Court hears PF injunction

The Lusaka High Court has this morning been hearing an application for an injunction against Patriotic Front Leader, Michael Sata from filing in his nomination for the October 30 poll.

The injunction by PF Kasama member of parliament Xavier Chishimba said this is because no convention was held as per party constitution to appoint Mr. Sata to represent the opposition party.

Mr. Chishimba said he is also interested in contesting the Republican Presidency on the PF Ticket.

This is contained in an application filed in the Lusaka high Court Monday.

Dr. Chishimba contends that he is an interested and disadvantaged PF member who wanted to stand for the PF presidency.

He argues that Mr. Sata’s presidency in the PF is ultra vires to the party constitution that requires that the party holds a convention every five years but in vain.

Dr. Chishimba foiled Mr. Sata’s scheduled filing in of nominations before the Supreme Court by applying for an injunction against it.

The application for an injunction sent shock waves among angry Patriotic Front members who trooped to the Lusaka High Court and sang songs in solidarity of their party president.

Dr. Chishimba’s lawyer Mutakela Lisimba and Mr. Sata’s lawyers Bonaventure Mutale, and Edgar Lungu were locked for over two hours in chambers of a Lusaka High Court Judge.

According to a statement of claim filed before the Lusaka High Court, the Patriotic Front has been in existence since 2001 but has never held a convention appointing anyone as PF presidential candidate.

  57. That boy Akashambatwa is stepping down as Anti Corruption Commissioner(ACC). This is good news because we can’t have an active politician like him serving the ACC. It is unethical and just down right wrong. These were some of the appointments that LPM(MHSRIP) created just for the sake of it. I guess people now have the courage to deal with matters like this now that things have changed. Aka has also been influenced by Thabo Mbeki’s move of stepping down as head of state. It looks like Mr. Sata will form the next gov’t but it would have been nice had Sata and HH worked together. The tribal divide is getting wider which is not good for our young democracy. Whatever we do, let us work together.

The Zambian courts are indeed kangaroo courts, how can they allow a 72 years old man with a serious heart problem who only a few months ago had to be airlifted to South Africa, unconcious, to successfully file in his nomination papers for the office of president? Worse still, how can this be coming so hot on the heels of a state funeral of a dead president whose health was a disaster and they also allowed to run. Given their disrespect for the provision in our constitution that requires every candidate for this office to be of sound health, they’ve doomed us in for another state funeral. This country is hearded for disintegration, period.

  82. #73, the indicator shows that Rupia Banda is losing the election hence the extension of a hand to people like Chiluba, Maureen Mwanawasa to help. The MMD is divided more than what you can see.
    They have not made much ground as claimed.. Just watch the campaign trail you will see a pattern of their campaign, going to areas where they think they have support.. But the response is lukewarm.
    The Scale still in favour of PaBwato in all MMD stronghold except the 2006 eastern which swang to the MMD from UNIP/FDD. The status quo is that, PF commands a huge Majority with HH closing on,..Banda panting far third.

    I think on that matter of areae campaign you are wrong if you follow the campaign trail as you have done you will find that other areas have already indicated support for MMD the areas you say the welcome is not good they already know that because just by going there they will gain a few votes.
