome of the courts as a person is innocent until proven guilty. We have seen so many cases withdrawn by the state. If they did something wrong, the law will take its course. Though I have been leaving abroad for the last 15 years, am told Tom Mtine is still one of the old timers who manages to look after himself and still maintains his standards despite his old age. I asked some of my freinds in Ndola who informed me the man still maintains his standard of life due to his wise investments. SAGE and HK, please lets not just open our mouths without thought?
