United Party for National Development (UPND) Leader Hikainde Hichilema has accused President Michael Sata of beginning the construction of his retirement home at a cost of K1.4 billion while he is a sitting president. According to the statement, this action is a violation of the republic constitution which only provides such privilege to a former head of state.

CONSTRUCTION OF FIFTH REPUBLICAN PRESIDENT’S HOUSE

Early this year, we alerted the nation that Mr. Sata had begun constructing his retirement home near state lodge illegally using government resources.

Government spokesperson Hon Kennedy Sakeni refuted our assertion and alleged that we were bitter and chocking with envy after the 2011 electoral defeat.

Lies have a very short life span and we have been vindicated.

Mr. Sata sent his uncle Hon Alexander Bwalya Chikwanda as a bearer of a message to Parliament to solicit for K1.4 billion for the construction of his house. Page 911 of the yellow book attest to this.

Our contention is that our laws do not provide for such type of expenditure. This is a clear violation of our statutes. Act number 21 of 1998, chapter 15 section 4a states as follows:

“assigned to a former President within a period of not more than two years from the date of ceasing to hold office, a furnished executive house built or bought in Zambia by the State at a place of the former President’s choice”.

Clearly, this is a benefit given to a former President not a sitting one. Is Mr. Sata a retired, sitting President? We are concerned that Mr. Sata has continued raping our constitution with impunity. If Mr. Sata had any sense of morality, he would have concentrated on paying retirees who have already worked for their money than paying himself a retirement prematurely.

We call on all Honourable Members of Parliament across political divide to do the honourable thing by stopping this reckless, proposed spending.

This level of self aggrandizement is unacceptable especially that houses for the second, third and fourth former Republican Presidents are not completed. If this reckless expenditure is not stopped in Parliament, UPND shall explore other democratic options available.

      Have you even looked at the figures of the other presidents allocations for house? Have you also looked at the dodgy document with 708-715 items are missing? Have you also forgotten the confusion with the 3rd presidents problems of plots and housing issues? Maybe the previous government made a statutory amendment to ensure that plots are secured before presidents leave office. I personally think it’s a good move to save money,we have paid quite alot in rentals for former presidents and Zambians are in in agreement.

  30. This is really interesting to an analytical mind. There are succession fights in PF as we read between GBM and Kabimba. Then we read that the President has started contructing his retirement house. This makes one wonder whether GBM and Kabimba know something about our current president’s tenure office. Maybe he has hinted he will not stand in 2016 giving way to young ones to take over (I would support him for this) or they are privy to circumstances that may lead him or his family to ocuppy the retirement home. Our president is a man of action but this time he is acting too early. I still believe he has a chance to leave a good legacy if does the right things. This can also eliminate fears of harrassment once he leaves power.

  38. The statement says “president sata has began…” meaning the structure is visible and if we are given the plot number we can just drive to see it. Or just provide as with a picture. But this I know will not happen because another law suit will come from the real owner of plot. What is being provided as evidence is Mr Sata sending his uncle to parliament. Did his uncle reach parliament? did he deliver the messege. What did parliament say?

  48. I have not read the Yellow Book. If indeed it refers to construction of 5th President retirement home then clearly this is illegal and immoral. If indeed the houses for last 4 Presidents have not even been constructed this is overly self serving for a President that professes to be a Christian (ie treating others equally to paraphrase a commandment from the Bible) and who undertook an oath to uphold the constitution. An objective clarification from State House (not recent Shamenda type re Miyanda) would put the matter to rest I am sure

How about the house for FTJ, LPM and RB, where are they. Let these past presidents have theirs erected first and he should wait for retirement as per Constitution.

  74. Can lawyer clarify how building a house now is breach of the constitution…if this house built is the property of GRZ until sitting president ceases to be in office? On ZWD I have read the Law in Question and Page 911 Yellow Book..it clearly state the former president should be built/bought a house within 2 years of leaving office. What is breach of law if it is being built in advance its still GRZ property until Sata retires. Actually building now saves GRZ a lot of money because straight from Plot One Sata goes into this house…NO GRZ renting Sata’s Rhodes Park home until the house is built as they did when Sata became President & State House was under renovations. Build now save money becoz what will K1.4bn house now cost to build 2016 or 2021? Make sure to employ youth “daka boys”

  79. Those of you who disputing what HH is saying, get a copy of the 2013 yellow book (budget) and go to page 911. Check on Head 51/07, programme 1012 and activity 716. The evidence is there in black and white. We do not need any further evidence. HH is 100% correct about what he is saying. I encourage fellow Zambians to go through the 2013 yellow book instead of just insulting HH. The yellow book is already in the public domain. It is not a secret document. Those who can afford, the document can be bought from government printers. You can also refer to the photocopy on the Zambian Watchdog.

  82. I really feel for Zambia with the comments I am seeing on this site. It would appear that people do not know what a yellow book. What the Minister reads in Parliament is just a speech and the yellow is the actual budget for the country and that is what HH is presenting as evidence. So for people to still be asking for evidence is really shocking to say the least. The other evidence is what the constitution say. there a lot of pressing issues that that money can be used for. And for The Real Steel -It is quite naive to think that the 1.4 billion is the total cost. that amount is just for preparatory works.

  85. You Zambians read the law about benefits for former presidents. The law states clearly that a house can only be built for a FORMER president AND NOT a sitting president. Houses for the second, third and fourth presidents have NOT yet been built but SATA is in a hurry to finish his house. Mind you Sata has just clocked one year in the office and he is already constructing his house. Why is he in such a hurry? Has he sensed danger ahead? This is the first time such a thing is happening in the history of the presidency in Zambia.

  89. If the constitution states that a house must be constructed for a former head of state, then what Sata ia doing as alleged by HH is good. How much money is government losing in renting that lodge for RB? Is it better to build theme houses or continue renting huge properties while their houses are under construction? I personally do not agree with the issue of building former heads of state houses but i guess it is ok bearing in mind that after they leave state house they need some respect and dignity.   107. It is like you get a job today and you apply to get your pension when you have not even served your full period of service. If the conditions stipulate that you get your pension after 25 years of service so be it. This is purely violation of conditions of service. If this is what is happening then all the employess in Zambia should force the government to pay them their terminal pension benefits even if they have not yet reached their 25 years or 55 years of service. Stop condeming HH.

The former presidents from the 2nd to the 4th have all been accorded 2.5billion in this budget. 2. The insertion of the issue at hand from 707 and jumping to 716 where the mention of the 5th presidents house is mentioned is quite suspect,looking at it from an AUDITORS eye. 3. Is there no change in how former presidents houses are built? considering the Embarassing situation of our 1st President staying in rented house.

  115. This is yet again clear evidence of abuse of office by President Sata, at the expense of job creation for the youth who put him into office. Every single blogger on this site who calls himself a Zambian and is defending this type of behaviour must pause for a moment and think about the effects of the President’s behaviour on your less privileged brothers, sisters, cousin, nieces, nephews and childhood friends in Zambia before blogging. Parliament will have to step in and restore order if we are to have some semblance of rule of law in our Country. This behaviour from our President is an affront to all well meaning Zambians. 

  116. 1. Hon Alexander Bwalya Chikwanda may be President Sata’s uncle but this fact is irrelevant in this issue and therefore the relationship should not have been mentioned.

    2. Act # 21 of 1998, chap 15-4a: “assigned to a former President within a period of not more than 2 yrs from the date of ceasing to hold office” does’t imply it can’t be built during the president’s tenure. The house can be built now and “assigned to [Mr. Sata] within a period of not more than 2 yrs from the date of ceasing to hold office”

    3. HH mentioned that “houses for the 2nd, 3rd & 4th former Republican Presidents are not completed”. Considering the time it takes to build a house of a former president in Zambia, the current government maybe in order to start now.

    The law has many ways of interpretation. But if you are a fault-finder, you will find fault in anything. It is good to give people a benefit of doubt and that they may mean well at times. To me I do not see anything wrong to start building a house for the president now. Actually, he is supposed to move into the home a day after leaving office. So when do we start building?

  118. When do we start building indeed, after the president leaves office? What is wrong is giving the retirement home to a seating president. The problem with thinking such as that of HH is that there is lack of planning for the future. Chiluba died without seeing his entitlement, Mwanawasa’s family is still wating for their entitlement. Banda is living in a house he built while in office “without” using government funding. He is still waiting for his entilement. We should learn from history to prepare for the future. 2016 is here and if HH you are not preparing now, 2016 will leave you in the dust. PF or other governments will call you bitter in 2017. Be prepared. Plan for the future. The only message you have given today is that you do not know how to prepare or plan for the future.

    Appointment Time is 14:00 hours. A person leaves home at 14:00 hours and arrives at the meeting late. Normal?

    Retirement Home to be assigned to the former president is within 2 years of ceasing office. The government starts constructing the house after the president ceases office and hands over the keys to the house 10+ years later. Normal?

    HH I really thought that you could bring change to this mentality. Now you are fighting to maintain the status quo of the Zambian time concept.

  120. A former President’s retirement home must be ready for occupancy when the president retires. A sensible and prudent government should plan for that. Hence, the current PF government is doing the right thing. We have all seen how KK suffered for a long time in a rented house. Up to now the late FTJ’s home and late Levy’s home have not been built. At this rate, RB may have to wait for another 10 years before he can even ask for his retirement house. Is this what HH would like to perpetuate? Sata has seen all this, and is playing it safe. The constitution should include such a provision and state a standard reasonable package to ensure that a sitting president does not abuse the system and build himself or herself a palace.

  131. Please Bembas stop insulting and disrespecting the Tonga speaking people they are not your tribal cousins. Tongas are just honest and down to earth people and you must not feel intimidated by them. They are welcoming and accomodating people as evidenced from lots of Bemba’s living in Tonga land. For once please lets not be tribal and racist becuase this is being uncivilised and intolerant. Zambia is for all Zambians and let us not divide the country with this tribal attitude. There are a lot of intermarriages nowadays a sign that Zambia is one. I just hope that those who hate Tongas feel the way they must feel…shameful. If you think bemba is superior go speak it in Mongu or Kalabo, then you will get the answer.

  132. The K1.4 billion budgeted for and showing in the yellow pages is for construction of houses for  retired Presidents. It is not meant for seating president but for retired/ deceased President. No where does it state that the money is for seating President Sata and if it did would be unconstitutional. Of the 4 Presidents only Kaunda’s has been completed. Mwanawasa’s is yet to start (I believe), while for Chiluba – it should never be built since he is dead and that right does not extend to surviving beneficiaries of retired Presidents – this is very different from serving President that dies on duty (Mwanawasa). Banda has yet to select ground for construction. The K1.4 billion is estimate to cover Mwanawasa, and Banda house. As for Sata there is nothing wrong in putting an estimate of K1 

  133. Not only do Zambians have poor reading culture, they also have poor memory. When RB increased salaries for MPs and the presidency, Zambians and the POST condemened day and night. When SATA increased the figures RB left by 100% no one said a thing and HH was attacked when he revealed this information. For as long as we don’t condemn what is wrong, Zambians shall forever remain poor. We are not helping SATA or the PF by supporting even wrong things. If HH said in the Bible John 11:35 reads “Jesus Wept”, Zambians would ask for proof and for pictures of the verse. How amazing! for once LOOK AT THE MESSAGE NOT THE MESSENGER.

If u do as zambians we will not rise from our knees until the lord answers our prayers. how many hospitals are going without basic needs for the patient? the list is endless. talk about roads in zambia, No operating ambulances anywhere,ect ect, now how can a sane president start building a mantion for his family at the cost of the citizen? my prayer is that all this is lies. if this happens mr president the blood of all those children dyng in our hospitals due to lack of vaccines and decent facilities will be on your head.. we are hopeless as zambians because of the selfishness of our politicians all we can now do is ask god all might to help us..we will continue to pray untill the lord scatters all evil politicians.just watch!.
